Gov.-Elect Ritter Taps Harris Sherman to Head Colorado's Department of Natural Resources
Gov.-Elect Bill Ritter announced today the appointment of Arnold & Porter LLP partner Harris Sherman as the Executive Director of the Department of Natural Resources for the state of Colorado, a position he previously held from 1974 to 1980. In this position, Mr. Sherman will oversee the state's water, energy, land, wildlife, parks, and wilderness resources. At Arnold & Porter, Mr. Sherman has been actively involved in the firm's environmental practice, focusing on natural resources, energy and water law.

''We are honored that Governor-Elect Ritter has appointed Harris for this important position,'' said Brian Leitch, head of Arnold & Porter's Denver office. ''Harris has provided valuable advice and leadership to our firm and its clients throughout the 27 years that he
has been with us. He has contributed greatly to our natural resource, energy and environmental practice areas. We wish him the best in his new position.''

Mr. Sherman is a senior partner at Arnold & Porter. He was one of the initial partners who participated in opening Arnold & Porter's Denver office in 1980 and has been with the firm since that time. Mr. Sherman currently serves as a Commissioner on the Denver
Water Board, Trustee of the Boettcher Foundation, Chair of the Colorado Chapter of Trust for Public Land, and member of the Colorado Forum. Mr. Sherman had earlier served as Chairman of the Colorado Water Quality Control Commission, Chairman of the Denver Regional Air Quality Council, Chairman of the Colorado Mined Land Reclamation Board, Colorado Commissioner of Mines, Colorado's Representative to the Western States Water Council and National Governors Association, and Trustee of Colorado College. He has an LL.B. from Columbia Law School and a B.A. from Colorado College.

Novack and Macey LLP Obtains Dismissal With Prejudice Of All Claims
P. Andrew Fleming and Christopher Moore obtained a dismissal with prejudice of all claims against J. Alexander Stevens in a lawsuit filed in the Circuit Court of Cook County, Illinois.

The suit, brought by Plaintiffs Roy D. Piazza and Jo Ann Piazza alleged breach of fiduciary duty claims against Mr. Stevens arising from a purported joint venture agreement between themselves and Mr. Stevens. Alternatively, they also alleged that a fiduciary relationship existed between themselves and Mr. Stevens independent of the alleged venture.

Mr. Stevens moved to dismiss all claims against him on the grounds that no joint venture agreement existed, the Piazzas had failed to allege sufficient facts to establish the alleged joint venture, and that the Piazzas had also failed to sufficiently allege a fiduciary relationship between themselves and Mr. Stevens independent of the purported venture.

On November 13, 2006, Judge Sophia Hall, of the Circuit Court of Cook County, dismissed all claims with prejudice. Judge Hall agreed with Defendant’s counsel that Mr. Stevens owed no fiduciary duties to the Piazzas because no joint venture had been alleged, and no facts had been alleged to establish a fiduciary relationship between the Piazzas and Mr. Stevens independent of any purported venture.

WRF Partner Kirk J. Nahra Quoted on Medicare Part D Compliance
Kirk J. Nahra, co-chair of Wiley Rein & Fielding's Health Care Practice, was quoted in the BNA Health Care Fraud Report on the Centers for Medicare & Medicaid Services' struggle to ensure compliance among contractors under the new Medicare Part D program. New requirements aimed at fraud, waste and abuse took effect January 1.

Creating a plan for ensuring compliance from partners will be a top priority, Nahra said. "There are very real commercial difficulties [for plans] with getting downstream partners to agree to many of these requirements, and practical issues with requiring downstream partners to implement obligations to many different Part D plans.

Attorney Tim Attalla Joins Miller Canfield
The law firm of Miller Canfield announces that Tim A. Attalla has joined the firm as senior counsel in the Detroit office. He will focus his practice on commercial and international matters.

Prior to joining Miller Canfield, Attalla was in private practice in Dearborn, Mich. for 18 years.

He is a member of the State Bar of Michigan. He is active in and sits on the board of numerous organizations. He is a national board member of Seeds of Peace of New York, a member of Wayne County Mental Health Board, and a member of Ishmael and Isaac of Chicago. He is a past board member of American Arab & Jewish Friends. He was the first Arab-American to be appointed to the Michigan Civil Rights Commission. He was appointed by Governor John Engler and served two, four-year terms from 1991-1998.

Attalla resides in Northville, Michigan. He received his J.D. from Thomas M. Cooley Law School and his B.A. is from Wayne State University in Political Science. He is fluent in Arabic.

Silicon Valley Office Adds Alcohol Beverage Practice with New Partner
The Silicon Valley office of McDermott Will & Emery is pleased to announce the addition of J. Daniel "Dan" Davis as a partner in the Firm's Alcohol Beverages & Products Group. Mr. Davis possesses more than two decades of legal experience in the fields of alcohol beverage regulation and distribution.

"Dan adds a significant new geographic dimension to our alcohol practice," commented Marc Sorini, head of the Firm's Alcohol Beverages & Products Group. "His knowledge of California's alcohol laws and regulations is second-to-none, and his judgment and experience have earned him the respect of both industry members and regulators alike."

Mr. Davis has both legal and business experience in the alcohol beverage industry advising suppliers on various issues. He has worked in both in-house and outside counsel capacities. His experience includes tied-house laws and regulations, licensing matters, distribution agreements and disputes, and advertising and promotional issues. Mr. Davis has represented clients in numerous hearings before the California Department of Alcoholic Beverage Control, and in appeals arising from such proceedings.

Mr. Davis has served as outside counsel to various alcohol beverage companies for the past 15 years. Prior to private practice, he held the position of assistant general counsel of Schieffelin & Somerset, then a joint venture between Guinness and Möet Hennessy Louis Vuitton. Mr. Davis earned his J.D. from the University of Virginia School of Law, and his B.A. from The College of William and Mary. He is admitted to practice in California and Connecticut.
