Verrilli Argues Habeas Evidentiary Hearing Rights Case Before Supreme Court
Jenner & Block Partner Donald B. Verrilli, Jr. urged the U.S. Supreme Court on January 9 to help delineate those instances in which it is appropriate to hold an evidentiary hearing for a habeas petitioner whose original attorney failed to present important mitigating evidence during the sentencing phase of his death penalty trial. Among other things, Mr. Verrilli, Jr., asserted that Jeffrey Landrigan, convicted of murder in 1990 and sentenced to death by an Arizona State Court, should be granted an evidentiary hearing to determine if he was deprived of his 6th Amendment right to effective assistance of counsel at trial. Schriro v. Landrigan, No. 05-1575.

According to Mr. Verrilli, his pro bono client’s attorney at the time failed to provide adequate representation at trial by refusing to present valuable evidence, including key testimony and expert evaluations regarding Landrigan’s troubled childhood and current mental state during sentencing.

The case comes on appeal from the Ninth Circuit, in which the Appellate Court held en banc that Mr. Landrigan “has demonstrated proper basis for an evidentiary hearing,” based on the assertion that he “made a colorable claim that he did not receive effective assistance of counsel in his sentencing.”

In addition to Mr. Verrilli, the Jenner & Block legal team on this matter includes Partners Ian H. Gershengorn and Elaine J. Goldenberg, and Associates Scott B. Wilkens, Jessica Ring Amunson, and Joshua M. Segal. Mr. Landrigan’s counsel of record are Dale A. Baich, Sylvia J. Lett, and Justin F. Marceu of the Office of the Federal Public Defender for the District of Arizona.

Mr. Verrilli had played a lead role in the landmark Supreme Court case, Wiggins v. Smith, in which a majority of Justices struck down the death sentence of another pro bono client and reaffirmed the duty of defense counsel in capital cases to explore all potentially mitigating evidence.
