Court Grants Final Approval to $423 Million Class Action Settlement in Uninsured Pricing Lawsuit Against Catholic Healthcare West
The Honorable Richard A. Kramer of the San Francisco Superior Court granted final approval today to a class action settlement resolving claims regarding pricing and collection practices for over 780,000 uninsured patients at all of Catholic Healthcare West’s affiliate hospitals.
As part of the settlement, Class members will be entitled to make a claim for refunds or bill reductions of 35% from their prior hospital bills. For the next four years, Catholic Healthcare West (“CHW”) hospitals have also agreed to maintain discounted pricing policies for uninsured patients that will make CHW’s pricing for uninsured patients comparable to the pricing for patients with private insurance. In addition, CHW has agreed to maintain more compassionate collections policies that will protect uninsureds who fall behind in their payments. The settlement benefits have been valued at approximately $423 million.
The claims process under the settlement is ongoing. Claim forms are available online at the settlement website, www.chwsettlement.com, and the deadline to submit claims is March 8, 2007.
The Settlement Class includes all persons who:

* Received hospital services from a CHW-affiliated hospital between July 1, 2001 and September 25, 2006;
* At the time of treatment, were uninsured and had annual household income at or below $250,000.

“This settlement provides much-needed relief to hundreds of thousands of uninsured patients by substantially reducing their past medical bills and ensuring that in the future CHW maintains reasonable prices for all uninsured patients,” said Plaintiffs’ attorney Kelly M. Dermody, of Lieff Cabraser Heimann & Bernstein, LLP, in San Francisco, California. Co-counsel Sidney A. Backstrom of the Scruggs Law Firm added, “We are pleased that the Court granted final approval to this settlement, which not only secures fair pricing for uninsured patients, but also protects them from unfair and overly aggressive collections practices.”
The lawsuit was filed by two uninsured patients on behalf of themselves and all uninsured patients at CHW-affiliated hospitals in California, Nevada and Arizona. The original complaint, filed in October 2005, alleged that CHW charged uninsured patients excessive and unfair prices for medical treatment and engaged in aggressive and unfair collections practices. CHW denied wrongdoing and liability in the case.

Kenneth Brooks Named Managing Partner of Honigman's Lansing Office
Honigman Miller Schwartz and Cohn LLP announced today that Kenneth Brooks has been named managing partner of Honigman’s Lansing office, effective Jan. 1, 2007. Brooks replaces Dan Demlow, who has retired and had served as managing partner of the Lansing office since its inception in 1985.

“We look forward to the continued growth and new business goals that Ken brings,” said Alan S. Schwartz, CEO of Honigman. “His experience and professional and personal networks in Lansing will be invaluable to continuing our commitment to bringing connectivity and results to our clients. Ken’s ability to relate to the Honigman attorneys and staff will also contribute to his effective management of the Lansing office.”

Brooks joined Honigman as a partner in 2004. Concentrating in litigation and insurance law, Brooks was recently included in the 2007 edition of Best Lawyers in America for his work with Honigman’s Commercial Litigation practice. Brooks also serves on the Honigman Board of Directors. Brooks’ predecessor, Demlow, was the first and only attorney to serve as managing partner of the Lansing office. During his tenure, Demlow worked to build Honigman’s regulatory practice into one of the best in the state.

“Under Dan’s direction our Lansing office has experienced many successes,” said Brooks. “I am excited about the future opportunities Honigman has in Lansing. We want to provide our clients and prospective clients with the unique resources available in the state’s capitol.” Brooks resides in Williamston with his wife Ginny. He has two grown children Kristin and Drew.

Ronald E. Whitney Joins Honigman As Partner
Ronald E. Whitney recently joined Detroit-based law firm Honigman Miller Schwartz and Cohn LLP, as partner with the firm’s Corporate and Securities Law department. Whitney comes to Honigman from Ford Motor Company (Ford) in Dearborn, where he has been Counsel in Mergers and Acquisitions Transactions at the Ford Office of General Counsel for the last five years. His practice at Ford included general experience in corporate business and tax law, with a strong entrepreneurial focus. Prior to joining Ford, Whitney worked in New York as an associate attorney at Cahilll, Gordon & Reindel for three years and at Cravath, Swaine & Moore for five years.

Whitney received his LL.M. from New York University School of Law in 1991, his J.D. from Columbia University School of Law in 1988, his M.B.A. from George Washington University in 1978, and his B.Sc. from the University of Nebraska in 1973. Whitney resides with his family in Bloomfield Hills, Michigan.

Duane Morris to Contribute $100,000 to the University of Pennsylvania Law School Endowed Chair in Civil Rights
Duane Morris LLP announced that the firm has pledged $100,000 to the University of Pennsylvania Law School to help in funding the new Raymond Pace and Sadie T.M. Alexander Chair in Civil Rights. The endowed chair, still in the fundraising stage, will support the work of legal scholars in the area of civil rights.

"Duane Morris is pleased to join with the Law School in support of this fundraising effort," Duane Morris Chairman Sheldon Bonovitz said. "It is important that law students be aware of the contributions of great African-Americans. No one has made a greater contribution in this arena than this unique couple." The contribution was first raised by the firm's Diversity Committee, led by Duane Morris Partner Nolan Atkinson, Jr.

The Alexanders were pioneers in law and government through much of the 20th century. Sadie Alexander achieved a number of "firsts." She was the first African-American woman to graduate from the University of Pennsylvania Law School, to be admitted to the Pennsylvania bar and to earn a Ph.D., which she received in Economics in 1921. She served on the President's Committee on Civil Rights in 1947 under Harry S Truman, and in 1978 was appointed by President Jimmy Carter to chair the White House Conference on Aging, which addressed the social and economic needs of the elderly.

Raymond Pace Alexander, a prominent lawyer and politician in Philadelphia, successfully litigated numerous discrimination cases that resulted in equal access for African-Americans to public schools, restaurants and hotels in Philadelphia. He became the first African-American judge on the bench of the Philadelphia Court of Common Pleas, in 1959. Raymond also decided the case that approved, over objection, the establishment of Community Legal Services. He died in 1974, at 76 years of age.

Several Duane Morris attorneys are closely connected with the Alexanders. After her husband's death in 1974, Sadie Alexander practiced in the firm of Atkinson & Archie, which included current Duane Morris partners Bob Archie and Nolan Atkinson. She died in 1989, at 91 years of age.
