Gabriela Richeimer to Speak at ABA Program
RDB partner Gabriela Richeimer will be a featured speaker at the American Bar Association Tort Trial and Insurance Practice Section's 15th Annual Insurance Coverage Litigation Committee Midyear Program. Law & Politics has been publishing Super Lawyers for 16 years. According to Mr. William C. White, publisher of Law & Politics, the selection process involved the following:

The general survey process began in May 2005 when the Ohio Super Lawyer staff mailed more than 28,700 ballots to lawyers across Ohio. They asked lawyers to vote for the best lawyers they have personally observed in action. Each lawyer was given a score based on the number of votes received. Votes received from lawyers in other firms were awarded significantly more points than votes received from lawyers in the same firm. Lawyers who received only same-firm votes were eliminated from the list of candidates.

As part of the screening process, the Ohio Super Lawyer staff also kept track of “back-scratch voting”; that is, two lawyers voting for each other. Indications of back-scratch votes eliminated that lawyer from the list of candidates. In addition to the general survey, the research staff reviewed the credentials of Ohio attorneys and assigned points based upon defined evaluation criteria. The Ohio Super Lawyer staff also conducted research on candidates to ensure that the lawyer is properly licensed, is in good standing with the Bar, and has no history of disciplinary actions.

A blue ribbon panel consisting of the top vote-getters from the general survey was assembled for each area of practice. These panels reviewed the list of nominees in their areas of practice. The blue ribbon review process yielded a positive or negative point total for each nominee. This point total was then added to the lawyers’ scores.

The point totals from the General Survey, Screening Process and Blue Ribbon Panel were added to arrive at a final point total. The final point totals were then segregated by firm size (small, medium, and large). Top vote getters from each of the three firm size categories were selected to identify the top attorneys in the state of Ohio, “Super Lawyers”, generally consisting of the top 5% of the attorneys in the state. The list of Super Lawyers includes lawyers in private practice, as well as lawyers in non-private practice, such as prosecutors, in-house counsel and public service lawyers.

Gray Plant Mooty Attorney Adam Nathe Honored as one of “25 On The Rise”
The law firm of Gray Plant Mooty is pleased to announce that Adam Nathe has been honored as one of “25 On The Rise” by the Hispanic Chamber of Commerce and recognized in the January 2007 issue of Twin Cities Business Monthly.

With this recognition, Nathe was honored by The Hispanic Chamber of Commerce of Minnesota as one of a select group of 25 recognized and aspiring young leaders in the Latino community in 2006. Each year the Hispanic Chamber of Commerce honors twenty-five young changemakers for their contributions to the Latino community in Minnesota and for their achievements in the past year. The “25 On the Rise” initiative has several goals, including, celebrating the achievements of young Minnesota Latinos, and showcasing recognized leaders as role models for other young Latinos.

Adam Nathe is an associate in the Minneapolis office of Gray Plant Mooty. He practices in the areas of Commercial Financial Services and Mergers and Acquisitions. Nathe received his law degree cum laude from the University of Wisconsin Law School in 2002. He completed his undergraduate studies at the University of St. Thomas in 1993, and earned a Master of Business Communications degree at St. Thomas in 1999.

Nathe has been involved in numerous diversity, pro bono and community initiatives in his first few years of practice. Currently, he is co-chair Gray Plant Mooty’s Culture and Diversity Committee, co-chair of the Twin Cities Committee (TCC) on Minority Lawyers in Large Law Firms, an active member of the Minnesota State Bar Association Diversity Committee, the Minnesota Hispanic Bar Association, Hispanic National Bar Associations (HNBA), the Minnesota, Wisconsin and American Bar Associations, is helping to coordinate the 2007 HNBA Mid-year Conference that will be held in Minnesota, and is active in the Twin Cities Diversity in Practice, Voluntary Lawyers Network, Community Capital Alliance, and several other community organizations.

Firm Names 11 New Members
Frost Brown Todd LLC, one of the region’s largest full-service law firms, is pleased to announce the appointment of eleven new Members throughout the Firm. Attorneys Kim Amrine, Bill Becker, Kasey Bond, Whitney Calvert, Deanne Clarke, Matt Gunn, John Higgins, Adam Kegley, Bill Paliobeis, Noel Shepard, and David Walulik’s Membership will be effective January 1, 2007.

Kim Amrine, of the Cincinnati office, concentrates her practice on complex business litigation and advertising law. She represents clients in many forms of complex commercial disputes, including business disputes and class action matters. She also counsels clients on various advertising law issues, including pre-publication review, contests and sweepstakes, formal and administrative advertising challenges and federal court litigation under the Lanham Act. Kim also serves as the Firm’s first Director of Diversity.

