Jeh Johnson Nominated to Be Next Chief Judge of New York State
As reported by today's New York Law Journal, litigation partner Jeh Johnson and six other candidates were nominated by the New York State Commission on Judicial Nomination to be the next chief judge of New York state. The nominees include incumbent Chief Judge Judith S. Kaye; Appellate Division Justice Richard T. Andrias; Appellate Division Justice Thomas E. Mercure; George F. Carpinello, a partner at Boies, Schiller & Flexner in Albany; David A. Schulz, a partner at Levine Sullivan Koch & Schulz in Manhattan; and Steven C. Krane, a partner at Proskauer Rose. Of the 12 members of the commission, four are appointed by the Governor Eliot Spitzer, four are appointed by the speaker and one each is appointed by the speaker and minority leader of the New York State Assembly, and one each is appointed by temporary president and the minority leader of the New York State Senate.

Fulbright’s Merrill Kraines Receives Two Board Appointments
Fulbright partner Merrill M. Kraines of the New York office has been named to the Board of Trustees of the NYU Hospital for Joint Diseases, considered one of the leading orthopedic hospitals in the country. The Hospital for Joint Diseases, which celebrated its 100th anniversary last year, merged with NYU Medical Center on January 1, 2006. The NYU Hospital for Joint Diseases is one of only five orthopedic/rheumatology hospitals in the world and the only one with a program in neurology. Each year, the NYU Hospital for Joint Diseases treats more than 5,000 inpatients and 96,000 outpatients and performs 12,000 surgeries.

Kraines was also named to the Executive Committee of the Board of Directors and is a member of the National Governing Council of the American Jewish Congress. Formed in 1933, the American Jewish Congress is a not-for-profit entity with 50,000 members in all 50 states.

Among the tenets of the Congress’ multi-faceted mission are: the protection of fundamental constitutional freedoms and American democratic institutions, the security of the State of Israel and its search for peaceful relations with its neighbors, vigilance against all forms of bigotry and the vitality of Jewish cultural life.

Fulbright First Firm to Receive Longevity of Exemplary Service Award
Fulbright & Jaworski's exemplary service to the community resulted in the Houston Bar Foundation’s awarding its Longevity of Exemplary Service Award today to the international law firm.

The award that typically goes to an individual went this year to Fulbright for the firm’s continued commitment to the Houston Volunteer Lawyers Program. Fulbright is the first law firm to receive the award. The Houston Volunteer Lawyers Program sets out to help those with low incomes who may not qualify for other legal aid or assistance.

"This marks the sixth year in a row Fulbright has received an award from the Houston Bar Foundation for contributions to the Houston Volunteer Lawyers Program," said Tracie Renfroe, chair of the Houston Bar Foundation. "While we typically give this award to an individual, Fulbright has devoted itself to this cause through endless hours of pro bono work and a dedication to doing all it can to help the community."

Fulbright attorneys completed an average of more than 60 hours each of pro bono work in 2005 and 2006. When attorneys at the firm give back to the communities in which they work, Fulbright becomes an even better law firm, said Steven B. Pfeiffer, chair of Fulbright’s Executive Committee.

"Since its founding in 1919, Fulbright has been committed to improving the communities in which we practice law, as well as the lives of our fellow citizens who are not as fortunate as we," Pfeiffer said. "We have always been leaders in the area of pro bono work -- leaders in the level of contributions we make, and leaders in creating programs to provide legal services for those who cannot afford such representation. Fulbright is committed to continuing this leadership."

Among the notable pro bono cases Fulbright has handled through its relationship with the Houston Volunteer Lawyers Program is the recent successful defense of a Nigerian woman's possession of her U.S.-born daughter. The girl's father filed a Hague Convention petition requesting the girl be returned to him in Belgium. Such Hague Convention petitions set out to secure international cooperation when it comes to returning a child wrongfully taken by a parent from one country to another.

The mother, who claimed her ex-husband was abusive, had immigrated legally to the U.S. with her daughter in 2002. With Fulbright's help, the mother successfully fought the claims in the Hague Convention petition. A federal judge cleared the way for the 6-year-old to remain enrolled in school and with her mother in the United States.

"The ability to help clients who may not otherwise be able to afford legal advice that so greatly impacts their lives underscores the importance of our pro bono work," said Stewart Gagnon, who oversees Fulbright's pro bono efforts. "Our attorneys pour themselves into each and every pro bono case our firm handles and we are always touched and come away as better attorneys as a result of those we assist."

In addition to its assistance with individual cases, Fulbright contributes to the community through attorney loan programs the firm has established in a majority of its domestic offices. Through the loan programs -- in cities, such as New York, Washington, D.C., Los Angeles, Dallas, San Antonio, Minneapolis, Houstonand Austin -- Fulbright's young lawyers attain courtroom experience prosecuting and defending cases. The cities and other governmental entities involved in the program acquire free assistance as they work to quell their swelling caseloads.

