K&L Gates’ Michael Zanic Named to American Lawyer’s “Fab Fifty” Young Litigators
K&L Gates litigation partner Michael Zanic has been named to American Lawyer’s “Fab Fifty” Young Litigators, a listing of the top 50 most promising litigators under 45 years old.

American Lawyer’s editorial staff selected the Fab Fifty based on their past accomplishments and potential future performance in their respective areas of litigation.

Zanic focuses his practice on strategic advice in the areas of insurance coverage and innovative solutions to toxic-tort-related problems, including the use of pre-packaged bankruptcies. His experience in toxic tort-related bankruptcies includes representation of the debtors in the largest asbestos and silica-related pre-packaged Chapter 11 bankruptcy filed in the United States. Zanic has also litigated major environmental, asbestos, product liability, property damage and business interruption insurance coverage cases across multiple U.S. jurisdictions. In addition to practicing law, Zanic is co-administrative partner for K&L Gates’ Pittsburgh office and a member of the firm’s management committee.

K&L Gates Opens in Berlin
today announced the launch of its first Continental European office in Berlin, Germany. The office will be staffed by partners who formerly practiced in the Berlin office of Taylor Wessing, an international firm of British and German origins.

The expansion into Germany follows the landmark combination between the international firms Kirkpatrick & Lockhart Nicholson Graham and Preston Gates & Ellis, announced last month.

K&L Gates’ German practice will offer expertise in a variety of disciplines and industries, including corporate counseling, mergers and acquisitions, securities, private equity, real estate, media, technology, entertainment and labor. The office will open with 11 partners and a full complement of associates.

The K&L Gates German team will include corporate and M&A partners Rüdiger von Hülst, Eberhardt Kühne, Thomas Lappe, and Stefan Kimmel; media and entertainment partner Martin von Albrecht; real estate partners Georg Foerstner, Felix Greuner, Christoph Wagner, Christoph Mank, and Christian Hullman; and labor partner Manfred Hack.

Peter J. Kalis, K&L Gates’ Chairman and Global Managing Partner, said: “The opening of our Berlin office is a natural expression of our relationships with many clients doing business in Europe and around the world. We are fortunate to welcome such a distinguished group of practitioners into the firm.”

Michael Johns, a senior partner in K&L Gates’ London office, said: “Clients of the London and U.S. offices have increasing activities in Germany, and many German companies are active in the U.S. and U.K. We believe that we will be producing many opportunities to work together with our new colleagues in Germany.”

Poyner & Spruill LLP is pleased to announce James S. “Charlie” Livermon, III and Deborah E. Sperati have become Partners in the firm.

James S. “Charlie” Livermon, III focuses his practice on bankruptcy and creditor’s rights, and represents secured creditors, including national and regional banks and other lending institutions in commercial and consumer bankruptcy cases. Charlie assists creditors in obtaining relief from the automatic stay, objecting to confirmation of plans, challenging valuations of collateral, and objecting to discharge and dischargeability of particular debts. In addition, he represents secured and unsecured creditors, including unsecured creditors committees, in Chapter 11 bankruptcy cases and in adversary proceedings involving preferential and fraudulent transfers. Finally, in addition to his representation of creditors in bankruptcy cases, he represents banks and other lending institutions in collection, foreclosure and claim and delivery actions across North Carolina. He regularly practices in all bankruptcy courts and state courts in North Carolina. Charlie received his J.D. from Campbell University and his B.A. from Hampden-Sydney College. Deborah Sperati practices in the areas of Civil and Commercial Litigation, Bankruptcy, and Creditors’ Rights. She frequently represents creditors in workouts, bankruptcies, collections, and lender liability matters. Her practice also includes representation of businesses and individual clients in a wide variety of civil litigation matters before State and Federal Courts, including contract disputes, fiduciary duty claims, property disputes and fraud claims. She is very active in her community of Rocky Mount, where she serves on the Executive Committee of the Chamber of Commerce Board of Directors and chairs the Chamber's Community Investment Committee. She is also Chairman of the Tar River Wine Festival and serves on the Board of Directors for the Harrison Family YMCA, the Futrell-Mauldin Community Fund, and the Tar River Charitable Foundation. Deborah is a founding member and Past President of the Rocky Mount Young Professionals Network, and a certified black belt in Tae Kwon Do. Poyner & Spruill Attorney Ken Burgess to Speak at National Nursing Home Trade Association Meeting
Well-known health care speaker Ken Burgess, an attorney in the Raleigh office of Poyner & Spruill LLP, will address a national audience in Washington, D. C. on the implications of the Deficit Reduction Act of 2005. This legislation takes effect January 1, 2007.

