Calfee Announces Promotions: Executive Committee, Partners, Senior Counsel
Michael Brittain and Guy F. Guinn have been elected to the firm's executive committee. W. Eric Baisden, Shelly K. Hillyer, Matthew M. Mendoza, Peter A. Rosato and Jennifer L. Vergilii have been elected to the partnership. Wade D. Clark and Donald E. Lampert have been promoted to senior counsel.

Executive Committee

Michael Brittain (Cleveland office -- Partner and Chair, Insurance Coverage) - Brittain litigates insurance coverage and business disputes and counsels business leaders on corporate indemnification, insurance aspects of mergers and acquisitions, and complex corporate, class action and product liability litigation.

Brittain is an active member of the Cleveland Bar Association and currently serves as its vice president. He has served previously on its board of trustees (2001-2004) and on various committees, including membership (chair and vice chair), business litigation (chair), judicial selection, and ethics and professionalism. He is also an active member of the American and Ohio Bar associations and is a trustee of the Cleveland Bar Foundation. Brittain has spoken about and published articles on numerous topics including insurance coverage, expert witnesses, evidentiary rules and privileges, legal ethics and unfair competition.

Brittain received his J.D. from Case Western Reserve University School of Law and his B.A. from Ohio University. He began practicing law with Calfee in 1979 and became a partner with the firm in 1987.

Guy Guinn (Cleveland office -- Partner and Co-Chair, Commercial Business and Finance) Guinn is experienced in all forms of commercial and real estate financings and syndications, securitizations, domestic and international commercial business arrangements, capital formation and restructurings.

An active member of the American and Ohio State Bar associations, Guinn has chaired the American Bar Association Business Law Section's Joint Subcommittee on Domestic and International Business Transactions and the Ohio State Bar Association's Opinion and Loan Documentation Subcommittee. Guinn consistently has been recognized as one of America's Leading Lawyers in Chambers USA. He also was recognized as a 2006 Ohio Super Lawyer and in The Best Lawyers in America from 1995-2006.

Guinn received his J.D. from University of Michigan Law School and his B.A. from Duke University. He joined Calfee in 1980 and became a partner in 1986.

Partners

W. Eric Baisden (Cleveland and Columbus office -- Labor and Employment) - Baisden counsels privately and publicly held employers in a wide variety of labor and employment matters. Clients value his counsel as well as his litigation experience before federal and state trial and appellate courts throughout the United States. Baisden has represented employers in wrongful discharge, discrimination, ERISA, executive compensation, non-competition and trade secret cases in court and administrative proceedings before the Department of Labor, OSHA, NLRB, EEOC and numerous state agencies.

Baisden is a member of the American, Ohio, Cleveland and Akron Bar associations. A graduate of Case Western Reserve University School of Law, he received his B.S. from Ashland University.

Shelly K. Hillyer (Cleveland office -- Insurance Coverage) - Hillyer represents corporate policyholders seeking insurance recovery from their general liability, professional liability, property and other insurance carriers. She litigates against insurers in bad faith and breach of contract actions in mass tort, catastrophic loss and other contexts, and represents policyholders in actions against negligent brokers. Hillyer also counsels clients in complex cost-sharing negotiations where long-tail mass tort claims trigger numerous carriers' general and excess liability policies.

Hillyer has co-authored several insurance-related articles and is a member of the American, Federal, Ohio, Pennsylvania and Cleveland Bar associations. A graduate of Temple University School of Law, she received her B.A. from The Ohio State University.

Matthew M. Mendoza (Cleveland office -- Litigation) - Mendoza is an experienced business and commercial litigator whose background ranges from insurance coverage, to municipal law, to products liability and toxic tort litigation. He counsels clients on insurance coverage issues and obtains coverage for corporate policyholders under various types of insurance policies. Mendoza also defends clients against negligence, strict liability, premises liability, products liability, toxic tort and other tort claims.

Mendoza is an active member of the Federal, American, Ohio and Cleveland Bar associations. A graduate of The Ohio State University College of Law, he received his B.A. from Kent State University.

Peter A. Rosato (Columbus office -- Litigation) - Rosato is an experienced litigator in complex business litigation, disputes involving public utilities, workplace injury and OSHA investigations. He has appeared in federal and state courts throughout the United States on behalf of clients involved in a variety of significant disputes, including breach of fiduciary duty claims and challenges brought under provisions of the U.S. Constitution. Rosato also has litigated successfully civil rights cases, Medicare reimbursement appeals and construction disputes.

Rosato is a member of the American, Ohio and Columbus Bar associations. A graduate of The Ohio State University College of Law, he received his B.S. from Western Connecticut State University.

Jennifer L. Vergilii(Cleveland office -- General Corporate) - In her practice of corporate and information technology law, Vergilii counsels public and privately-held companies in an array of business and securities issues, as well as issues in stock, merger and asset purchase agreements, limited liability company operating agreements, and confidentiality and non-competition agreements.

