Mintz Levin Expands White Collar Crime and Corporate Investigations Practice in New York
Mintz, Levin, Cohn, Ferris, Glovsky and Popeo, P.C., a full-service, 450-lawyer AmLaw 100 firm with offices throughout the U.S. and in the U.K., announced that Bridget Rohde, the former Chief of the Criminal Division in the U.S. Attorney's Office, Eastern District of New York, has joined the firm as a Member in the White Collar Criminal and Corporate Investigative Practice in New York.

During her tenure with the U.S. Attorney's Office, Ms. Rohde directed complex federal investigations involving business and securities fraud, organized crime and racketeering, terrorism and violent criminal enterprises, narcotics, public integrity, obstruction of justice, tax offenses and money laundering. In addition, she worked to develop and implement strategies regarding national and district-wide law enforcement policies, including business and government integrity, corporation fraud and gang prosecutions.

"While at the U.S. Attorney's office, Bridget set the highest standard as a leader and a prosecutor," said Robert Bodian, head of the firm's New York office. "Together with Peter Chavkin, also a former federal prosecutor, Bridget is a major addition to the strength of the first-rate white collar practice in the New York office and expands the depth of the firm's national practice as well. We are delighted to welcome her to the firm."

Among Ms. Rohde's cases was the prosecution and conviction of a powerful La Cosa Nostra captain for racketeering involving illegal domination of the scrap metal industry. Her background also includes extensive work with several federal law enforcement agencies including the Federal Bureau of Investigation, Internal Revenue Service and U.S. Department of Labor as well as several local agencies. Graduating magna cum laude from the College of Notre Dame in Baltimore, MD, Ms. Rohde earned her law degree with honors from the University of Maryland School of Law. She is admitted to practice in New York, Washington D.C. and Maryland.

Ms. Rohde marks the third former federal prosecutor to join the firm within the last year. Peter Chavkin, a former Assistant United States Attorney in the United States Attorney's Office for the Eastern District of New York and the head of Mintz Levin's white collar defense practice in New York, previously served as a special assistant to the head of the United States Department of Justice's Civil Division in Washington. Jonathan Rosen, a former senior trial attorney in the fraud and public corruption section of the U.S. Attorney's office for the District of Columbia, joined as a Member in the firm's Washington, D.C. office.

HASKELL SLAUGHTER'S COHEN NAMED TO BOARD POSITION WITH THE BIRMINGHAM ESTATE PLANNING COUNCIL
Haskell Slaughter Young & Rediker, LLC attorney Ross N. Cohen has been named to the Board of Directors of the Birmingham Estate Planning Council, Inc. (BEPC). The BEPC is a multi-disciplinary organization composed of attorneys, accountants, financial planners, insurance professionals and trust officers who provide estate planning, trust and related services.

Mr. Cohen has practiced estate planning and trust law - and has been a member of the BEPC - for more than 20 years. He will serve an initial two-year term on the Board of Directors.
The BEPC has a membership roster of more than 150 Birmingham professionals. It conducts monthly technical meetings featuring local and out-of-town experts in taxation, trust law, economics, insurance, and similar areas. The BEPC is a chapter of the National Association of Estate Planning Councils, Inc.

Changes Affecting Colorado Construction Defect Law
the Colorado Supreme Court overturned the Colorado Court of Appeals on the issue of whether a CGL policy must cover the claims of successors-in-interest for property damage occurring during the policy period but before the property is owned by the claimant. Hoang v. Monterra Homes et al., ---P.3d--- 2007 LEXIS 31 (Colo. Jan. 8, 2007). The Supreme Court also affirmed another Court of Appeals’ decision earlier this year on the same issue. Travelers Cas. & Sur. Co. v. Village Homes of Colo., 2007 Colo. LEXIS 35 (Colo. Jan. 8, 2007). These rulings support a third Court of Appeals decision handed down earlier this year concerning trigger of coverage for property damage caused by construction defects under a CGL policy. Bainbridge, Inc., et al. v. Travelers Casualty Company of Connecticut,--- P.3d ----, 2006 WL 3094099 (Colo. App. 2006).

In Hoang, the Supreme Court held that the proceeds of the CGL insurance policy were available through garnishment to satisfy the judgment of a subsequent purchaser of the damaged home against the homebuilder because: (1) the builder insured itself against liability for damage occurring during the policy period; (2) the damage to the home occurred during the policy period; (3) no exclusion to the policy rendered the insured's policy coverage inapplicable because of a change in the home's ownership, and; (4) the builder of the home was liable for the damage to the home. Because there were no express exclusions or limitations in the policy to limit coverage to claims of third parties owning the property during the policy period, the Court found no basis to deny coverage under the circumstances. Village Homes underscored the breadth of Hoang extending it beyond the scope of a garnishment proceeding.

In Hoang, the Supreme Court did not discuss the concept of equitable subrogation raised in the Bainbridge case. Bainbridge suggested that if the construction defect were known by the successor in interest at the time of sale, and a discount in the price of the home had been negotiated for the defect, equitable subrogation may not exist and, therefore, coverage would not be triggered. Bainbridge has been granted certiorari. Thus, the Supreme Court may resolve the equitable subrogation issue at a later time. However, for now, insurers should be prepared to cover claims of third party successors-in-interest regardless of prior knowledge of a defect, or any express assertion of a right to equitable subrogation.

BINGHAM MCCUTCHEN EXPANDS FINANCIAL RESTRUCTURING PRACTICE IN NEW
Bingham McCutchen LLP announces that Steven Wilamowsky, a partner from Willkie Farr & Gallagher LLP, has joined Bingham’s Financial Restructuring Group as a partner in the firm’s New York office.
Wilamowsky is actively involved in numerous complex restructuring matters and is best known for his involvement in large Chapter 11 cases on behalf of creditors, asset purchasers and debtors.
In addition to having represented numerous corporate Chapter 11 debtors in a variety of industries, including retail, energy, telecommunications, construction, manufacturing, and financial services, Wilamowsky represented the stalking horse bidder and ultimate purchaser of the assets of Conseco Finance Corp. for more than $1 billion. He also represented bidders and equity investors in the Polaroid, Covanta Energy, RCN Corporation, and FAO Schwarz Chapter 11 cases, among many others, and represented the official creditors’ committee in the Planet Hollywood Chapter 11 cases.
“Steve is a highly respected young partner poised to become one of the future leaders in his area,” said Robert Dombroff, managing partner of Bingham’s New York office.
“Steve has substantial experience in all phases of large-case restructurings as well as recognized skill in distressed acquisitions,” said New York partner Tina Brozman, co-leader of Bingham’s Financial Restructuring Group and former chief judge of the U.S. Bankruptcy Court in the Southern District in New York, where Wilamowsky clerked for her from 1994 to 1996.
Wilamowsky’s arrival underscores Bingham’s continuing commitment to expanding its market-leading financial restructuring practice. Last month, Bingham announced a joint venture with leading Tokyo financial restructuring firm Sakai & Mimura, adding 22 lawyers. In November, Bingham announced that it would open a Hong Kong office in January, initially concentrating on counseling hedge fund and investment banking clients in their distressed and special situations investments.
For Wilamowsky, Bingham’s global platform and leading work as counsel on the creditor and acquirer side for hedge funds and distressed-debt investors were key draws. “Bingham’s reputation as the pre-eminent firm in cross-border restructurings was attractive to me,” said Wilamowsky, adding that he is looking forward to practicing alongside Brozman, whom he called “one of top legal minds in the restructuring field.
