Brinks Hofer Gilson & Lione Announces New Board of Directors and Practice Group Chairs for 2007
Brinks Hofer Gilson & Lione, one of the largest intellectual property law firms in the United States, is pleased to announce its newly-named Board of Directors. The 2007 Board members are:

Glen P. Belvis focuses his practice on all facets of intellectual property law, including patents, trademarks, copyrights, trade secrets and related antitrust matters. He has substantial patent litigation experience, including bench and jury trials, appeals before the Federal Circuit, and alternate dispute resolutions, and has participated in several multinational litigations involving related patent lawsuits in the U.K., Europe, Asia, Canada and the United States. He has testified as an expert witness on patent and trade secret matters, has lectured on patent and antitrust matters at Oxford University, and has experience in patent prosecution, interferences, and proceedings before the PTO board of appeals. Mr. Belvis' experience encompasses a wide range of technologies, including medical devices, bio-tech, software, Internet, lasers, paper, polymers, heavy equipment and pharmaceuticals. He received his J.D. from DePaul University College of Law and his B.S. in Chemistry from University of Notre Dame.

David S. Fleming, chair of the Internet/E-commerce Group, concentrates his practice in trademark law, focusing on litigation in federal courts and before the Trademark Trial and Appeal Board, counseling, and prosecution in the Patent and Trademark Office. Mr. Fleming has represented a wide variety of trademark clients in services and manufacturing industries. These clients have included worldwide companies engaged in the following activities: Internet search engine services; franchising in areas such as real estate brokerage and hotel services; car rental services; mortgage lending services; asset-based and other business lending services; title insurance and related services; a joint venture of credit card associations providing international standards for security in electronic payment transactions; retailing services; cellular and other communications equipment manufacturing and marketing; truck manufacturing; automobile parts manufacturing; tobacco products; and motion picture services. He received his J.D. from the University of Illinois College of Law and his B.A. from Northwestern University.

Cynthia A. Homan has practiced law at Brinks for 25 years, where she also worked while attending law school. She focuses her practice on brief writing at all levels of the federal court system, with a special emphasis on patent appeals. She founded the firm’s Appellate Group and served as chair for eight years. Ms. Homan also has copyright counseling experience as well as litigation experience in patent, trademark and copyright law. She is a member of the national board of directors of Lambda Legal and served as the organization’s co-chair from 2004 to 2005. She received her J.D. from DePaul University College of Law, her M.L.S. from the University of Pittsburgh and her B.A. in Russian Language and Area Studies from the University of Illinois.

Robert S. Mallin has extensive litigation experience in a variety of patent and trademark cases, including first chair jury trial and arbitration preparation and participation, taking and defending depositions, preparing and arguing motions, and conducting discovery matters; patent prosecution and counseling, including the use of reexamination to invalidate a patent during litigation; reviewing and evaluating patents for patentability, infringement, and validity opinions; and licensing. He is knowledgeable in such technical areas as metallurgical processing, electromechanical inventions, mechanical inventions, chemical processing, optical fiber connectors and thermoplastic adhesives, and the automotive industry and biotechnology. He received his J.D. from Loyola University Chicago School of Law and his B.S. in Chemical Engineering from the University of Illinois.

Steven P. Oberholtzer, managing partner of Brinks’ Ann Arbor office, focuses on patent and trademark counseling, corporate intellectual property policy development, technology licensing, joint development and joint venture relationship agreements, United States Patent and Trademark Office administrative proceedings, including interferences, re-examinations, re-issues, trademark oppositions, patent application preparation and prosecution, providing opinions regarding infringement risks, design-around projects and patentability and administration of corporate intellectual property portfolios. He has extensive experience in the mechanical and electro-mechanical disciplines with particular emphasis on automotive industry issues and has additional significant experience in technology areas, including medical devices, lasers, fiber optics, optical devices and heavy industrial equipment. Mr. Oberholtzer received his J.D. from the Detroit College of Law at Michigan State University and his B.S. in Mechanical Engineering from Kettering University, formerly known as the General Motors Institute.

