Publication names Kamenec among its ‘Lawyers of the Year’
From the nearly 40,000 practicing attorneys in the state, Michigan Lawyers Weekly (MLW) has named Plunkett & Cooney, P.C. appellate specialist, Robert G. Kamenec, as one of its “Lawyers of the Year” for 2006.
Kamenec’s involvement in 11 high-profile appellate cases this year earned him recognition among this accomplished group of attorneys. MLW is a leading legal industry publication providing news and legal updates to practitioners throughout the state.
“This is really an honor,” said Kamenec, who also serves as the firm’s Insurance / Professional Liability Department Leader. “I’ve had the good fortune to work on some really interesting cases recently, and its nice to be recognized. I certainly couldn’t do it without the backing of my outstanding clients and staff at Plunkett & Cooney.”
According to MLW, Kamenec has redefined medical malpractice liability in Michigan, and he was a driving force in shaping caselaw regarding the wrongful death savings statute and the principle of equitable tolling when letters of authority are issued. Members of the MLW editorial staff reviewed nominations for the honor, placing specific emphasis on legal accomplishments. All honorees were chosen for their contributions to the profession and their commitment to the rule of law, according to MLW.
Finalists for the MLW award were interviewed for a special section in the December 25 edition of the publication. An award presentation will be held in conjunction with the Detroit Metropolitan Bar Association’s annual conference in May.

A shareholder in the firm’s Bloomfield Hills office, Kamenec represents a variety of clients, including municipalities, insurance companies, hospitals, physicians and pharmaceutical manufacturers. His involvement in complex litigation, both at the trial and appellate court levels, includes successfully handling appeals of multi-million dollar verdicts involving medical malpractice claims, diethylstilbestrol (DES), L-Tryptophan, silicone breast implants, DBCP, other chemicals and pesticides and Fen-Phen. Kamenec has also represented various corporate clients and insurance companies in the environmental context.
Of significant note, Kamenec was involved in the case of Dow Corning v Continental Casualty, the largest appeal to proceed in the history of Michigan’s court system. With respect to recent medical malpractice appeals, Kamenec played a central role in numerous cases dealing with the retroactivity of Waltz v Wyse, a case where the Michigan Supreme Court held that the filing of the notice of intent did not stop the two-year savings period granted the plaintiff under the wrongful death savings statute. In addition, his arguments in Ward v Siano helped formulate the decision of the Michigan Court of Appeals conflict panel, which held that the doctrine of equitable tolling is not available to plaintiffs who wish to avoid the retroactive application of Waltz v Wyse.
Kamenec earned his undergraduate degree from the University of Michigan in 1978 and graduated from University of Detroit School of Law in 1982. He is a member of the Oakland County and Michigan bar associations, as well as the Michigan Defense Trial Counsel and the Defense Research Institute.
Plunkett & Cooney’s appellate attorneys concentrate their practices exclusively on appeals and have more than 1,500 combined state and federal appellate decisions to their credit. They offer clients a vision for litigation based on their knowledge of the law and whether it can be changed. Members of the group also provide the firm’s commercial and municipal clients with insight regarding appropriate settlement decisions based on their appellate experience and knowledge.

Jaqluin Lloyd joins KRCL

Kramer Levin Leads Effort to Launch Diversity Initiative: Law Firm Donates $10K To Support Legal Outreach’s New Pipeline Diversity Program
Kramer Levin Naftalis & Frankel LLP announced today that the firm donated $10,000 to help launch Legal Outreach Inc.’s new College to Law School Pipeline Diversity Program, becoming the first major firm to make a significant contribution. The initiative is aimed at helping minority college students prepare for law school.

“We are excited about spearheading this important new diversity program and take great pride in our long-standing relationship with Legal Outreach,” said Kramer Levin Managing Partner Paul Pearlman. "We believe that James O'Neal and his staff at Legal Outreach have created one of the nation's most effective programs aimed at assisting minority, inner city youth to recognize and realize their potential while moving through high school, and attending and graduating college. The College to Law School program is a new and exciting extension of this effort, geared to helping those same students in their quest to attend and graduate law school. We hope that our participation will encourage other firms to support this new initiative.”

Over the years, the firm has provided summer internships for Legal Outreach students, and numerous Kramer Levin associates have worked as mentors, debate coaches and judges for Legal Outreach programs. Also, for several years, the firm has endowed four annual scholarships for graduates of the organization’s College Bound program.

“We appreciate Kramer Levin taking a leading role in the effort to launch this important new initiative,” said James O’Neal, Executive Director of Legal Outreach. “We believe the program will provide minority college students with critical support and preparation that will keep them focused on the goal of law school.”

Legal Outreach prepares urban youth from underserved communities in New York City to compete at high academic levels by using intensive legal and educational programs as tools for fostering vision, developing skills, enhancing confidence, and facilitating the pursuit of higher education.

Kelley Drye Assists Pension Benefit Guaranty Corporation In Resolving Its Claims In the Delta Bankruptcy
Kelley Drye assisted Pension Benefit Guaranty Corporation ("PBGC") in negotiating a favorable settlement of PBGC's claims arising from the termination of the Delta Pilots Retirement Plan which paved the way for Delta to complete and file a Plan of Reorganization. The negotiations took place over several months, but were dramatically accelerated just before Thanksgiving when U.S. Airways announced an unsolicited offer to acquire Delta, which led Delta to expedite resolving the issues with the goal of emerging from bankruptcy during the first half of 2007. Pursuant to the settlement, PBGC will receive $225,000,000 in Senior Notes and a $2.2 Billion allowed claim in the bankruptcy proceedings. Based on estimates, PBGC expects to be entitled to receive approximately 15% of the outstanding common stock of Reorganized Delta when the Plan of Reorganization takes effect, making it Delta's largest post-bankruptcy shareholder. Delta filed the Plan of Reorganization on December 19, 2006. The settlement was approved by the Bankruptcy Court on December 20th.

Kelley Drye has been representing PBGC, a U.S. government owned entity formed under the Employee Retirement Income Security Act of 1974 which insures defined benefit pension plans, for many years, and is also currently working with PBGC in the Chapter 11 proceedings of Delphi Corporation.

Helen F. Bean has joined Keating Muething & Klekamp (KMK) as an associate in the labor and employment practice group.

Prior to joining KMK, Ms. Bean was an associate with Baker, Donelson, Bearman, Caldwell & Berkowitz P.C. in Nashville, Tennessee. She is currently admitted to practice in the state of Tennessee. Ms. Bean has experience in representing and advising clients in the areas of workers' compensation, retaliatory discharge, employment discrimination and harassment, supervisor training, and mediation. Her litigation experience includes trial work in state and federal courts and appellate advocacy. Ms. Bean also conducts on-site training. She is experienced in Human Resource Development and is certified by the American Society for Training and Development as a Certified Professional in Learning and Performance.