Bill Becker practices in Louisville’s Labor and Employment Department with experience covering all areas of employment law, with a focus on wage and hour law, employment discrimination and harassment, and affirmative action. His practice includes client counseling and litigation.

Kasey Bond, of Cincinnati’s Labor and Employment Department has experience arbitrating grievances for unionized employers; representing employers in unfair labor practice proceedings before the National Labor Relations Board; counseling employers regarding various union issues, including organizing campaigns and union avoidance; representing employers in litigation involving claims under Title VII, ADEA, ADA, FLSA, and FMLA; representing employers in proceedings before the EEOC; and counseling clients regarding miscellaneous employment issues, including wage-hour, family and medical leave, discipline and termination issues.

Whitney Calvert practices in the Lexington office, focused on general corporate law, with a special emphasis on matters related to the coal industry. She assists clients in negotiating, structuring and documenting mergers and acquisitions, including equity interest and asset sales, and other business transactions. She also advises clients with respect to company formation, organizational issues, and other general corporate matters.

Deanne Clarke practices in Cincinnati’s Commercial Transactions/Real Estate Department. She focuses her practice on a wide array of commercial real estate transactions, including development, acquisition, sales and leasing, for office, retail, commercial and industrial uses. She works regularly with developers, landlords and tenants in connection with shopping center transactions, as well as other regional, national and international clients in connection with the acquisition and leasing of new locations, along with the sale and leasing of existing locations.

Matt Gunn has practiced for more than six years in Louisville’s Immigration Group. He represents clients in a wide array of business immigration matters with particular emphasis on Nonimmigrant and Immigrant visas for degreed professionals, intracompany transferees, and Trade NAFTA professionals.

John Higgins is a litigator and a member of Cincinnati’s Construction Law Group. He has tried cases to jury verdict and participated in various injunctive hearings. He has litigated cases before the Ohio Supreme Court, the Sixth Circuit Court of Appeals, and in various other states throughout the United States. He has successfully represented construction managers, general, trade, and specialty contractors, suppliers and project owners in litigation, mediation and arbitration.

Adam Kegley practices in Lexington’s Commercial Transactions and Real Estate Department. He practices primarily in the area of bankruptcy and has represented debtors, debtors-in-possession, creditors and creditors’ committees in bankruptcy cases, as well as parties to bankruptcy adversary proceedings.

Bill Paliobeis, of the Cincinnati office, practices in the area of medical malpractice and insurance defense. He has experience representing a wide array of healthcare providers including several of Cincinnati's largest hospitals and physician groups. He also has experience representing individual physicians, nurses, physical therapist, pharmacists and other healthcare specialists in all types of professional liability matters. In addition, he handles personal injury matters involving premises liability, work-place accidents and intentional torts.

Noel Shepard, of the Columbus office, represents clients by performing general employment defense litigation and a variety of other employer-related legal consulting services. She also represents employers regarding all aspects of workers’ compensation, including; cost management and containment, accident investigations, violations of specific safety requirement (VSSR) and other related matters.

David Walulik practices from the Cincinnati office as a commercial litigator, specializing in insurance, banking, and other complex commercial cases. He represents a wide range of clients in these industries, including insurers, financial institutions, and corporations.

Buckingham, Doolittle & Burroughs Announces That the Law Firm of Kaufmann & Kaufmann Will Join its Akron Office
Buckingham, Doolittle & Burroughs, LLP is very pleased to announce that the law firm of Kaufmann & Kaufmann has joined the firm’s Akron office. This addition brings three new attorneys to the firm, enhancing the services of its Trusts & Estates Practice Group.

The new attorneys are Philip S. Kaufmann, Loma L. Swett, and Steven P. Mutersbaugh, all with Kaufmann & Kaufmann of Akron. In addition, the group will be strengthened with the support of two paralegals, a law clerk, and an administrative assistant, all of whom will be joining the BDB team from Kaufmann & Kaufmann. Philip S. Kaufmann, who joins Buckingham as a shareholder, was formerly managing partner of Kaufmann & Kaufmann in Akron, Ohio. His practice areas include estate planning, probate, guardianship, Medicaid planning, corporate law and disability trusts. A graduate of Loyola University, Mr. Kaufmann earned his juris doctorate in 1971 from The University of Akron School of Law. He is a member of the Akron (Probate Section), Ohio State (Probate Section) and American Bar associations, and is admitted to practice before the U.S. District Court, Northern District of Ohio; the U.S. Tax Court; and the U.S. Supreme Court. He is listed in the current edition of The Best Lawyers of America and Leading Lawyers in Northeast Ohio, and has been selected as an Ohio Super Lawyer, Trusts. He is a fellow of the American College of Trust and Estate Counsel.

