Labaton Sucharow & Rudoff Files Amicus Curiae Brief on Behalf of the AARP In Important Antitrust Case
Labaton Sucharow has filed a friend of the court brief in a significant antitrust case argued January 10, 2007 in the New York Court of Appeals. The Firm was requested to appear on behalf of the American Association of Retired People ("AARP") to represent its interests in connection with the issue of whether New York's Antitrust Statute ("Donnelly Act") permits the filing of a class action for antitrust damages. In its brief, authored by Bernard Persky and Kellie Safar of the Firm's Antitrust Practice Group, the Firm argued that without the ability to prosecute class actions on behalf of consumers, and other indirect purchasers, New York's antitrust remedy would be rendered meaningless. A decision on this vital question is expected in the next few months.

Chicago Civil Rights Pioneers to Share Their Views and Experience at Much Shelist on Martin Luther King, Jr. Day
Chicago-based law firm Much Shelist announced today that two of the city’s most distinguished African American judges and civil rights champions, the Honorable George N. Leighton and the Honorable R. Eugene Pincham, will address the firm on Martin Luther King, Jr. Day, Monday, January 15, 2007, from 1:30 to 3:00 p.m. The two will share their personal stories and insights with Much Shelist attorneys and staff as part of the firm’s second annual Diversity Day celebration.

Leighton and Pincham have championed human rights throughout their long and distinguished legal careers. Both are former Cook County judges and Illinois justices who were active during the civil rights movement in Chicago, both hold lifetime memberships in the NAACP, and both have won numerous awards and recognition for their professional and community service.

A graduate of Howard University and Harvard Law School, Leighton has served as Judge of the Circuit Court of Cook County, the Illinois Appellate Court, and United States District Court. During his career, he often attracted national attention and made history by defending the civil rights of all Americans. He has been active in the NAACP, serving as a two-term President of the organization’s Chicago Branch. In 1951, Leighton founded the law firm Moore, Ming & Leighton, considered one of the largest predominantly black law firms in the United States. He was also the first African American to serve on the Board of Managers of the Chicago Bar Association.

R. Eugene Pincham has been an active and dynamic civil rights leader for more than 50 years as a lawyer, former judge of the Circuit Court of Cook County, justice of the Appellate Court of Illinois, educator and politician. A graduate of Northwestern University School of Law, he has argued cases before the United States Supreme Court on three separate occasions. In 1991, he became the Harold Washington Party nominee for mayor, carrying 19 of Chicago’s 50 wards. He has taught at some of America’s most prestigious universities, including Harvard, Yale, Cornell, Notre Dame and Northwestern.

“Leighton and Pincham are living legends known for their groundbreaking legal work in civil rights, as well as their personal commitment to championing diversity,” said David T. Brown, Chair of the Much Shelist Management Committee. “We are excited to hear their stories and learn from them.

Brian Rice Named To Connecticut Bar Diversity Post
Brian P. Rice, an Associate in McCarter & English's Stamford office, has been named Co-Diversity Director for the Young Lawyers Section of the Connecticut Bar Association.

Mr. Rice has long been active in organizations which support equal rights for the gay, lesbian, bisexual and transgender community. He has testified before the Connecticut General Assembly's Judiciary Committee on issues of marriage recognition and, as a member of the Human Rights Campaign, has worked closely with federal legislators.

Mr. Rice's law practice focuses on construction litigation. His experience includes representing public and private entities in resolving construction claims and disputes, including mechanic's liens. He has represented owners
and suppliers in litigation, arbitration, and appellate proceedings. Mr. Rice also counsel's clients on appellate advocacy.

A graduate of Northeastern University School of Law (J.D. 2004) and Franklin & Marshall College (B.A., cum laude, 2001), Mr. Rice was selected by The Connecticut Law Tribune for its "New Leaders of the Law" in 2005.

Weil Gotshal Obtains Major Appellate Victory for Former Chairman and CEO of Westar Industries
Weil Gotshal obtained a major appellate victory in the US Court of Appeals for the Tenth Circuit on behalf of David Wittig, the former chairman and CEO of Westar Industries. In a case that was dubbed "the Enron of Kansas,” Mr. Wittig was indicted on 40 counts of conspiracy, wire fraud, money laundering and circumvention of internal financial controls. After two trials, the first ending in a hung jury, Mr. Wittig was convicted on all 40 counts and sentenced to 18 years in prison, fined $5 million, and ordered to pay $14.5 million in restitution.

After reviewing a trial record that exceeded 60 volumes and involved numerous complex financial transactions, Weil Gotshal successfully appealed the case, arguing that the government’s allegations had little real substance and that the case was tried in a manner that was fundamentally unfair to the defendants. As explained by Weil Gotshal partner Steven Reiss in January 12, 2007 New York Times article, “A Setback for Prosecutors in the ‘Enron of Kansas’ Case,” “[a]lmost everything in the case was irrelevancy and smoke.” And the Tenth Circuit agreed - reversing Mr. Wittig’s conviction on all 40 counts and barring Mr. Wittig's retrial on the 25 most serious counts—those alleging wire fraud and money laundering.

Paul, Weiss Helps Residents of Brownsville Housing Complex Find New Owner
Paul, Weiss and the Legal Aid Society helped the tenant's association of a dilapidated housing complex in Brownsville, Brooklyn, to find a new owner, former New York Met Mo Vaughn. The 385-unit Noble Drew Ali Plaza complex had suffered under its former landlord, Abdur Rahman Farrakhan, who culminated years of mismanagement with an attempted eviction of 125 families. After a protracted legal battle, Farrakhan put the housing complex into bankruptcy and the tenant's association immediately moved to remove Farrkahan, insert a new management compant and, ultimately, after many months of hard fought negotiations, find a new owner. Yesterday, the bankruptcy court approved a $21-million deal for the sale of the complex to Vaughn and his business partner Eugene Schneur; the pair are expected to spend an additional $20 million to renovate and upgrade the complex. The Paul, Weiss bankruptcy team included partner Brian Hermann, associate Penny Dearborn and former associate Lori Kata. Also instrumental in achieving this result were Paul Weiss litigation partner Moses Silverman and associate Amir Weinberg, whose state court lawsuit prompted the bankruptcy filing and made it possible for us to achieve this great result for the tenants at Noble Drew.