Gary M. Ropski, President of Brinks Hofer Gilson & Lione, has practiced intellectual property law exclusively since joining the firm in 1976. His practice now focuses on litigation, but has included patent prosecution and litigation; trademark prosecution, including oppositions and litigation; trade dress litigation; copyright registration and litigation; trade secret litigation; right of publicity counseling and litigation; and related unfair competition and antitrust matters in federal and state courts. Mr. Ropski has received numerous awards, including being named as a Leading Illinois Intellectual Property Lawyer byChambers USA for four consecutive years; a Leading Intellectual Property Lawyer by theLeading Lawyers Network for three consecutive years; and a Top 10 Leading Lawyer for Business by the Leading Lawyers Network. Mr. Ropski has also been recognized as an Illinois Super Lawyer in Intellectual Property Litigationand was named one of the Top 10 Attorneys in Illinois in 2006. He received his J.D., cum laude, from Northwestern University School of Law and his B.S. in Physics from Carnegie-Mellon University.

Jason C. White's practice has focused primarily on patent litigation matters. However, he also has significant experience representing both licensors and licensees in complex licensing negotiations. In addition, he has experience in drafting and prosecuting U.S. and foreign patent applications in computer, electronics and telecommunications arts, preparing invalidity and non-infringement opinions, conducting due diligence analyses in conjunction with mergers, acquisitions and divestitures and counseling clients regarding obtaining and enforcing intellectual property rights.

Fleming, Mallin and Ropski will serve on the Executive Committee along with Chief Operating Officer, Bruce Weisseg.

Jack Lange Quoted in the New York Times and International Herald Tribune on Competition Between Hong Kong and Shanghai
Partner Jack Lange was quoted in today's New York Times in an article titled "Hong Kong and Shanghai Duel for Financial Capital." The article discusses the increasing public competition between the two cities to become China's leading financial center and outlines the political and economic arguments made in support of both cities, as well as the prospects of other potential financial centers in mainland China. Jack said, “Shanghai is in temporary eclipse because of...political factors. But Shanghai is where it’s happening -- if there’s going to be a domestic financial center that gives Hong Kong a run for its money, it’s going to be Shanghai.” Jack was also quoted in a similar article titled "Hong Kong and Shanghai Vie to be China’s Financial Center" in Monday's International Herald Tribune.

Darby & Darby’s Victory for Burlington Coat Factory in Trademark Case Brought by Louis Vuitton is Affirmed
Darby & Darby won a decision yesterday from the U.S. Court of Appeals for the Second Circuit affirming the May 2006 ruling for client Burlington Coat Factory in a trademark infringement case brought by Louis Vuitton. Last spring, Judge Richard M. Berman of the U.S. District Court for the Southern District of New York denied, for the second time, Vuitton’s motion for a preliminary injunction that would have barred Burlington Coat Factory from selling a line of ladies’ handbags. The decision again vindicates Burlington’s position that its handbags are not confusingly similar to Vuitton’s.

The case began in April 2004, when Vuitton sought a preliminary injunction to prevent Burlington Coat Factory from selling a line of beaded handbags that Vuitton alleged infringed its trademarks. Darby & Darby successfully defeated the motion for a preliminary injunction, prompting Vuitton to appeal to the U.S. Court of Appeals for the Second Circuit. In October 2005, the Second Circuit vacated the district court’s decision and remanded the case to Judge Berman.

On remand, Judge Berman denied Vuitton’s motion for a preliminary injunction and rejected all of Vuitton’s trademark, trade dress infringement and dilution claims for the second time. Persuaded by Darby’s arguments, Judge Berman found that “‘ordinarily prudent consumers’ would not confuse Louis Vuitton’s bags with [Burlington’s] handbags.”

