Bracewell Partner Quoted in The Boston Globe
In a news story about illegal steroid use in Major League Baseball, The Boston Globe (Dec. 31, 2006) quoted Bracewell & Giuliani partner Marc Mukasey . The article reported that the Players Association was challenging an appeals court ruling in San Francisco that gives federal investigators the authority to use the names of 100 major leaguers who tested positive in their steroid probes. Among his comments, Mr. Mukasey said, "…prosecutors are not going after the users (the players) but 'on a federal level, they're more than likely going after the traffickers.' "

Mr. Mukasey was also quoted on a similar topic on WFAN-AM, New York.

Orrick Lawyer Interviewed About Vioxx Litigation
New York office leader Peter Bicks was interviewed about the Vioxx litigation on "Bloomberg Law" on Bloomberg Radio. Upcoming in 2007 are some multiple plaintiff lawsuits in New Jersey, a New Jersey Supreme Court case involving third-party payers and more than 23,000 individual cases throughout the country.

According to Bicks, who has extensive experience in mass-tort litigation, the strategy Merck has been taking to litigate rather than settle out of court has been successful. "The history of mass-torts shows that once a defendant opens up the coffers to start settling cases, that that is really an invitation for further litigation," said Bicks. "And the strategy that Merck has embarked on here is to try these cases one by one, and if you look at what’s happened at least over the last year and a half for Merck, I think it’s pretty clear that that is a good strategy and that that strategy is working so far.

the Northern District of Illinois Judge Richard Posner entered a verdict in favor of the firm’s client represented by J. Kent Mathewson and Jennifer M. Zlotow.
After a week of trial before Judge Richard Posner, sitting by designation in the Northern District of Illinois, a verdict was returned in favor of the firm’s commercial client represented by J. Kent Mathewson and Jennifer M. Zlotow. This interesting case involved allegations of breach of fiduciary duty, interference with a business relationship, seizure of a corporate opportunity, and breach of contract. The case had begun as a jury trial and immediately before closing arguments, because of some perceived juror misconduct, the jury was discharged and the case concluded as a bench trial before Judge Posner. The plaintiff had sought $20 million dollars in damages. In a twenty-four page written opinion, Judge Posner found that the plaintiff had failed to prove any of the allegations and entered judgment in favor of the defendant on all claims.