Mr. Kaufmann is involved in many community activities including Chairman of the Board of the Village of St. Edward Foundation, Chairman of the Board of the Akron Bar Association Foundation, Chairman of the Board of Community Fund Management Foundation in Cleveland, Vice-Chairman of the Board of Trustees of the University of Akron, Secretary/Treasurer of North Coast Community Homes in Cleveland, a member of the Salvation Army Advisory Board of Summit County, and a member of the Blossom Music Center Board of Overseers. Loma L. Swett, who joins Buckingham as a partner, was formerly at Stark & Knoll and Matz Petersilge & Weimer before joining Kaufmann & Kaufmann. She focuses her practice on estate planning and trusts, estate administration, guardianships, estate planning for the disabled and elder law. A graduate of Stetson University, Ms. Swett earned her juris doctorate from The University of Akron School of Law in 1980 passing the bar exam in 1980. She is a member of the Akron, Ohio and American Bar associations. In addition, she has been licensed to practice law in New Jersey since 1990.

Steven P. Mutersbaugh, who is joining Buckingham as an associate, focuses his practice on estate planning, probate, estate planning for the disabled, elder law and corporate law. A graduate of the University of Findlay, Mr. Mutersbaugh earned his juris doctorate from The University of Akron School of Law in 2002. He is a member of the Akron (Probate Section), Ohio State (Probate Section) and American Bar associations and the Tax and Estate Planning Council of Akron. He has been selected as a 2006 Ohio Super Lawyer Rising Star.

Experienced Litigator Joins Blackwell Sanders
Blackwell Sanders is pleased to announce the addition of Stephen R. Clark to the firm’s Litigation Department. Joining the St. Louis office, Clark will continue his national practice, litigating on behalf of clients within the telecommunications, securities/financial, retail, chemical manufacturing, real estate and construction industries.

Clark was a shareholder at Polsinelli Shalton Welte Suelthaus PC (1999-2006), and he will continue to serve as lead counsel for a national telecommunications company in a number of state-wide tax disputes. Several sate and federal lawsuits are the subject of recent legislation in which Clark will maintain his key role.

Prior to joining Polsinelli, Clark was a partner and associate at Greensfelder, Hemker & Gale, P.C. from 1991 to 1999, where he tried numerous jury and non-jury trials. Clark began representing telecommunications companies in the early 1990s and has continued to do so since. Clark also has experience litigating substantial business disputes as well as ERISA and labor and employment matters.

Clark received a J.D. from Saint Louis University (1991) and a B.A. from the University of Notre Dame (1988).

Kramer Levin Wins National Law Journal 2006 Pro Bono Award
The National Law Journal has selected Kramer Levin from among scores of nominees to receive one of the publication's four Pro Bono Awards for 2006. The award recognizes the firm’s “singular achievement” in litigating a high-profile federal case that was the first to hold that private voter registration drives are protected by the First Amendment. League of Women Voters of Florida v. Cobb, 447 F. Supp. 2d 1314 (S.D. Fla. 2006).Â

In a related feature article published in the January 1, 2007 issue, "Voting case smashed barriers," the Law Journal reports how partner Eric A. Tirschwell and senior associates Craig L. Siegel and Erin A. Walter helped the League of Women Voters of Florida and other nonprofit groups win a federal injunction striking down a burdensome and discriminatory Florida law that had shut down most nonpartisan voter registration efforts in that state. The ruling had cleared the way for the immediate resumption of voter registration efforts in anticipation of the 2006 November elections.

The article quotes Deborah Goldberg, director of the democracy program at the Brennan Center for Justice at NYU School of Law, as saying that the case is on the leading edge of voting rights jurisprudence and notes that it has already been cited in rulings in other states striking down voter registration restrictions. Wendy Weiser of the Brennan Center and Elizabeth S. Westfall, senior attorney with the Advancement Project, both co-counsel in the case, are also quoted praising Kramer Levin for its commitment to the litigation and the quality of its work in a high-pressure situation.Â

The article notes that Kramer Levin has devoted more than $1 million in billable time to the case, a significant undertaking to a single matter for a firm of 300 lawyers. In addition to the attorneys recognized in the article, the Kramer Levin team included associates David A. Landman and Emily J. Groendyke and paralegal Sandra Wong. Partner Jeffrey S. Trachtman assisted at the preliminary injunction hearing. Summer associates Pamela Swidler, Kathleen Pirozzolo, Amelia Martella, Joseph Shifer and Abdul-Rahman Lediju also assisted on the matter.Â

Kramer Levin continues to serve as pro bono co-counsel as the district court’s decision is now on appeal before the United States Court of Appeals for the Eleventh Circuit.