In response to the decision, Robert Weisbein, Darby principal and lead counsel for Burlington Coat Factory, said, “Our client is again very pleased with this result. The affirmation from the Second Circuit that Judge Berman recognized that consumer confusion -- the linchpin of a trademark infringement case -- was still completely absent from Vuitton’s case.

Cox Smith Matthews Names 6 New Shareholders
Cox Smith Matthews announced today that six attorneys have been named shareholders of the firm. The new shareholders are: Raymond A. Cowley, David G. Henry, William M. Fisher, Jeffrey C. Gifford, Darrell R. Jones, and Megan P. Lindberg.

The firm’s new shareholders include:

Raymond A. Cowley, based in the McAllen office, is a member of the firm’s Labor and Employment Practice Group. Formerly Of Counsel, Ray primarily assists clients in labor and employment matters, employee relations, and general litigation, and has successfully represented many high profile clients. He received his J.D. with highest honors from Chicago-Kent College of Law.

David G. Henry, based in the Austin office, is a member of the firm’s Intellectual Property Department. Formerly Of Counsel, he assists clients in the protection and enforcement of all types of intellectual property, and is a registered patent attorney in both the United States and Canada. His practice includes prosecuting domestic and international patent and trademark applications. He received his J.D. from Baylor University Law School.

William M. “Bill” Fisher is a member of the firm’s and Tax Department. Bill assists clients with a variety of tax issues, especially in the area of employee benefits and tax-exempt organizations. He received his J.D. from the University of Texas School of Law.

Jeffrey C. Gifford is a member of the firm’s Corporate and Securities Practice Group. His expertise ranges from public and private securities transactions and mergers and acquisitions to facilitating domestic and international commercial transactions. He received his J.D. from the University of Michigan Law School.

Darrell R. Jones is a member of the firm’s Energy and Natural Resources Department. His practice covers most aspects of the oil and gas industry, including up-, mid- and downstream asset transactions, exploration and development project agreements, MSA’s, title examination and energy finance. He received his J.D. from the University of Houston School of Law.

Megan P. Lindberg is a member of the firm’s Labor and Employment Practice Group. She advises clients with labor and employment matters ranging from defending litigation to creating uniform and consistent policies to be implemented in the workplace. She received her J.D. from Baylor University Law School.

Cooley Litigation Partner Steven M. Cohen Named New York Attorney General Andrew Cuomo’s Chief of Staff
Cooley Godward Kronish LLP announced today that New York litigation partner Steven M. Cohen has been named Counselor and Chief of Staff for Andrew Cuomo, the newly elected Attorney General of the State of New York.

At Cooley, Mr. Cohen’s practice focused on white-collar criminal defense, internal investigations and the trial of criminal and civil matters. Mr. Cohen represented numerous individuals and corporations in connection with investigations and prosecutions conducted by the Department of Justice, the Securities and Exchange Commission, the New York State Attorney General, the National Association of Securities Dealers, the New York Stock Exchange and the Manhattan District Attorney’s Office.

“Steve is a outstanding lawyer, and he is highly qualified to assume this important new position,” said Alan Levine, partner in charge of the New York office. “We will miss him, and we wish him well in his new role.”

“I have had an opportunity to work on some of the most interesting cases in the country with some of the smartest lawyers in the world,” said Mr. Cohen, who joined the firm in 1998.

Over the past six years, Mr. Cohen has spearheaded efforts to reverse the wrongful murder convictions of two men serving 25 years to life for the murder of a bouncer at the Palladium nightclub in New York City. As a result of these efforts, the Manhattan District Attorney’s Office consented to the release of one of the men, while the litigation over the other man’s fate continues.

A former Assistant U.S. Attorney for the Southern District of New York, Mr. Cohen served as Chief of the Violent Gangs Unit and received the 1997 Attorney General’s Award for Distinguished Service and the 1995 Award for Superior Performance.
