LAMB McERLANE ATTORNEYS TO INTRODUCE “THE APPELLATE WHEEL OF (MIS)FORTUNE” AT STATEWIDE BAR PROGRAMS IN JANUARY
Attorneys James C. Sargent, Jr., Scot Withers and Joshua Villari of Lamb McErlane PC, a full service law firm in West Chester, and Dean Phillips of Elliott Greenleaf and Siedzikowski in Blue Bell, will present “The Appellate Wheel of (Mis)Fortune,” a series of CLE programs for the Pennsylvania Bar Institute, this month to demonstrate the strategic opportunities, common mistakes, and procedural pitfalls associated with appellate law practice.
The “Appellate Wheel of (Mis)Fortune” programs will be held from 8:45 a.m. to noon on three separate dates across Pennsylvania: Friday, January 12 in Pittsburgh, Friday, January 19 in Philadelphia, and Tuesday, January 30 in Mechanicsburg. The course, designed by Pennsylvania Bar Association Appellate Advocacy Committee Co-Chairs the Hon. Mary Jane Bowes, Pennsylvania Superior Court and James Sargent of Lamb McErlane; and Dean Phillips of Elliott Greenleaf, will focus on practical problems encountered by appellate attorneys, as well as technical requirements for the rules of appellate procedure. The format will include an interactive game show question and answer segment entitled “The Appellate Wheel of (Mis)Fortune” that addresses recent court cases to reveal common procedural mistakes that may damage a claim’s chances for success. In particular, the course will look at controversial rule 1925(b), which provides strict standards for filing cases on appeal, including recent changes and developments in its application.
“ ‘The ‘Appellate Wheel of (Mis)Fortune’ provides an engaging and entertaining format for attorneys to learn about the recent court decisions that impact the practice of appellate law and procedural pitfalls that often prevent otherwise viable claims from being heard,” says Sargent, who is also a member of the Appellate Procedural Rules Committee for the Pennsylvania Supreme Court. “This type of course is a very user-friendly way to obtain information and unique perspectives from a highly respected panel of experts who cannot be accessed together anywhere else.”

Mr. Wasserman addressed the differences between FDA's 510(k) certification and premarketing approval (PMA) for devices.

Partner Comments on Enron Task Force
Partner Barry Pollack of the Litigation and White Collar Crime Practice Groups, was interviewed by the Houston Chronicle after a judge overturned the conviction of Kevin Howard, the former finance chief of Enron's broadband unit. Howard was convicted of five counts of wire fraud, conspiracy, and falsifying books last spring. Mr. Pollack won an acquittal for Howard's co-defendant, Michael Krautz. In his interview with the Chronicle, Mr. Pollack commented that the government's Enron Task Force had used very aggressive legal theories that, so far, have not stood up on appeal.

Miller & Chevalier Names Three New Members
Miller & Chevalier Chartered announced today that it has elected three members to the firm. Brian Hill and Andrew Wise, who practice in the litigation area, and Sarah Nappi, who practices in the firm’s international department, were all formerly counsel at Miller & Chevalier.

The new members counsel clients on a wide range of matters, including appellate litigation, intellectual property, fraud and white collar crime, ERISA and fiduciary duty matters, government contracts, global compliance and risk management, complex internal investigations, customs and international trade.

“We are so pleased to welcome these highly talented lawyers to the firm’s membership,” said Samuel Maruca, Chair of Miller and Chevalier. “These three new members are indicative of the firm’s continued strategic growth and focus on areas that are critical to our clients’ business needs.”

Brian Hill, Litigation Department, practices in the areas of complex business litigation and trial and appellate work. Hill has significant experience with corporate governance, government contracts, False Claims Act, Section 337, ERISA and fiduciary duty matters. He has litigated cases involving employment contracts and teaming agreements, government contract claims, cost accounting standards, defective pricing, foreign military sales, technical data rights, patent infringement and other intellectual property issues before state and federal courts and agencies. Hill holds a J.D., magna cum laude, from the Georgetown University Law Center, and a B.A from Southwest Missouri State University.

Sarah Nappi, International Department, counsels clients on customs and international trade matters, with an emphasis on import regulation and customs compliance. She advises on a wide range of customs issues, including tariff classification, valuation, country of origin marking, duty preference programs and duty deferral opportunities, such as the use of foreign trade zones. Nappi has significant experience with issues arising under the North American Free Trade Agreement and has counseled companies on the customs implications of foreign sourcing and supply arrangements and foreign-to-foreign trade. She also works with clients to develop customs compliance programs, conducts internal compliance assessments and assists with regulatory audits and the Importer Self Assessment program. Nappi is a licensed customs broker and holds a J.D. from Georgetown University Law Center, and a B.A. from Cornell University.

Andrew Wise, Litigation Department,concentrates on complex litigation in federal and state courts, with a particular emphasis on white collar defense in both criminal and civil matters. Wise has represented individuals charged or targeted by the U.S. Department of Justice in cases involving allegations of government contracting fraud, criminal antitrust violations, perjury and false statements, Securities Act violations, accounting and bank fraud, RICO, export controls violations, conspiracy and other fraud-related offenses. He has also conducted and participated in complex internal investigations on behalf of corporations and partnerships focusing on various statutes including the U.S. Foreign Corrupt Practices Act and the Money Laundering Control Act. Wise holds a J.D., cum laude, from the University of Michigan Law School and a B.A. from Swarthmore College.

Michigan Supreme Court Reappoints Susan H. Zitterman to Committee
Susan H. Zitterman of Kitch Drutchas Wagner Valitutti & Sherbrook was reappointed by the Michigan Supreme Court to the Committee on Model Civil Jury Instructions for a three-year term.

The Committee is composed of attorneys and judges whose duty it is to ensure clear, concise, and objective civil jury instructions. Ms. Zitterman, who heads the firm’s appellate practice, has been a member of the committee since its inception in 2002.
