Firm Argues Lethal Injection Case Before the Eighth Circuit on Behalf of Pro Bono Client
Jenner & Block Associate Ginger D. Anders argued before a federal appeals court yesterday, urging the Justices to affirm a Missouri trial court's 2006 stay of all executions in the state and which mandated new lethal injection protocols on constitutional grounds.

Ms. Anders appeared on behalf of Death Row inmate Michael Taylor and against the state's appeal, saying the Missouri Department of Correction's method of executing the condemned remains "fraught" with systemic problems that could subject them to "unconstitutional pain and suffering."

The decision by U.S. District Judge Fernando Gaitan, Jr., had required the DOC to meet a number of new requirements, including a formal written execution protocol and a board-certified anesthesiologist to monitor anesthetic depth during the procedure.

In its appeal, the State disputed the court-ordered requirements, arguing that the alleged pain and suffering in its procedures does not violate the Eighth Amendment unless prison officials “intend” to cause such pain and suffering.

In response to the State’s appeal, the Firm contends that the District Court did not err in its findings. It noted that evidence presented at the trial had revealed that Missouri had vested almost total discretion regarding the execution procedure to a single physician, who changed fundamental aspects of the procedure – including the amount of anesthesia administered – from execution to execution. It was further revealed during trial that prior inmates who received lethal injections may have been given insufficient doses of anesthesia and that the DOC’s physician “often transposes numbers” and “can make mistakes” due to his dyslexia condition.

In addition, the Firm argued that the District Court applied the correct Eighth Amendment standard in its 2006 decision, and that cruel and unusual execution methods do not become constitutional even if they are “unintended.”

The Jenner & Block team of attorneys working on the pro bono matter of Michael Taylor v. Crawford before the U.S. Court of Appeals for the Eighth Circuit also included Partner Donald B. Verrilli Jr., and Associates Eric Berger and Matthew S. Hellman.

Open House Provides First Year Law Students with Glimpse of Jenner & Block Culture
Nearly 100 first year law students from law schools across the country attended Jenner & Block’s third annual “Winter Break Open House” reception, held last week at the Firm’s Chicago office. The event provided the students with an inside look at Jenner & Block and its commitment to pro bono service, and gave them an opportunity to learn about life as a member of the legal profession.

Jenner & Block Partners and Co-Chairs of the Firm’s Hiring Committee Katherine A. Fallow, Reginald J. Hill and Charlotte L. Wager welcomed the students to the Firm, and Partner Robert L. Graham, founder and Chair of Jenner & Block’s Environmental, Energy and Natural Resources Law Practice, offered his perspective on what the students can aspire to as future members of the legal profession.

Mr. Graham stressed the obligation of attorneys to balance their professional objectives with meaningful public service. A member of the American Bar Association’s Commission on the Renaissance of Idealism in the Legal Profession, he urged the students to “remember why they went to law school in the first place,” and encouraged them to work in a place where they are passionate about what they do and have the opportunity to help people who cannot help themselves.

He also advised the students to speak with representatives attending the event from various Chicago-based non-profit legal organizations that hire first year law student interns. Jenner & Block invited members of Business & Professional People for the Public Interest (BPI), the Cabrini Green Legal Aid Clinic (CGLA), the Chicago Legal Clinic, the Environmental Law & Policy Center (ELPC), and the Public Interest Law Initiative (PILI).

Mr. Graham noted that the Firm has a close relationship with these organizations and works regularly with them on pro bono initiatives. Jenner & Block Partner Anton R. Valukas is the on BPI Board; Associate Brian O’Donnell is on the Board of the Chicago Legal Clinic; Partner Jeremy M. Taylor is on the CGLA Board and C. John Koch and Terrence J. Truax are on the CGLA Advisory Board; Mr. Graham is on the Board of ELPC; and Partner Eric A. Sacks is on the PILI board.

Holland & Knight Strengthens Its Public Policy & Regulation Group with the Addition of Former U.S. Representative Jim Davis
Holland & Knight LLP strengthens its legislative and regulatory practice with the arrival of former U.S. Representative Jim Davis (D-FL). Davis joins the firm's Tampa, Fla., and Washington, D.C., offices, and will play a major role providing strategic counsel to clients in the District of Columbia and across the country. The firm also welcomes Karl Koch, Davis' former Chief of Staff, who will be resident in the firm's Tampa and Washington, D.C., offices.

Hogan & Hartson Awarded Contract to Manage Multilateral Carbon Credit Fund
Hogan & Hartson MNP is member of a team — together with ICF International — that has been awarded a service contract to act as manager of the new Multilateral Carbon Credit Fund (MCCF) issued by the European Bank for Reconstruction and Development (EBRD) and the European Investment Bank (EIB).

The MCCF has newly been issued by the EBRD and EIB to maximize the opportunities that arise from carbon credit trading, focusing on countries in transition located in Central Asia, the Caucasus Region, and the Balkans. EBRD and EIB have appointed three carbon managers; each will cover a defined sub-region on a exclusive basis. Carbon managers will identify, prepare, negotiate, and monitor project-based carbon credit transactions.

Hogan & Hartson and ICF International will jointly act as carbon managers for the southeast European region.

The Hogan & Hartson team is being led by Dr. Carl-Stephan Schweer, a partner in the Berlin office.

Hogan & Hartson has been co-appointed with London-based ICF International, a management, technology, and policy consulting firm. Together with ICF International, Hogan & Hartson has been awarded a contract to assist Russia in implementing the Kyoto Protocol in July of 2005.

Partner Paulette Brown to Receive American Bar Association's Spirit of Excellence Award
Paulette Brown, a Partner in the Litigation Department in the New Jersey office of Edwards Angell Palmer & Dodge, will receive the American Bar Association’s Spirit of Excellence award at the organization’s Midyear Meeting in Miami, Florida on February 10, 2007. Paulette Brown is a Past President of the National Bar Association; President of the YWCA of Central New Jersey; Member of the ABA Commission on Women in the Profession; and Council Member, ABA Section of Litigation.

The Spirit of Excellence Award was established by the ABA Commission of Ethnic & Racial Diversity to celebrate the efforts and accomplishments of lawyers who work to promote a more racially and ethnically diverse legal profession. Jean Soh Joins Dykema
Dykema announces that Jean Soh has joined the firm as an Associate in the Bankruptcy and Restructuring practice group, resident in its Chicago office. Prior to joining Dykema she served as a judicial clerk for the Honorable Ernest M. Robles in the U.S. Bankruptcy Court for the Central District of California in Los Angeles and was an intern at the U.N. Criminal Tribunal for Rwanda in Arusha, Tanzania.

Ms. Soh received her B.A. from Wesleyan University and thereafter served as a Peace Corps volunteer in Cameroon. She earned her J.D. from the University of Michigan where she was an Executive Editor of the Michigan Journal of Law Reform, vol. 38.