Vergilii has authored articles and spoken at several legal seminars on general business and e_commerce issues. A graduate of Case Western Reserve University School of Law, she received her B.A. from The College of the Holy Cross.

Senior Counsel

Wade D. Clark (Cleveland office -- Employee Benefits and Executive Compensation) - Clark advises clients on employee benefits and executive compensation issues. He works closely with a diverse range of companies in the development, implementation, administration and termination of qualified retirement plans, nonqualified plans, welfare plans and cafeteria plans. He provides counsel on matters of fiduciary requirements and liability, IRS qualifications, audits and remedial programs, U.S. Department of Labor audits, and qualified plan administration, including participant accounting, compliance testing, distributions, tax reporting and prohibited transactions. He also provides counsel on employee benefit and executive compensation programs in connection with corporate mergers and consolidations.

A member of the Cleveland, Florida and American Bar associations as well as the WEB Network, Clark received his J.D. from University of Akron School of Law and his B.A. from Youngstown State University.

Donald E. Lampert (Cleveland office -- Workers' Compensation and OSHA) - Lampert concentrates on workers' compensation and related employment litigation. He represents and counsels employers regarding workers' compensation injuries, occupational diseases and intentional torts. He also has extensive experience litigating on behalf of employers before the Industrial Commission in various Ohio regions and has appeared before the full Industrial Commission on numerous occasions.

An adjunct professor at Case Western Reserve University School of Law, Lampert serves as the academic advisor for the Ohio State Bar Association's Workers' Compensation Specialty Board. He has lectured at seminars sponsored by private and public organizations including the ABA, OSBA and the National Workers' Compensation Defense Network. Lampert has been listed in The Best Lawyers in America for 10 years, designated an Ohio Super Lawyer and has an AV rating from Martindale-Hubbell. He is a member of the American, Ohio and Cleveland Bar associations as well as the Cleveland Committee on Foreign Relations.

Lampert received his J.D. from Case Western Reserve University School of Law, his Ph.D. from Rutgers University, his M.A. from University of Pennsylvania, and his B.A. from University of Pittsburgh

Bullivant names new shareholder in Portland office
Bullivant Houser Bailey PC, a multi-service West Coast law firm, has announced that Andy Lauersdorf has been named shareholder of the firm.

Lauersdorf serves as the leader of the firm’s Insurance SIU practice team, which counsels insurance carriers and claims personnel in the investigation and litigation of insurance claims involving arson, material misrepresentation, fraud, fabricated or staged losses, and racketeering and organized fraudulent claims activity.

He is admitted to practice in Oregon and Washington and is a member of the Multnomah Bar Association and the Oregon Chapter of the International Association of Arson Investigators. Lauersdorf earned his law degree from the Northwestern School of Law, Lewis & Clark College and his B.A. from the University of Wisconsin.

Fitzpatrick Cella Elects Five New Partners
Leading intellectual property law firm Fitzpatrick, Cella, Harper & Scinto is pleased to announce that Filko Prugo, Joshua I. Rothman and Lock See Yu-Jahnes in New York; and Edmund J. Haughey III and Justin J. Oliver in Washington, DC, have been elected Partners at the firm. Also, Aimee Nassau Gardiner has been named Of Counsel in Fitzpatrick’s New York office. This is one of the largest new partner classes the firm has elevated.

Filko Prugo

Mr. Prugo has extensive experience in patent litigation across a broad range of technologies, particularly in the chemical, biological and pharmaceutical areas. Some of the technologies he has worked with include anti-fungal and osteoporosis medications, contraceptives, immunosuppressants and fusion proteins for the firm’s largest pharmaceutical clients.

Mr. Prugo received his B.Sc. (First Class) in 1996 from York University and his LL.B. in 1998 from Osgoode Hall Law School. Mr. Prugo, age 33, is a New York City resident.

Joshua I. Rothman

Joshua I. Rothman’s practice focuses on complex patent litigation in the pharmaceutical and biotechnology arenas. He has also worked on licensing and trade secret matters.

Mr. Rothman received his B.S. in 1993 from the University of Michigan, his M.S. in 1994 from Rensselaer Polytechnic Institute and his J.D. in 1998 from the Brooklyn Law School. He has served on the Brooklyn Law School Alumni Admission Board since 1999 and lectured on intellectual property at Baruch College. Mr. Rothman, age 35, lives in Chappaqua, NY.

Dr. Lock See Yu-Jahnes

Dr. Yu-Jahnes focuses her practice on patent prosecution in the electrical and mechanical arts. Some of the technologies she has worked on relate to signal manipulation for telecommunications, image processing, computer hardware and software, sporting equipment, bulk materials processing, facsimile systems, copier systems, DVD and other data storage devices, network communications systems, cameras, IC chips and manufacturing processes and business methods.

