Federal Circuit Denies Petition for Rehearing; Favorable Decision for Aero Products Brings Dispute Closer to Resolution
Brinks Hofer Gilson & Lione today announced that, on January 9, 2007, the United States Court of Appeals for the Federal Circuit confirmed its prior victory on behalf of its clients Aero Products International, Inc. and Robert B. Chaffee when the Court of Appeals denied a Petition for Rehearing filed by Intex Recreation Corporation.

The case, Aero Products International, Inc. v. Intex Recreation Corporation; Quality Trading, Inc.; and Wal-Mart Stores, Inc., involved technology that allows a user to quickly inflate an air mattress and easily adjust its firmness using a unique comfort control feature found in Aero’s popular line of AeroBed ® inflatable mattresses.

On October 2, 2006, the Court of Appeals affirmed a nearly $12 million patent judgment that Aero obtained after a February 2004 jury trial at which a Northern District of Illinois jury found that Intex had willfully infringed Aero ’s patent rights. Intex petitioned for a rehearing but, after considering briefs filed by the parties, the Court of Appeals denied the Intex petition. This favorable ruling brings Aero closer to a resolution of this lengthy legal dispute.

Aero was represented at trial, at the contempt hearing and on appeal by the intellectual property law firm Brinks Hofer Gilson & Lione. William H. Frankel was the lead trial lawyer and Michael P. Chu argued the appeal. Litigators Mark H. Remus and David H. Bluestone were also part of the winning Brinks team.

Brinks Hofer Gilson & Lione Brings Santa to Leland School

For more than 10 years, Brinks has participated in a “Letters to Santa” program, providing holiday gifts to Chicago Public School students in some of the most underprivileged areas of the city. This holiday season, Leland School students wrote letters to Santa requesting a variety of toys and the firm’s attorneys and staff members responded, purchasing gifts for the children and delivering them in time for a visit from Santa. In addition, Brinks gave each student a backpack containing pencils, sharpeners, erasers, crayons and scissors.

Fross Zelnick Ranked No. 1 Trademark Filer By The U.S. Patent And Trademark Office
Fross Zelnick Lehrman & Zissu, P.C., a leading law firm specializing in trademark, copyright, design and unfair competition law, has filed more trademark applications than any other law firm nationwide and is the most active law firm user of the Trademark Electronic Application System (TEAS), according to the Department of Commerce’s U.S. Patent and Trademark Office (USPTO). Susan Upton Douglass, a partner at the firm, was recently named the most prolific individual attorney filer by NameProtect, a digital brand management company.

The recognition of Fross Zelnick and Ms. Douglass was made in conjunction with the USPTO’s public commemoration today of the one-millionth trademark application filed using TEAS. Launched in November of 1997, TEAS is a Web-based application process that now accounts for the vast majority of all trademark filings.

Bell, Boyd Elects Associates to Partnership