"A commitment to pro bono work is one of our core values," said Stephen C. Dillard, chair of Fulbright’s worldwide litigation department. "Our pro bono commitment reveals a great deal about our firm's culture and our commitment to improving the lives of our fellow citizens in the communities where we practice law."

Covington Secures Relief for Clients in Two Death Penalty Cases
In two death penalty cases pending in trial courts in Alabama and Mississippi, Covington clients obtained significant relief, in one case securing a ruling overturning a murder conviction and death sentence and in another case securing a new capital sentencing trial. The cases both involved evidentiary hearings and were venued, respectively, in the Circuit Court of Marshall County, Alabama, and the Circuit Court for Jefferson Davis County, Mississippi. The decisions were handed down on December 29, 2006 and January 12, 2007.

The Alabama case concerned Larry Smith, who was convicted and sentenced to death for a 1994 robbery and murder. In 2001, Covington filed habeas papers challenging his conviction, alleging ineffective assistance by his trial counsel. After a three-day hearing, the court ruled that "but for the ineffective assistance of Mr. Smith's [trial] counsel, the outcome of Mr. Smith's trial might well have been different." Accordingly, the court ordered that Smith be granted a new trial.

The Mississippi case involves Cory Maye, who was convicted and sentenced to death for the 2001 shooting of a police officer that occurred during a narcotics task force search of Maye's home the night after Christmas. Mr. Maye, who had no prior arrests or convictions, testified at his trial that he did not realize it was the police who were breaking into his home, and that he fired in self defense at what he thought was an intruder. The firm began representing Maye in February 2006 in connection with post-trial motions. After evidentiary hearings before the judge who presided over Mr. Maye's trial, the court vacated the jury's sentence of death, based on a finding that the original trial counsel had provided ineffective assistance during the sentencing phase of the trial. The firm continues to represent Maye in preparation for a potential new sentencing hearing, and in appealing the conviction.

The Covington team on the Alabama case includes Keith Teel, John Fuson, Jeremiah Williams, and Burth Lopez, along with former Covington associate James Hanlon and Alabama co-counsel Brian White. The Mississippi team includes Covington lawyers Michael Labson, Benjamin Vernia, Abram Pafford, Jessica Gabel, and James Sullivan, along with Mississippi co-counsel Bob Evans.

Baker & McKenzie LLP Lawyers Named in The Lawyer's Hot 100
Three lawyers from Baker & McKenzie, London have been named in the prestigious The Lawyer's Hot 100 list.

Corporate Partner Helen Bradley, Competition Partner Samantha Mobley, and Corporate Senior Associate Robert Adam, were all included in the list, confirming the Firm's legal expertise at all levels.

The annual list is compiled by the UK's The Lawyer magazine and is described as a list of 'those individuals who are making things happen in the legal world'.

Baker & McKenzie's Hot 100 lawyers are:

Helen Bradley, Partner, named in the Corporate and Commercial category. The Hot 100 report said that she had 'single-handedly propelled her firm into the corporate limelight last year'.

Samantha Mobley, Partner, named in the Competition category. She was described as an 'adept juggler' for her work in heading the Firm's European Commission and competition practice, as well as running the Firm's diversity committee.

Robert Adam, Senior Associate, named in the assistants section. Robert is described as having worked on 'some of the most contentious matters' coming before the Takeover Panel during his secondment there, and having 'had a role on the choicest M&A file of late 2006.

Bradford L. (Brad) Love is a Public Finance attorney whose practice concentrates primarily on governmental matters for cities, counties and special purpose districts. He has years of experience working on various types of general obligation and revenue bond transactions for governmental entities, as well as colleges, hospitals, and other nonprofit organizations.

Following his graduation from the University of Georgia School of Law, cum laude, Love joined the Firm’s Greenville office in 1999. J.W. (Jay) Matthews III joined the Firm’s Greenville office in 2000, offering legal services to clients in a multitude of technology and business sectors. In addition to his extensive constructive law practice, Matthews has a wealth of experience in complex business, commercial, and technology-related disputes, where he represents clients in litigations involving business torts, products liability, intellectual property, and fiduciary law. Matthews has a particular depth of experience litigating cases involving the manufacturing and telecommunications industries.

This South Carolina native graduated with high honors from the University of Florida's Fredric G. Levin College of Law in 2000 where he received the Gersten Key Award for Outstanding Graduate. A graduate of the Georgia Institute of Technology in mechanical engineering in 1991, Matthews served in the Air Force as an engineer, managing deployments and construction projects in the Persian Gulf and Bosnia.

Matthews is a member of Leadership South Carolina’s Class of 2007, and is a member of The Defense Research Institute, Inc., and the Greenville County, South Carolina and American Bar Associations.
