Holland & Hart Announces New Administrative Partner
Holland & Hart is pleased to announce Elizabeth Sharrer as the Denver Administrative Partner.

Ms. Sharrer will be the first to take this newly created position. Until now, each office besides Denver has had an Administrative Partner who took a direct leadership role in the day to day business of the office. As the firm has grown and expanded, opening two new offices in 2006, it has become clear that the role needed to be created in Denver.

"Liz combines a keen intellect and warm personal manner with a profound understanding of Holland & Hart, its people, and its values," said firm Chairman, Paul Phillips. "She will do an excellent job both defining and serving as the new Denver Administrative Partner."

Ms. Sharrer is a partner in Holland & Hart's real estate practice group. Her practice concentrates on commercial real estate development and financing, land use and annexation issues, all aspects of acquisitions and sales, office park development, leasing, title related issues, loan documentation and opinion letters. She is also experienced in the areas of oil, gas and minerals development and financing.

Gentry Locke welcomes new Commercial Attorney
Gentry Locke Rakes & Moore, LLP has added Lewis A. Conner to its growing General Commercial practice group, where he will focus on tax and finance issues.

Prior to joining the Firm, Mr. Conner served as the Vice-President Finance and Acting General Counsel for Professional Healthcare Resources, Inc., a provider of home healthcare services in Northern Virginia. Prior to joining Professional Healthcare in its accounting and finance department 1999, Mr. Conner worked for three years as a CPA with KPMG, LLP.

Mr. Conner earned his Juris Doctor cum laude from the George Mason University School of Law in 2003. During law school, while also employed by Professional Healthcare, Mr. Conner served as the Associate Editor of the Federal Circuit Bar Journal. Mr. Connor received his undergraduate degree in Accounting and Finance from Virginia Polytechnic Institute and State University, and was certified as a CPA in 1996.

Freshfields tops European M&A league tables
Leading international law firm Freshfields Bruckhaus Deringer has been ranked no 1 M&A adviser for the second year running, in Mergermarket's preliminary pan-European year end league table of legal advisers by value, advising on 260 deals worth €378.3bn. Freshfields also ranked no 1 for UK M&A deals, advising on 102 deals worth a combined €153.2bn.

Freshfields was also ranked no 1 European legal advisor in Bloomberg's final 2006 M&A league tables, advising on 251 deals worth $352.2bn and maintained its no 3 position in the global rankings, advising on deals totaling $369.1bn behind US firms Skadden, Arps, Slate, Meagher & Flom and Sullivan & Cromwell. The firm also topped the M&A league tables in Hong Kong and China, both in terms of value and number of deals and was also no 1 in Japan by value.

In Bloomberg's league tables for global equity IPO issuer advisers, Freshfields was ranked no 2, advising on 26 deals worth $14.6bn. The firm was also ranked no 2 for global equity IPO manager advisers, advising on 24 deals worth $16.8bn.

Andreas Fabritius, global head of corporate said: 'This is a great achievement for our team and illustrates the sustained level of client activity internationally, both in M&A and securities. In the absence of any unexpected global events, we can expect high levels of activity to continue for at least the first half of 2007.

Robert H. Schwartz elected to Executive Committee for Crime Stoppers of Southeastern Michigan
Butzel Long attorney and shareholder Robert H. Schwartz has been elected to the Executive Committee for Crime Stoppers of Southeastern Michigan. He also will serve as secretary for the organization.

The Alliance for a Safer Greater Detroit is the parent organization for Crime Stoppers of Southeastern Michigan. The Alliance is a non-profit organization and was founded in 1993 based on an identified need for the community, business, and law enforcement to come together to fight crime and the perception of crime in the Detroit region.

"Crime Stoppers provides an avenue for people to turn in anonymous tips on crimes that they may have knowledge of," said Mr. Schwartz. "If the tip leads to an arrest, the individual receives a financial award. Crime Stoppers is a positive program in our community."

Mr. Schwartz is based in Butzel Long's Bloomfield Hills office. His practice includes corporate and health care cases. He has extensive experience in business planning, mergers and acquisitions and in assisting health care and hospital clients in health care regulatory areas including reimbursement, fraud and abuse, and hospital physician relations, among others. He also works on various international matters with a particular emphasis on Mexico, Latin America and Canada. Mr. Schwartz is a resident of West Bloomfield.

Thomas K. Potter III To Head Burr & Forman’s Tennessee Litigation
Thomas K. Potter III (Tom) is moving his practice from the New Orleans office of Jones Walker and joins Burr & Forman LLP as lead attorney for the firm’s Tennessee Litigation practice. Tom’s practice will focus on corporate and securities and intellectual-property litigation. The firm’s Nashville office recently expanded in September of 2006, and the addition of a litigation practice will round out Burr & Forman’s ability to fully serve clients throughout the states of Alabama, Georgia, Mississippi and Tennessee.

Tom is no stranger to the legal community in Nashville. Before attending law school, he served as Special Assistant to Mayor Richard H. Fulton, Mayor to Metropolitan Nashville and Davidson County; and as a result of Hurricane Katrina, Tom temporarily practiced for three months in Nashville.

Team Obtains Dismissal of Qui Tam Lawsuit
The Blackwell Sanders team of Jim Griffin, Steve Torline and Lori Sellers recently obtained a dismissal of a complex lawsuit for the Salina Regional Health Center involving the Federal False Claims Act, commonly known as a “qui tam” lawsuit. The dismissal culminated almost 10 years of legal proceedings involving SRHC’s decision to terminate a physician’s hospital privileges at SRHC.

SRHC terminated the plaintiff's hospital privileges in 1997, and in 1999, the plaintiff first filed a lawsuit in the Kansas Federal District Court, claiming his civil rights were violated under 42 USC 1983. Jim Griffin and Steve Torline defended SRHC in this action. The district court dismissed the 1983 claims because the plaintiff failed to show that SRHC (a privately owned hospital) acted “under color of law,” as required to establish a 1983 claim.

The plaintiff appealed the dismissal to the 10th Circuit, which ultimately affirmed the district court's dismissal. While the 1983 appeal was pending in the 10th Circuit, the plaintiff filed the qui tam lawsuit under seal in the Kansas Federal District court. In the qui tam lawsuit, the plaintiff claimed that SRHC created a fraudulent scheme to submit false claims for payment to Medicare by failing to comply with certain Medicare regulations involving quality of care provided to patients. The plaintiff claimed that the scheme spanned over 15 years and sought to have SRHC refund millions of dollars paid by Medicare to SRHC.

Under the Federal False Claims Act, the plaintiff would receive up to 30% of any money wrongfully paid to the government. The plaintiff also claimed the SRHC wrongfully terminated his privileges because of his qui tam investigation. After lengthy briefing by both parties, the district court dismissed the substantive qui tam claims, finding that plaintiff failed to establish that Medicare conditioned payment to SRHC on the quality of care regulations. The district court also dismissed the retaliatory discharge claims because the plaintiff failed to file the discharge claims within the three-year statute of limitations.
