Gunter Selected to 'Legal Elite'
Nelson Mullins Riley & Scarborough Winston-Salem Partner Denise Gunter has been selected by her peers as among North Carolina's most effective lawyers in antitrust and is listed in the January 2007 Business North Carolina's Who's Who of North Carolina's Legal Elite.

The magazine surveyed 18,000 lawyers from the N.C. Bar to determine the best lawyers in 14 categories for this year's 6th Legal Elite. Voters could not pick themselves and could only select members of their own firms if they also voted for out-of-firm lawyers in the same categories. Only about 3 percent of the state’s lawyers are selected from among the top vote-getters.

Ms. Gunter is the managing partner of the Winston-Salem office and, in addition to antitrust, practices in the health care and litigation fields, with particular emphasis on health care matters and certificate of need issues. She advises clients on a variety of antitrust issues, including pricing, mergers and acquisitions, joint ventures, and proper structuring of "messenger model" networks. She also litigates a variety of health care related cases, including medical staff privilege cases and managed care disputes; and defends clients in government antitrust investigations.

Active in the community, Ms. Gunter is a member of the board of trustees of Senior Services, Inc. of Forsyth County. In 1986, Ms. Gunter earned a Bachelor of Arts from Northwestern University. In 1989, she earned a Juris Doctor from George Washington School of Law, where she was a member of the Moot Court Board and the National Moot Court Team.

STERNE, KESSLER, GOLDSTEIN & FOX ANNOUNCES ELECTION OF DIRECTORS
Intellectual Property law firm Sterne, Kessler, Goldstein & Fox is pleased to announce the election of Vincent L. Capuano, Ph.D., Elizabeth J. Haanes, Ph.D, Kevin W. McCabe and Michael D. Specht, to the directorship.

Dr. Capuano’s practice is focused in the chemical and pharmaceutical area, where he counsels clients in all areas of patent procurement, exploitation and enforcement, including domestic and foreign patent preparation and procurement, patent validity and infringement analysis, patent licensing and FDA/ANDA practice. He holds a J.D. from the University of Akron, a Ph.D. in Organic Chemistry from the University of Texas, and a B.S. in Chemistry from The Ohio State University.

Dr. Haanes specializes in biotechnology patent law, working closely with clients to build and maintain strong patent portfolios. She prepares and prosecutes patent applications in a variety of disciplines, including immunology, virology, genomics, gene therapy, and vaccines. She also advises clients on patent law issues which may impact strategic business decisions. Dr. Haanes earned her J.D. from the University of Colorado, her Ph.D. in Microbiology from the University of Minnesota and a B.S. in Biology from the niversity of Michigan.

Mr. McCabe’s intellectual property law experience has principally involved representing clients in complex multi-jurisdiction, multi-party, and multi-patent litigations, including Paragraph IV ANDA litigations. Another focus of Mr. McCabe’s practice is preparing product clearance opinions, patent validity and infringement opinions, and performing patentability investigations. He also has extensive experience in drafting and prosecuting patent applications in the biotechnology and chemical areas. Mr. McCabe holds a J.D. from The George Washington University, with honors, a M.S. in Applied Molecular iology from the University of Maryland and a B.S. in Biology from the University of Richmond.

Mr. Specht develops and prosecutes patent applications, conducts intellectual property audits, creates and implements licensing strategies, and counsels clients on the development and implementation of intellectual property strategies to maximize the economic potential of their intellectual property. Additionally, he has worked closely with venture capital firms to evaluate legal and regulatory matters associated with emerging technologies. He earned his J.D. from Georgetown University, cum laude, a M.S. in Electrical Engineering from Purdue University and a B.S. in Electrical Engineering from Case Western Reserve University, with highest honors.

SEASONED CAPITOL STRATEGIST JOINS PUBLIC LAW TEAM OF LOCKE LIDDELL STRATEGIES
Shane Doucet has joined Locke Liddell Strategies, the Washington, D.C., public affairs arm of Texas-based Locke Liddell & Sapp LLP, as a political strategist. Doucet began his career in Washington with Congressman Chris John, a conservative Democrat from Louisiana who is a former Chairman of the Blue Dog Democrats, and comes to Locke Liddell from the Louisiana-based firm of Adams & Reese.
Prior to joining Adams and Reese, Doucet served as Vice President of a significant Washington, D.C., consulting firm where he represented various pharmaceutical and health services companies, as well as clients in the energy, high-tech and financial services industries. Previously, he lobbied on behalf of the National Federation of Independent Business (NFIB) for more than two years on issues such as health care reform, legal reform, energy, tax and environmental regulations.
While living in Baton Rouge, Doucet spent time as a legislative aide for State Sen. Phil Short. In D.C., he served more than two years as a Legislative Assistant to Rep. John, a member of the Health Subcommittee on the Energy and Commerce Committee. In that capacity, he worked on education, energy, health, judicial, foreign affairs, immigration and labor issues. He is a native of Lafayette, La., and received his Bachelor of Arts in History and English from Tulane University in New Orleans. He currently serves as a Communications Officer for the District of Columbia Air National Guard in the 113th Fighter Wing.

