ARTICLE AUTHORED BY SMITH HAUGHEY ATTORNEYS PUBLISHED IN FDCC QUARTERLY
FDCC Quarterly recently published an article authored by Craig S. Neckers and Matthew L. Wikander, both attorneys in the Grand Rapids office of Smith Haughey Rice & Roegge, entitled “Daubert and the Soft Sciences: Can a Forensic Economist Ever Make it Past the Gatekeeper?”

The Daubert article, which appears in this peer-reviewed journal published by the Federation of Defense and Corporate Counsel, details the factors now used by trial courts when deciding whether to admit expert testimony and also explores how courts from across the country are applying those gatekeeper factors to proposed economic experts, who are often considered experts of "soft" sciences. In addition, the article includes numerous case summaries from the most recent court decisions across the country analyzing same.

Craig is a shareholder at Smith Haughey and focuses his practice on representing clients in business and corporate litigation, including product liability, professional liability, and all manners of claims and issues involving businesses and individuals. He has been a lecturer for the Institute of Continuing Legal Education and has been a member of the faculty for ICLE’s Trial Skills Advocacy Workshop. He was elected into the membership of the Federation of Defense and Corporate Counsel. He has chaired the FDCC’s 2005 Law Management Conference and is the current chairperson of the FDCC’s Commercial Litigation section. He is also a fellow of the Michigan Bar Foundation.

Matt is an associate at Smith Haughey and focuses his practice on civil litigation, primarily in the areas of governmental, employment, commercial, and personal injury matters. He is a member of the State Bar of Michigan, Federal Bar Association, American Bar Association, Grand Rapids Bar Association, American Inns of Court, and the Grand Rapids Young Lawyers and Young Professionals Associations.

PHILLIPS LYTLE LLP PARTNER-IN-CHARGE RICHARD M. BEERS, JR. ELECTED TO ROCHESTER DOWNTOWN DEVELOPMENT BOARD
Richard M. Beers, Jr., Partner-In-Charge with Phillips Lytle LLP, a full service law firm with statewide coverage, was recently elected to the Rochester Downtown Development Corporation Board of Directors.

Corporations, institutions and real estate companies fund the Rochester Downtown Development Corporation, a private, not-for-profit, economic development entity. The organization’s primary role is to deliver a vibrant and economically strong downtown as part of the region’s larger asset package.

At Phillips Lytle, Mr. Beers focuses his practice in the areas of real estate transactions and financing, secured lending, distressed loan resolutions and real estate tax matters. Mackenzie Hughes Opens Florida Office
New Location Allows Firm to Offer Legal Counsel to Clients in Florida

SYRACUSE, N.Y. – In order to better provide legal services for its clients in Florida, Mackenzie Hughes LLP recently opened a new office in Boca Raton, Fla.

“Our clients are familiar with the high caliber trust and estate attorneys of our firm and want a seamless continuity of service when they move to Florida,” said Art Wentlandt, partner and chairman of the Mackenzie Hughes Executive Committee. “With the addition of the new office, we can provide better service to our clients who have residences both here in Central New York and Florida.”

Many Mackenzie Hughes clients who move to Florida or purchase homes in Florida need legal assistance with taxes, especially when it involves real estate and the determination of their “domicile.”

“Many of our clients were born and raised in New York; however New York’s estate and property tax policies do not encourage them to stay in the area and make Central New York their official domicile,” said Gay Pomeroy, partner and chairman of the Trusts and Estates Department at Mackenzie Hughes. “When New Yorkers permanently change their residence to Florida, they must prove they are truly Florida residents. They must be able to answer questions that include: Where are you registered to vote? Where is most of your furniture? How long do you live in New York each year?”

Pomeroy, a licensed Florida legal practitioner for 25 years, will be the primary contact for the firm’s Florida clients. In that role, he will provide advice to clients regarding Florida domicile change and will represent them in domicile audits.

Additionally as an estates and trusts attorney, Pomeroy drafts wills, a variety of trusts, living wills and powers of attorney. He has a broad range of experience in estate tax planning as it relates to the use of trusts, such as testamentary trusts, personal residence trusts, life insurance trusts and charitable remainder trusts.

Mackenzie Hughes plans to expand its Florida office in the next year by adding two to three more Florida practicing attorneys.

Nina Cortell Elected to Appellate Honor Group
Haynes and Boone, LLP partner widely recognized for her expertise handling complex appeals -- has been elected to the American Academy of Appellate Lawyers.

The academy was founded in 1990 to recognize outstanding appellate lawyers and to promote improvement of appellate advocacy and appellate court administration. Academy members must establish a distinguished reputation over 15 years in a practice substantially focused on appeals.

Cooper Levenson Honored With Bailey Award
Cooper Levenson, an Atlantic City-based law firm, was honored with the Bailey Award on Dec. 24, 2006. The annual award honors a single southern New Jersey business for contributions made to the community. The award, created by the Press of Atlantic City 11 years ago, is named after George Bailey of the holiday classic film “It’s a Wonderful Life” because the character used his position to make his community a better place to live.