The American Health Care Association will bring together the CEOs from each state chapter of the organization in Washington for two days of training on the new laws January 10 – 11, 2007. Burgess is one of several speakers chosen to address the group on the new federal fraud reduction legislation and how it will affect Medicaid programs. The 2-day training will enable the CEOs from each chapter to go back to their own state and help nursing homes comply with the new laws.

Burgess is a long term care attorney advising clients on a wide variety of legal planning issues arising in the skilled nursing facility setting, assisted living setting, and other spheres of long term care. He is a frequent national lecturer and author of industry manuals, national trade journal magazine articles and similar training tools. He serves Poyner & Spruill clients by focusing on legal issues impacting the long term care and health services sector.

McCarthy Tétrault Tops Year-End League Tables with Most Canadian M&A Deals in 2006
McCarthy Tétrault ranks as the number-one Canadian law firm for most announced and completed Canadian M&A deals in year-end league tables, released this month by Thomson Financial and Bloomberg. Thomson Financial accredits the firm with 117 announced Canadian M&A deals, 33 more than its closest competitor. McCarthy Tétrault also leads the Thomson Financial table for the most completed Canadian M&A deals in 2006 with 107 deals.

"These unprecedented results are continued proof that our clients have complete confidence in our expertise and abilities to deliver outstanding client service in their M&A transactions," said David Tennant, Co-Practice Group Leader of McCarthy Tétrault’s Business Law Group. "2006 was a banner year for M&A activity and I don’t see an end in sight, given the capital strength of the private equity sector, consistently low interest rates and the overall strength of the Canadian economy.

"In Canada, the value of M&A deals almost doubled from US$89 billion in 2005 to US$173.6 billion in 2006. As KPMG reported, the number of Canadian M&A deals increased by 26 per cent over 2005 with financials, natural resources, and oil and gas dominating the field. In 2007, I believe we will see more M&A transactions in these fields, as well as power, telecommunications and technology.

LAMB McERLANE ATTORNEYS TO INTRODUCE “THE APPELLATE WHEEL OF (MIS)FORTUNE” AT TATEWIDE BAR PROGRAMS IN JANUARY
Attorneys James C. Sargent, Jr., Scot Withers and Joshua Villari of Lamb McErlane PC, a full service law firm in West Chester, and Dean Phillips of Elliott Greenleaf and Siedzikowski in Blue Bell, will present “The Appellate Wheel of (Mis)Fortune,” a series of CLE programs for the Pennsylvania Bar Institute, this month to demonstrate the strategic opportunities, common mistakes, and procedural pitfalls associated with appellate law practice.
The “Appellate Wheel of (Mis)Fortune” programs will be held from 8:45 a.m. to noon on three separate dates across Pennsylvania: Friday, January 12 in Pittsburgh, Friday, January 19 in Philadelphia, and Tuesday, January 30 in Mechanicsburg.
The course, designed by Pennsylvania Bar Association Appellate Advocacy Committee Co-Chairs the Hon. Mary Jane Bowes, Pennsylvania Superior Court and James Sargent of Lamb McErlane; and Dean Phillips of Elliott Greenleaf, will focus on practical problems encountered by appellate attorneys, as well as technical requirements for the rules of appellate procedure. The format will include an interactive game show question and answer segment entitled “The Appellate Wheel of (Mis)Fortune” that addresses recent court cases to reveal common procedural mistakes that may damage a claim’s chances for success. In particular, the course will look at controversial rule 1925(b), which provides strict standards for filing cases on appeal, including recent changes and developments in its application.
“ ‘The ‘Appellate Wheel of (Mis)Fortune’ provides an engaging and entertaining format for attorneys to learn about the recent court decisions that impact the practice of appellate law and procedural pitfalls that often prevent otherwise viable claims from being heard,” says Sargent, who is also a member of the Appellate Procedural Rules Committee for the Pennsylvania Supreme Court. “This type of course is a very user-friendly way to obtain information and unique perspectives from a highly respected panel of experts who cannot be accessed together anywhere else.”