2006 Arizona Securities Fraud Liability Publication Released by State Bar of Arizona
The international law firm Greenberg Traurig, the nation’s seventh largest law firm, is pleased to announce that Brian J. Schulman has co-authored Arizona Securities Fraud Liability: Statutory and Common-Law Remedies, Second Edition.

“The first edition of the treatise was outstanding. I used it all the time,” states Schulman, Of Counsel in the Phoenix office of Greenberg Traurig. “Rich Himelrick, the author, told me he was going to revise his work from the first edition, and asked if I would be interested in writing some new material to expand the scope of the publication. I was honored that he asked, and more than happy to participate in the second edition. It always has been, and remains, an invaluable resource on the topic of securities litigation in Arizona.”

According to the State Bar of Arizona, Arizona Securities and Fraud Liability provides a comprehensive discussion on the theories of securities-fraud liability, defenses, and damages that exist under Arizona’s statutes and common law. Revisited topics include securities liability under the Consumer Fraud Act and the common-law of misrepresentation, nondisclosure and fiduciary duties; use of administrative precedent developed by the Arizona Securities Division; defenses to securities-fraud claims; and statutory and common-law damage measure.

Schulman, Of Counsel in the Phoenix office of Greenberg Traurig, focuses his practice on complex commercial and securities litigation. Prior to joining the firm, he served as General Counsel to the Securities Division of the Arizona Corporation Commission, providing representation on such regulatory matters as lobbying, rulemaking, and administrative proceedings related to investment advisor, broker/dealer and capital formation regulations. Schulman also prosecuted numerous securities fraud cases on behalf of the Securities Division. He graduated from the University of Kansas School of Law, where he served as editor of the Kansas Journal of Law & Public Policy. Schulman currently resides in Phoenix.

Hangley Aronchick Segal & Pudlin’s Ashely M. Chan Appointed to Homeless Advocacy Project Board of Directors
Ashely M. Chan, a bankruptcy shareholder at the law firm of Hangley Aronchick Segal & Pudlin, was recently appointed to the Homeless Advocacy Project (HAP) Board of Directors.

The Homeless Advocacy Project is a legal aid project of the Philadelphia Bar Association. HAP exists to meet the legal and advocacy needs of homeless individuals and families in Philadelphia. With a legal staff of five and a corps of 300 volunteer lawyers, paralegals, and law students, HAP engages in direct outreach to homeless individuals in need of legal services.

Ms. Chan concentrates her practice in the areas of bankruptcy and corporate restructuring. She is a 1996 graduate of Rutgers Law School-Camden, where she received Tax Honors With Distinction. Ms. Chan received her B.A. in Mathematics from Douglass College, Rutgers University in 1993.

Patent Partner Richard Pettus Joins King & Spalding's IP Practice
Continuing its aggressive expansion in the intellectual property arena, King & Spalding, a leading international law firm, announced today that Richard Pettus, a patent litigator with significant experience in the pharmaceutical, medical device and consumer products sectors, has joined the firm's New York office as a partner in its intellectual property practice group. Pettus is the seventh new partner to join King & Spalding's IP group in the past four months and the third new partner to join the firm's New York office in that time period.

"We are excited to welcome Rich to King & Spalding as yet another addition to our expanding IP group," said Courtland L. Reichman, the leader of King & Spalding's intellectual property practice. "Rich is a first-rate trial attorney, who has handled an impressive roster of IP cases during his career and has extensive experience in the pharmaceutical and medical devices industries. He will be an important contributor to our ongoing efforts to expand our intellectual property practice and enhance our services to these industries."

Pettus is the seventh new partner to join King & Spalding's IP practice since September 2006. IP litigators Tony Askew, Steve Schaetzel, Jim Johnson and John Harbin joined the practice in the firm's Atlanta office, and patent lawyers Ken Sonnenfeld and Peg Brivanlou joined the firm's New York office. Sonnenfeld's arrival marked the establishment of a patent prosecution capability in the firm's New York office, which now has a full complement of IP capabilities and more than 30 lawyers and patent agents. In all, the firm's IP group now numbers more than 100 lawyers and patent agents.

Pettus joins King & Spalding from McDermott Will & Emery, where he was a partner. His practice focuses on the litigation and licensing of patents, with particular expertise in pharmaceutical matters, including ANDA Hatch-Waxman actions. He also has extensive experience counseling Fortune 250 and emerging pharmaceutical/biotech companies and investors on strategies for IP due diligence, licensing, pre-litigation investigations and patent prosecution. Prior to joining McDermott, Pettus practiced at Morgan, Lewis & Bockius and the patent litigation boutique Hopgood, Calimafde, Kalil & Judlowe.

Pettus earned an engineering degree from Manhattan College and a J.D. from Fordham University School of Law.
