Dr. Donald Scaltrito Has Joined the Firm as Patent Agent
Rothwell Figg is pleased to announce that Dr. Scaltrito has joined the Firm as a patent agent. Dr. Scaltrito was a science advisor at an intellectual property law firm in Northern Virginia and an Examiner at the U.S. Patent and Trademark Office. His practice involves extensive patent prosecution in the areas of pharmaceuticals, organic chemistry, inorganic chemistry and materials science.

Rivkin Radler Welcomes A New Associate To It's Hackensack Office
William M. Savino, managing partner of Rivkin Radler LLP, is pleased to announce that Gabriel Adamo, of Paramus, New Jersey, has joined the firm as an associate in the Litigation & Appeals and Insurance & Coverage Practice Groups.

"Gabriel brings an array of experience, as well as enthusiasm to the firm, and we look forward to working with him," stated William Savino.

Mr. Adamo's practice includes the handling of complex insurance coverage claims, commercial litigation and appellate practice. He has represented some of the nation's largest insurers in defense litigations involving claims associated with construction litigation, products liability, premises liability, automobile personal injury, professional liability, insurance coverage, property damage claims, subrogation and other insurance-related matters. In addition, Mr. Adamo has litigated claims associated with toxic torts, primarily arising out of exposure to asbestos.

Rivkin Radler Welcomes A New Partner
William M. Savino, managing partner of Rivkin Radler LLP, is pleased to announce that Stephen E. Kesselman, of Old Westbury, has joined the firm as a partner in the Professional Liability and Litigation & Appeals Practice Groups.

"My partners and I are delighted to welcome Steve Kesselman to Rivkin Radler," stated William Savino. "We look forward to working with Steve and all of the wonderful attributes he brings to our firm."
Mr. Kesselman is an experienced litigator and has represented a broad range of clients, including Fortune 500 companies, in complex commercial litigation matters in the federal and state courts of New York. Mr. Kesselman has handled cases in a large variety of fields, including accountant and attorney liability, class actions, contract, employment, health care, real estate, and securities law matters. Mr. Kesselman also has substantial experience as a successful appellate lawyer and has argued and prevailed before the Second Circuit Court of Appeals on a civil RICO matter. In addition, Mr. Kesselman has served as a party arbitrator in several substantial corporate matters.

At Cornell Law School, Mr. Kesselman was elected to the Moot Court Board and argued before United States Supreme Court Justice Byron R. White in the final round of the Sutherland Cup Moot Court competition. As an undergraduate senior at Cornell, he was selected to be a member of the Mortar Board Honor Society based on his academic achievement and service to the university community.

Mr. Kesselman started his legal career as a litigation associate at a large Manhattan firm. He subsequently co-founded his own firm in Manhattan, where he continued his practice in commercial litigation before joining a Long Island-based firm in 2003. He is President of the Old Westbury Pines Civic Association and is a member of the Board of Trustees of the Old Westbury Hebrew Congregation. When he lived in Manhattan, he was elected to the New York County Democratic Committee. Mr. Kesselman serves as a member of the Nassau County Bar Association's Alternative Dispute Resolution, Commercial Litigation and Federal Courts Committees.

Three Leesburg Lawyers Named to "Legal Elite
Randolph A. Sutliff, Daniel P. Lyon and Lawrence J. McClafferty from the Leesburg office of McCandlish & Lillard have been recognized by Virginia Business Magazine as being among Virginia’s “Legal Elite.” They are among nine attorneys from the firm to be awarded this year’s distinction. All three were named to the list last year as well.

Virginia Business determines the “Legal Elite” designation from a survey conducted with the Virginia Bar Association, which polls thousands of Virginia lawyers to determine whom they consider the very best in certain defined practice categories. The seventh edition of the list is published in the magazine’s December edition.

Randolph A. Sutliff, a principal and President of McCandlish & Lillard, was named among the best in the category of Business Law. He began the general practice of law in Fairfax in 1973. Over time, he has concentrated on business law, with an emphasis on corporate and real estate matters. Currently, he divides his practice between the firm’s Fairfax and Leesburg offices. Mr. Sutliff has served as General Counsel for the National Capital Area Council Boy Scouts of America and currently is the President of the Dulles Area Transportation Alliance and General Counsel for the Claude Moore Foundation. Mr. Sutliff also was named as one of the Washington, D.C.’s Super Lawyers for 2006.

