Three Associates Join Nelson Mullins in Raleigh
Three new associates have joined Nelson Mullins Riley & Scarborough in its Raleigh office:

Elizabeth B. Frock represents health care providers in litigation, transactions and regulatory proceedings. She earned her Juris Doctor, cum laude, in 2007 from the University of Florida Levin College of Law, where she received honors in both Legal Research Writing and Appellate Advocacy. She was a member of the Justice Campbell Thornal Moot Court Team, where she served on the Executive Board. At the 2007 George Mason University Law and Economics Moot Court Competition, she was a semi-finalist and won the award for best brief. She also studied abroad in Paris and Montpellier, France. A former Nelson Mullins summer associate, prior to law school she worked as a legal assistant for a law firm in Washington, D.C., where she gained experience in products liability. She earned an A.B. degree in Politics and Economics in 2002 from Princeton University. While at Princeton, she was a member of the Varsity Swim Team.

Kelli Goss Hopkins, AIA, a North Carolina licensed architect, practices in the areas of construction law and government contracts. Ms. Hopkins is admitted to practice in all North Carolina State courts. Before law school, she was a partner in a prominent architectural firm in Raleigh, N.C., where she served as director of Commercial & Corporate Architecture. Ms. Hopkins designed, managed, and supervised construction administration on notable multimillion-dollar projects including 510 Glenwood Avenue Mixed Use project, Baity Hill Married Student Housing for UNC Chapel Hill, and the Capital Park Community Center. Ms. Hopkins has been involved in all phases of commercial, governmental, and institutional projects. Her experience includes schematic design, design development, construction documents, building code compliance, and building permit reviews at the city level and with State Construction. She has appeared before town councils, appearance commissions, and boards of trustees. She earned a Juris Doctor in 2007 from the University of North Carolina School of Law and a Master of Architecture degree from North Carolina State University School of Design. She received a Bachelor of Arts degree in Visual Design from Dartmouth College in Hanover, N.H.

Farah Lisa Whitley-Sebti practices in the area of business litigation, with a focus on defending cases for financial services industry clients, including claims arising under the Truth in Lending Act, the Real Estate Settlement Procedures Act, the Fair Credit Reporting Act, the Fair Debt Collection Practices Act, the Equal Credit Opportunity Act, state unfair or deceptive trade practices acts, predatory lending and usury statutes, and state common law claim theories. Before attending law school, Ms. Whitley-Sebti worked in New York City for a major national magazine in marketing, public relations, and promotions. She earned her Juris Doctor in 2007 from the University of North Carolina School of Law and also studied at La Sorbonne University in Paris. She earned a Bachelor of Arts degree in Political Science in 1999 from East Carolina University and also attended Duke University. She is conversational in French.

Lewis and Roca Attorneys Bass and Ivie Named to Lawyer Advertising Advisory Committee of State Bar of Nevada
Lewis and Roca LLP is pleased to announce that Joice Bass and Daniel S. Ivie have been appointed to the Standing Lawyer Advertising Advisory Committee for the Southern District. The State Bar of Nevada appointment is for a two- year term.

Bass is an associate in the firm’s Commercial Litigation practice group. Her practice focuses on all complex civil and business litigation matters. She also has experience handling employment litigation, corporate and healthcare transactions, eminent domain and intellectual property law. Bass has made extensive appearances in both federal and state courts in Nevada and California, and has trial experience in both states. She received her J.D. from the University of California, Davis School of Law in 2000, her M.B.A. from California State University, Fresno in 1994 and her B.S. in Business Administration and Information Systems from California State University, Fresno, in 1991.

Ivie is an associate in the firm’s Commercial Litigation and Insurance practice groups. His practice ranges from representing national corporations in personal injury lawsuits to assisting in multi-jurisdictional and complex civil litigation. He also has assisted in matters involving coverage issues and bad faith claims. Ivie received his J.D. from the S.J. Quinney College of Law, University of Utah, in 2006 and his B.A. from Brigham Young University in 2003.

Jones Day Obtains Eighth Circuit Victory in Retiree Health Benefits Case
Jones Day won a significant victory in the United States Court of Appeals for the Eighth Circuit in a case involving modifications to retiree health benefits and the arbitrability of disputes over such modifications.

When Jones Day's client, Crown Cork and Seal Company, changed the health plans provided to certain of its retirees, it also sued for a declaratory judgment that the changes were lawful under the Employee Retirement Income Security Act (ERISA) and the Labor Management Relations Act (LMRA). On behalf of the retirees, the International Association of Machinists and Aerospace Workers counterclaimed for arbitration of the dispute pursuant to the arbitration clauses in the expired collective bargaining agreements that created the retiree health benefits. The district court ordered arbitration and dismissed Crown's declaratory judgment claims, but the Eighth Circuit reversed.

