Jenner & Block Is First Law Firm Accredited with CEO Cancer Gold Standard
The CEO Roundtable on Cancer, Inc. announced this week that Jenner & Block has been accredited with the CEO Cancer Gold Standard(TM), a workplace initiative that combats cancer through employee programs encouraging risk reduction, early detection and quality care. Jenner & Block is the first law firm to receive the recognition, which was initiated by CEO Roundtable in 2001.

Jenner & Block was honored with the Gold Standard for offering a number of progressive benefits and programs that lower the risk of cancer through lifestyle changes. Some of these benefits include coverage for preventative screenings to detect cancers at the earliest possible stage, providing access to the best-available treatments and clinical trials for affected employees and/or family members, and on-site courses and resources for tobacco cessation, diet and nutrition, and physical activity.

"One of our core values is respecting our people, and promoting a healthy lifestyle for our workforce is a natural outgrowth of that commitment," said Jenner & Block Managing Partner Gregory S. Gallopoulos.

The CEO Roundtable on Cancer consists of CEOs from diverse industries who have pledged to fight cancer in workplaces across the United States. The group was formed after President George H. W. Bush challenged a group of leading executives to do something "bold" to combat cancer in corporate America. The group has since collaborated with the American Cancer Society to encourage its widespread adoption in workplaces across the country.

"We know that at least half of all cancer deaths can be prevented," said John R. Seffrin, Ph.D., chief executive officer of the American Cancer Society, in a statement. "By creating a healthier workplace and becoming an accredited organization, everyone benefits."

Other companies accredited for their special anti-cancer employee programs include; American Legacy Foundation, AstraZeneca, Enzon Pharmaceuticals, GlaxoSmithKline, Johnson & Johnson, MD Anderson Cancer Center, Novartis, OSI Pharmaceuticals, SAS Institute and Quintiles Transnational Corp.

Jenner & Block Partner Argues AIDS Policy Case Before DC Circuit
Jenner & Block Partner Julie M. Carpenter argued before a federal appeals court yesterday that the non-profit DKT International has a First Amendment right to not subscribe to a government-enforced pledge against prostitution in exchange for federal funds. According to Ms. Carpenter, enforcing the pledge policy “would turn the First Amendment on its head.”

The appeal by the U.S. government comes on the heels of the Firm’s victory for DKT International before a federal court in May, in which a judge had ruled that the government’s pledge policy, outlined in the Global AIDS Act of 2003, was an unconstitutional violation of free speech.

“The statute here is an unprecedented attempt by the government to commandeer the privately-funded speech of any organization accepting government money,” the brief stated.

According to the Firm’s brief, the policy would also allow the government to “favor economically those who agree with it, and to silence those who disagree, on virtually any number of issues.”

In addition to Ms. Carpenter, the Jenner & Block team on this matter includes Associates Martina E. Vandenberg and Amy L. Tenney.

DKT is a U.S.-based nonprofit corporation that provides family-planning and HIV/AIDS services and programming in eleven countries worldwide. One of the largest providers of these services, DKT currently serves nearly 10 million couples.

The case before the U.S. Court of Appeals for the DC Circuit is DKT International, Inc. v. USAID, et al.

WilmerHale Secures Major Antitrust Victory for Client Regal Entertainment Group in New York
WilmerHale achieved an important victory last week for client Regal Entertainment Group when United States District Judge Paul Crotty in the Southern District of New York granted summary judgment on a claim brought by a competitor regarding the exhibition of movies in Manhattan.

The plaintiffs were owners and operators of the Village East movie theater, which is located near a Regal theater, the Union Square 14. They claimed that Regal illegally conspired with almost all of the major film distributors and another theater owner to deny major films to the Village East and to prohibit the Village East from simultaneously showing films that were playing at the Union Square 14. The dozen other defendants settled. The court granted Regal's motion for summary judgment in all respects, finding that there was no evidence of any illegal conspiracy under Section 1 of the Sherman Act or New York's Donnelly Act.
