New Associates Join Firm
Annie Amaral and Danielle Stephens join Sacramento's largest law firm as associate attorneys.

Amaral joins the firm's litigation practice group. She received her J.D. from the University of the Pacific, McGeorge School of Law in 2005 and her B.A. from California State University, Sacramento in 2001. Prior to joining Downey Brand, Amaral was a law clerk to District Judge Garland E. Burrell, Jr. of the United States District Court, Eastern District of California.

Stephens joins the firm's real estate practice group. She received her J.D. from Santa Clara University School of Law in 2004 and her B.A. from Santa Clara University in 2002. Prior to joining Downey Brand, Stephens was an associate with Boutin Dentino Gibson Di Giusto Hodell Inc.

Shawn C. Gooden Earns Victory in Workers' Compensation Case
Shawn C. Gooden, an associate in the Firm's Philadelphia office, recently prevailed in a case heard in Reading, Pennsylvania. The claimant's benefits were reduced to partial, though he still received benefits equal to his compensation rate. In so doing, the indemnity benefits were capped at an additional 500 weeks. With 32 weeks left to go on his 500-week clock, the claimant was incarcerated and his benefits were suspended. Upon release from prison, he filed a petition to reinstate his benefits seeking the additional 32 weeks of partial disability and alleging that his incarceration tolled the running of the 500-week clock.

The Judge agreed with the employer's interpretation of the case law and held that the claimant’s petition was barred by the statute of repose in section 413 of the Act. She held that the 500-week clock continued to run even though the claimant was incarcerated; because claimant’s petition was filed after the 500 weeks had run, it was not timely.

The case presented an interesting and unsettled question of law. Although the risk of loss in this particular case was only 32 weeks of partial disability benefits, the arguments and rationale could have a much broader impact in similar cases in which the claimant seeks to toll the running of the statute of limitations while on suspension status.

LAURA SUTTELL, REFERENCE LIBRARIAN AT PHILLIPS LYTLE LLP ELECTED TO ASSOCIATION OF LAW LIBRARIES OF UPSTATE NEW YORK BOARD
Laura Suttell, reference librarian with Phillips Lytle LLP, a full service law firm with statewide coverage, was elected to the Board of Directors of the Association of Law Libraries of Upstate New York (ALLUNY). She will serve a two-year term. Founded in 1954, ALLUNY is a chapter of the Association of Law Libraries, a national organization that promotes professional development among law libraries and provides educational opportunities to its members.

Ms. Suttell also serves as the ALLUNY grants committee chair and is currently on the vendor committee for the 2007 Northeast Regional Law Libraries meeting. In addition, she is the Buffalo coordinator for the Special Libraries Association Upstate New York Chapter. In May, Ms. Suttell will have been with the firm for six years. As reference librarian, she provides research assistance to all of Phillips Lytle’s seven offices.

Patton Boggs LLP Elects Nine To Partnership for 2007
Patton Boggs LLP is pleased to announce that nine attorneys were elected to the partnership for 2007 at the firm’s annual partnership elections. The new partners are: J. Yost Conner, Matthew Cutts, Andrew Friedman, Marek Gootman, Kevin O'Neill, and M. Todd Tuten in the Washington, D.C. office, and Darren Collins, Akash Sethi, and David Teeples in the Dallas office.

Washington, D.C. Office:

J. Yost Conner’s practice focuses on real estate development, construction, privatization, and project finance matters. He attended the University of Virginia - School of Law, where he was a Dillard Fellow graduating with a J.D.in 1997 and attended Virginia Polytechnic Institute and State University, graduating magna cum laude in 1986 with a B. Arch.

Matthew Cutts advises clients on complex civil litigation and criminal cases involving corporate and business activities. He was recently named by Washington, D.C. Mayor-elect Adrian Fenty to be Chair of the Washington, D.C. Sports and Entertainment Commission. Mr. Cutts attended the University of Virginia, earning his law degree in 1997 and a B.A. in 1994.

Andrew Friedman represents clients involved in government investigations, civil enforcement matters, Congressional inquiries, complex civil litigation, and criminal proceedings. He attended the University of Minnesota Law School, J.D., graduating cum laude in 1993, and Brown University, earning an A.B. in 1988.

Marek Gootman represents local governments, public agencies, and non-profit organizations in dealings with federal executive agencies and Congressional offices on a variety of topical issues affecting their funding and program operations. Mr. Gootman attended Georgetown University Law Center, earning a J.D., Order of the Coif, magna cum laude in 2000, the Fels Center of Government, University of Pennsylvania, M.G.A. graduating cum laude in 1993, and the Wharton School of the University of Pennsylvania, earning a B.S., cum laude in 1992.

Kevin O'Neill advises clients on the federal appropriations, legislative, and agency process. His clients include corporations, municipal governments, transportation agencies, health care systems, museums, and universities. Mr. O’Neill is a graduate of the College of William and Mary Marshall-Wythe School of Law, earning a J.D. in 1999, and attended Syracuse University, graduating with a B.A. in 1992.

M. Todd Tuten advises clients on a range of federal administrative and legislative matters, with a particular focus on health care policy. He works closely with federal and state officials to further client interests on Capitol Hill and within regulatory agencies. Mr. Tuten is a graduate of Vanderbilt University Law School, earning a J.D.in 1990. He attended the University of Texas, graduating with a B.A., magna cum laude in 1986.

Dallas Office:

Darren Collins counsels clients on the protection, leveraging, and transaction of intellectual property and technology. He also advises emerging technology and other companies on protection and commercialization of property at all phases of development. He attended New York University, obtaining a J.D. in 1997, and earned a B.S.E.E., cum laude, at Texas A&M University in 1994.

Akash Sethi advises companies in a broad range of industries in all stages of development, including software, semiconductors, telecommunications, and financial services, as well as venture capital firms, private equity and mezzanine finance funds, investment banks and other institutional investors. He is a graduate of the University of Houston Law Center with a J.D., cum laude, in 1997, and the University of Texas at Austin, earning a B.B.A., in 1994.

David Teeples provides counsel to clients on business matters involving securities offerings, mergers and acquisitions, and federal and state banking issues. He also works on issues involving initial and secondary public offerings and private placements of debt and equity securities, with an emphasis on financial institutions. He earned a J.D. from the University of North Carolina, with honors, in 1997, and a M.A. from the University of Oklahoma in 1994, as well as a B.A., with distinction, in 1991.
