Finnegan Henderson Accepting Applications for 2007 Diversity Scholarship Leading IP Law Firm Continues Initiative to Foster Diversity within IP Bar
Finnegan, Henderson, Farabow, Garrett & Dunner, LLP, the world's largest intellectual property firm, announced today that applications for its 2007 Diversity Scholarship are now being accepted.

The Finnegan Henderson Diversity Scholarship provides financial support to qualified minority students who demonstrate a commitment to pursuing a career in intellectual property law. Suzanne Gentes, the firm’s Director of Professional Recruitment and Development, commented, “We established the Diversity Scholarship in 2003 and have had tremendous success in awarding scholarships to law students who reflect the firm’s commitment to workforce diversity and world-class representation in the IP community. The firm is please to again be a leading supporter of a diverse IP bar through this scholarship.”

The Scholarship award of $12,000 may be applied to costs associated with normal tuition; usual fees (such as, but not limited to, student activity fees; law school or university fees, and administrative fees); and a patent bar review course. The scholarship recipient will also join the firm as a summer associate in one of its domestic offices (Atlanta, GA; Cambridge, MA; Palo Alto, CA; Reston, VA; or Washington, DC).

Buchanan Ingersoll & Rooney Attorneys Win Intellectual Property Case for Deere
Three Buchanan Ingersoll & Rooney intellectual property attorneys, Sam Ibrahim, Lloyd Smith and Bryce Maynard, prevailed before the International Trade Commission (ITC) on behalf of client Deere & Company, maker of John Deere agricultural equipment. The case, In the Matter of: Certain Agricultural Vehicles and Components Thereof, was tried before ITC Judge Paul J. Luckern.

Buchanan's team demonstrated that foreign exporters and U.S. importers and retailers were infringing Deere's famous JOHN DEERE, green and yellow, and leaping deer trademarks by selling "gray market goods" in the United States that were specifically manufactured by Deere exclusively for the European Market. Those goods, although genuine John Deere equipment, were designed to European standards and safety regulations.

Ibrahim explains, "Deere's invaluable investment in its products was at stake, so this win will ensure that U.S. consumers receive Deere-branded goods designed to meet the needs and expectations of U.S. consumers, which often differ from the expectations of consumers abroad.

Willkie Represents Time Warner Telecom in Obtaining Conditions on FCC Approval of AT&T-BellSouth Merger Approval
the FCC announced that it had approved AT&T's acquisition of BellSouth subject to extensive conditions designed to address the public policy harms posed by the merger. Willkie's Telecommunications Department represented Time Warner Telecom Inc. ("TWTC") in obtaining unprecedented conditions pursuant to which the merged AT&T-BellSouth must lower the rates charged to competitors like TWTC for broadband local transmission by approximately $500 million across the AT&T-BellSouth network footprint. The Willkie team representing TWTC included partner Thomas Jones and associates Jonathan Lechter, Grace Koh, Megan Stull, and Daniel Alvarez.

White & Case Promotes Competition Specialists to Partner
Global law firm White & Case has named two new antitrust lawyers as partners effective January 1, 2007.

J. Mark Gidley, chair of the Global Competition Group, said, "White & Case's election of Eric Grannon and Jack Pace recognizes two of our many rising stars and adds depth to our global team, especially before the US Antitrust Division and in bet-the-company antitrust trials."

Eric Grannon is a litigator who specializes in antitrust, including regulatory, criminal and private actions. He returned to the Washington, DC office of White & Case after serving as Counsel to Assistant Attorney General of the Antitrust Division, R. Hewitt Pate. Grannon’s recent work includes defense of a foreign executive in the Division's ongoing criminal investigation of the DRAM industry, defeating class certification in a putative class-action arbitration involving claims of international price fixing and customer allocation in the shipping industry, and successfully representing Upsher-Smith Laboratories in its opposition to certiorari – resulting in a historic victory over the FTC before the US Supreme Court in the seminal pharmaceutical patent-infringement settlement case.

In his new role at White & Case, Grannon comments, "I have always relished what it takes to win cases at trial, and White & Case provides me the ability to do that on a regular basis."

Jack Pace is a litigator in the New York office who focuses on complex commercial litigation and counseling in the areas of antitrust and trade regulation. He has extensive experience defending companies in complex, multi-jurisdictional antitrust class actions.

He remarks, "White & Case offers me the unique opportunity to work with and learn from leading US competition lawyers, while at the same time participating in a powerful global network of competition and dispute resolution practitioners."

Pace's recent work includes representation of a major pharmaceuticals manufacturer in a monopolization case involving allegations of fraud, a leading agribusiness company in connection with a number of antitrust actions pertaining to the sale of genetically-modified seed and herbicide products, and one of the major credit reporting agencies in its defense against Sherman Act Section 1 and 2 filed by a competitor. Pace also serves as an editor for Antitrust magazine, which is published by the ABA Antitrust Section.

Hansard Global PLC in £357 Million IPO
White & Case advised both Dr. Leonard Polonsky, the founder, chairman and indirect majority shareholder of Hansard Global plc ("Hansard") and Polar Cap Limited, the 100 percent parent and sole selling shareholder of Hansard, on Hansard's listing on the London Stock Exchange and in the initial public offering (IPO) of approximately 37 percent of Hansard's shares to institutions and certain management.

"The Hansard IPO concluded a very successful year for White & Case," said Greg Hammond, the lead White & Case partner advising on the deal. "We are particularly pleased that the strong level of interest in the Hansard IPO among investors helped us to end 2006 on such a high note."

Bloomberg's 2006 League Tables reflect the Firm's recent capital markets successes, with White & Case being ranked second by deal count and third by volume in the EMEA Equity IPO Issuer Advisers category.

Through the sale of its shares, Polar Cap Limited raised gross proceeds of approximately £130 million (excluding proceeds arising under any over-allotment arrangements). The sponsor to the listing was Lazard & Co. Limited and the underwriters to the offer were Pamure Gordon and Fox-Pitt Kelton.

Hansard is a leading provider to affluent international investors of tax-efficient investment products packaged under a life assurance policy wrapper. The company is based on the Isle of Man and has operations in Dublin.

The White & Case team advising on the transaction was led by partner Greg Hammond, working closely with partners Peita Menon, Dan Hamilton, Carmen Reynolds, Kaya Proudian, Oliver Brettle, Heather Pilley and Brian Conway; counsel Andrew O'Keeffe and Brad Kurkowski; and associates Nicholas Greenacre, Jennifer Grabowski, Deborah Grim, James Meakin, Malcolm McLean, Olivia Rascoe, Kate Boyden and Helen Puchkova in London; and partner Marc Polonsky in Moscow.

Ann-Michele G. Higgins argued before the United States Supreme Court
Ann-Michele G. Higgins argued before the United States Supreme Court on January 9, 2007. Rawle & Henderson represents a Malaysian shipowner whose vessel was arrested in China. Rawle filed suit on behalf of the client in the United States and the defendant, the cargo importer in China, filed a motion to dismiss the case based on forum non conveniens. The district court judge granted the motion to dismiss. Rawle appealed to the Third Circuit, and successfully argued that the district court was premature in dismissing the case because it had not yet ruled on our requests to deal with some personal jurisdiction issues. We also argued the decision on the forum non conveniens issue was incorrect. The Third Circuit granted our appeal, finding that a court must determine whether subject matter jurisdiction and personal jurisdiction are present before entertaining a forum non conveniens motion. Defendant then filed a petition for certiorari before the U.S. Supreme Court because there is currently a split among the other circuit courts regarding this issue. The petition for cert was granted. Ms. Higgins argued that the Court should uphold the Third Circuit's decision.
