Sedgwick Launches E-Discovery Management & Compliance Practice Group and E-Discovery Portal
In response to the significant amendments to the Federal Rules of Civil Procedure that went into effect on December 1, 2006, Sedgwick announces the creation of its E-Discovery, Data Management & Compliance Practice Group and e-Discovery Portal. The e-Discovery Portal, a repository of essential forms, cases, statutes, regulations, rules and articles, provides Sedgwick attorneys and the firm's clients with direct access to practical and relevant information needed at the onset of litigation. The practice group, led by San Francisco Partner Keith Casto and New York Partner Kenneth Rashbaum, further positions the firm as a leader of legal services related to e-discovery and data management.

Sedgwick attorneys in the practice group will serve the firm's domestic and international clients who are impacted by the mandates for management of electronic data. The group will advise on electronic data management issues, on e-discovery retention and production obligations, and will assist with legal issues related to electronically stored information.

Businesses today increasingly rely on email and other forms of electronic data for records retention and communication. As a result, courts are regularly involved in resolving discovery disputes regarding email and other electronic data. E-discovery requirements place significant obligations on both in-house and outside counsel to take steps to avoid destruction of electronic data, and courts may impose significant sanctions for failure to adequately preserve electronic evidence.

The practice group draws on the rich experience of Sedgwick attorneys who already advise clients facing these and other complex issues concerning data preservation and production. The firm’s attorneys consult with clients at the outset of litigation matters on hold orders, preservation plans, and communications. In U.S. litigation matters involving discovery of data outside the U.S., Sedgwick attorneys advise on compliance with the personal data protection laws of the country where the data resides and on the rules and procedures for executing discovery requests in other countries.

The practice group will also be able to draw upon Ken Rashbaum's involvement with the Sedona Conference’s Working Group 6, which focuses on international electronic information management, discovery and disclosure. Sedgwick's involvement positions the firm at the forefront of developing specific best practices and policies that address the unique challenges of processing, reviewing and producing electronic data in a litigation response in multiple jurisdictions.

The legal experts comprising the E-discovery, Data Management & Compliance Practice Group include Kenneth Rashbaum (Co-Chair), Keith Casto (Co-Chair), Todd Betanzos, David Cassidy, Amy Chung, Scott Greenspan, Jolyon Grey (U.K.), Earl Hagström, James Holmes, Edward (Ned) Kirk, Peter Messrobian, Christopher Nedeau, John Stephens, David Subramanian.