Prior to embarking on her legal career, Dr. Yu-Jahnes was involved in the research and development of processes for fabricating thin-film electronic devices. Dr. Yu-Jahnes was co-recipient of the IBM Research Division Award in 1995.

Dr. Yu-Jahnes received her B.S. in 1984, her M.S. in 1985 and her Ph.D. in 1993 from the Massachusetts Institute of Technology. She received her J.D. in 1998 from Fordham University School of Law. Dr. Yu-Jahnes, age 44, lives in Upper Saddle River, NJ.

Edmund J. Haughey III

Mr. Haughey’s practice covers the full breadth of intellectual property law, with a particular focus on patent and trademark litigation and counseling. Mr. Haughey concentrates his patent practice on the electro-mechanical industries, with experience in a broad range of technologies. He counsels clients on patent strategies, drafts opinions and licensing agreements, and is experienced in all aspects of infringement litigation and patent prosecution. In the trademark arena, Mr. Haughey regularly works with major brand owners to clear and register trademarks, handle licensing matters, and litigate before the district courts and the Trademark Trial and Appeal Board.

Mr. Haughey received his B.S.E. in 1995 from the University of Pennsylvania and his J.D. in 1998 from the William & Mary School of Law. Mr. Haughey, age 34, lives in Washington, DC.

Justin J. Oliver

Mr. Oliver’s practice includes patent prosecution, licensing and litigation in a wide variety of scientific arts. Some of the technologies he has worked with include medical devices, business methods, pharmaceuticals, semiconductor technologies, optics, image processing devices, software applications, image reproduction devices, light emitting diodes, navigation systems and various household goods.

Mr. Oliver received his B.S in 1994 from Trinity College in Hartford, Connecticut and his J.D. in 1997 from American University’s Washington College of Law where he served as the Executive Editor of the Journal of International Law and Policy, as well as on the Executive Moot Court Board. Mr. Oliver, age 34, lives in Washington, DC.

Aimee Nassau Gardiner

Ms. Gardiner has experience in trademark litigation, enforcement, licensing and prosecution. Ms. Gardiner’s practice includes the clearance of trademarks, prosecuting applications, portfolio management, defending and prosecuting opposition proceedings and litigation in the federal district courts. She has represented clients in a variety of industries, including the food, pharmaceutical, publishing, building products and telecommunication industries.

Ms. Gardiner received her B.A. in 1993 from Dartmouth College and her J.D. in 1996 from Fordham Law School. Ms. Gardiner, age 35, lives in Glen Ridge, NJ.

CBLH Attorney Co-Authors Chapter in Book
Wayne C. Jaeschke, a member of the Firm’s Intellectual Property Group, has co-authored a chapter on intellectual property management in a book entitled, Innovate or Perish, written by Edward Kahn. Released in November 2006, the book is a thought provoking work about next generation integration of intellectual property law, technology and business strategy.
Mr. Jaeschke has co-authored his chapter with long-time colleague, Professor Karl Jorda. Professor Jorda is the David Rines Professor of Intellectual Property Law at the Franklin Pierce Law Center. Mr. Jaeschke is the former Chief Patent Counsel of Henkel Corporation while Professor Jorda was Chief Patent Counsel for Ciba-Geigy (now Norvartis).

Appellate Court affirms defense verdict in favor of Unger acute care center client in multimillion-dollar medical malpractice suit
In a victory for Johnson & Bell
Attorney Margaret A. Unger's, left, acute care center client, the Second District Appellate Court of Illinois recently affirmed a defense jury verdict that the acute care center did not commit medical negligence in its treatment of a patient.

The plaintiff, on behalf of her son, sued the defendant acute care center and one of the physicians working at the center alleging negligence in failing to: take a proper medical history, conduct a proper medical examination, order appropriate tests, and refer or admit plaintiff's son to a hospital. Plaintiff alleged that as a result of these acts and omissions, her son's Addison's Disease went undiagnosed, whereupon he suffered cardiac arrest leading to brain damage, leaving him profoundly and permanently disabled.

The case proceeded to a jury trial where plaintiff sought over $20,000,000 in damages. After a two-week trial, the jury rendered a verdict in favor of the defendants. On appeal, plaintiff contended that she was entitled to judgment notwithstanding the verdict because the evidence overwhelmingly favored her case. In the alternative, plaintiff sought a new trial on the grounds that the jury verdict was against the manifest weight of the evidence or the product of cumulative trial errors. In a 35-page order the Second District Appellate Court rejected plaintiff's numerous contentions and affirmed the verdict.

Unger was assisted in the trial of the case by Johnson & Bell Attorney Lauren A. Wieland, above center. Both are members of Johnson & Bell's Hospital Law & Medical Liability Group. Johnson & Bell Attorney David M. Macksey, above right, who chairs Johnson & Bell's Appellate Practice Group, handled the appeal.