Interpreting a line of Supreme Court precedents, the court of appeals explained that, because the union's grievance arose after the expiration of the relevant collective bargaining agreements, it was arbitrable only if the benefits at issue were actually vested under the past agreements. The Eighth Circuit agreed with Crown that the inquiry into arbitrability required the court to determine whether the benefits were vested even though doing so reached the merits of the dispute, which an arbitrator might otherwise decide. Reviewing the myriad provisions of the collective bargaining agreements in question, the court concluded that the benefits were not vested, and that the dispute was therefore not arbitrable.

Having already held as a matter of law that the benefits were not vested, the Eighth Circuit further explained that it would be futile to remand the case for a decision by the district court on the merits of Crown's declaratory judgment claims because the lower court would be foreclosed by law of the case from declaring that Crown's actions violated either ERISA or LMRA.

The Eighth Circuit issued its decision in Crown Cork & Seal Co. v. International Association of Machinists and Aerospace Workers, No. 06-3639, on September 18, 2007. James Rydzel of Jones Day's Cleveland Office and Shay Dvoretzky of the Washington Office (who argued the case before the Eighth Circuit) led the appeal team, which also included Andrew Kramer and Sarah McClure (Washington), and Kate Bushman and Robert Smith (New York).

Jones Day Obtains Third Circuit Victory in Age Discrimination Case
The United States Court of Appeals for the Third Circuit reversed the district court's denial of summary judgment and remanded for entry of judgment in favor of Jones Day's client CBS Corporation (formerly Viacom, Inc.) – in a case brought under the Age Discrimination in Employment Act (ADEA) by a former employee seeking damages for alleged age discrimination.

The plaintiff—who had been employed in the tax department of the former Westinghouse Electric Corporation (which became CBS Corporation) until that department was eliminated—was separated from his job and signed a waiver of claims under the ADEA, even though he later admitted that he believed he had been discriminated against due to his age. Despite signing the waiver, the plaintiff later opted into a collective action ADEA lawsuit filed by two other former Westinghouse employees. The District Court decertified that collective action because the plaintiffs were not similarly situated to one another, and six months later, the plaintiff filed an individual charge of discrimination with the EEOC. This individual charge was over 2000 days late, but the plaintiff argued that under a doctrine known as the "single filing rule," he could "piggyback" his untimely charge onto the charges filed by the parties in the decertified collective action. The plaintiff also argued that the time for filing an EEOC charge was tolled because his waiver was defective.

The District Court ruled that, in light of plaintiff's arguments, genuine issues of material fact existed; the court thus denied CBS Corp.'s motion for summary judgment. Jones Day filed an interlocutory appeal with the Third Circuit. The Third Circuit accepted the appeal, and unanimously reversed the district court's judgment. The Third Circuit definitively held that "the single filing rule is not available to former members of a collective action that is decertified because the plaintiffs are not 'similarly situated.'" Further, it held that because the plaintiff was not diligent in pursing his age discrimination claim, which he had admitted he had reason to know about when he signed his waiver, he could not benefit from equitable tolling. The Third Circuit remanded the case to the District Court with instructions to enter judgment in favor of CBS.

The Third Circuit issued its decision in Ruehl v. Viacom, Inc. (No. 06-1463) on September 7, 2007. The Jones Day lawyers who worked on the case were Glen D. Nager (who argued the case in the Third Circuit), Lawrence D. Rosenberg, and Thomas J. Davis (Washington), and Amy E. Dias (Pittsburgh).

Jones Day Successfully Represents Ohio Inmate Charged with Unauthorized Practice of Law
Shawn Organ and Kerstin Sjoberg-Witt successfully represented an Ohio inmate who was charged with the unauthorized practice of law by, according to Ohio's Disciplinary Counsel, serving as a "jail house lawyer." Mr. Cotton came to the attention of Ohio's Disciplinary Counsel because he would place his name on the pleading as "Pro Se Assistant."

The Ohio Supreme Court appointed Mr. Organ and Ms. Sjoberg-Witt to represent Mr. Cotton after the Court remanded the matter to the Board for the Unauthorized Practice of Law for consideration of the facts of the case in light of the U.S. Supreme Court decision in Johnson v. Avery, wherein "jail house lawyers" cannot be prohibited by the State for assisting other inmates unless and until the State can show that it provides the inmates "meaningful access" to the courts. The case is unique and interesting as the State is claiming that meaningful access is being provided via inmate law clerks; however, discovery taken by Jones Day attorneys reflects that these inmate law clerks perform the same task for which Mr. Cotton was being prosecuted. Mr. Organ argued the case before the Ohio Supreme Court on February 27, and on September 5, 2007, the Ohio Supreme Court handed the appellate team a victory, holding that the charges against Mr. Cotton shall be dismissed.