Daniel P. Lyon, a principal and member of the Firm’s Executive Committee, was named among the best in the category of Labor and Employment Law. Mr. Lyon has been recognized among Virginia Business’ Legal Elite in three of the past four years. He has significant experience litigating commercial issues on behalf of businesses and individuals at the trial and appellate level in both state and federal courts. Mr. Lyon divides his practice between the firm’s Fairfax and Leesburg offices. He recently completed his second term as Chairman of the Central Fairfax Chamber of Commerce and has been named as its Legal Counsel for 2007. Mr. Lyon also was named by Smart CEO Magazine as one of the Greater Washington Legal Elite for 2006 in Employment Labor Law/Commercial Litigation.

Lawrence J. McClafferty, a principal in the Firm’s Leesburg Office, was named among the best in the category of “Young Lawyer.” Mr. McClafferty, who is President-Elect of the Loudoun County Bar Association, concentrates his practice in the area of civil litigation, particularly with respect to business torts, commercial disputes and community associations. He also devotes a significant portion of his practice to guardianships, conservatorships and other elder law issues.

EG&S WINS DISMISSAL OF NATIONAL SECURITIES CLASS ACTION
In a national securities class action filed in Pittsburgh, EG&S successfully obtained the dismissal of a class action challenging a loan repayment program provided in 139 countries by a national wholesale chain. Through EG&S’ efforts, the court denied a temporary restraining order and preliminary injunction seeking to freeze assets pending resolution.

In this case, plaintiff brought a national class action in the Court of Common Pleas of Allegheny County. The corporate defendants and their officers retained EG&S, and EG&S removed the case to the United States District Court for the Western District of Pennsylvania. After successfully persuading the United States District Court to dissolve the improperly granted ex parte state court injunction, EG&S moved to dismiss the class action Complaint. In response, the plaintiff class representative moved for a temporary restraining order and preliminary injunctive relief, along with expedited discovery, seeking to freeze the assets of the defendants pending a final ruling. After an expedited hearing and oral arguments, the United States District Court denied the requested injunctive relief and dismissed the Complaint.

Mark A. Kearney, Timothy T. Myers, Stewart J. Greenleaf, Jr. and Colin D. Dougherty of the firm’s Blue Bell office represented the Defendants in obtaining this significant victory in a national class action that challenged business transactions in international commerce.

EG&S WINS SUMMARY JUDGMENT FOR CITY OF WILKES-BARRE, ITS MAYOR AND FIRE CHIEF
The United States District Court for the Middle District of Pennsylvania granted EG&S’ motions for summary judgment in favor of the City of Wilkes-Barre, its Mayor and Fire Chief in two cases brought against them by former Assistant Fire Chiefs when the plaintiffs claimed that they were constructively discharged from their appointed positions after the Mayor took office in January 2004 in violation of due process rights inherent under their union collective bargaining agreement. Both plaintiffs were appointed to their jobs by the previous mayor. In support of summary judgment, John G. Dean of EG&S’s Wilkes-Barre office and Deborah H. Simon of the firm’s Blue Bell office, successfully argued that no constitutionally protected rights were violated, and that the City provided plaintiffs with the opportunity to participate in the search process to fill their positions and properly rejected as anticipatory the grievances that they filed with their union over the impending selection process. The United States District Court agreed with EG&S, and dismissed the plaintiffs’ civil rights claims against the City, the Mayor and Fire Chief.

EG&S PRESENTS STATEWIDE CONTINUING LEGAL EDUCATION ON APPELLATE RIGHTS IN PENNSYLVANIA
EG&S’ Dean R. Phillips, Esq. and Stewart J. Greenleaf, Jr. will lead an important statewide Pennsylvania Bar Institute seminar titled "Appellate Wheel of (Mis)Fortune--Strategic Opportunities, Common Mistakes, Procedural Pitfalls and Waiver Traps" in January 2007. This seminar will be presented in Philadelphia, Mechanicsburg and Pittsburgh. The seminar is an expanded version of a program that Mr. Phillips has presented at various venues throughout the Commonwealth including the Chester County and Luzerne County Bench-Bar Conferences, Erie County Bar Association Annual Meeting and Chester County Inns of Court.

Mr. Phillips has also presented to the Centre County Bar Association and Bucks County Bar Association and the Pennsylvania Conference of State Trial Judges on various aspects of appellate procedure. Stewart J. Greenleaf, Jr. will also be a panelist for the “Appellate Wheel of (Mis)Fortune” Seminar. Mr. Greenleaf will be speaking on the collateral order doctrine. He is the co-author, along with Mr. Phillips, of course materials on the collateral order doctrine which were recently presented to the Pennsylvania Conference of State Trial Judges.
