Foley Encourages Diversity in Legal Community Through Ongoing Scholarship Program
Foley & Lardner LLP continues to demonstrate its commitment to diversity in the legal community through this year's Minority Scholarship Program. The program, now in its eighth year, has awarded nearly $400,000 in scholarships to first-year minority law students in an effort to create a more diverse legal community.

This year, nine ethnically diverse first-year law students received a $5,000 scholarship toward their legal education. Law schools participating in the program include Duke University, the University of Florida, Georgetown University, the University of Michigan, Northwestern University, the University of Wisconsin, UCLA and the University of California, Berkeley.

Each scholarship recipient is selected by Foley's Minority Scholarship Program Committee. The Committee considers significant involvement in community activities; significant involvement in minority student organizations; outstanding work or personal achievements; and academic achievement.

Foley is committed to recruiting a diverse pool of law students for its summer associate program and as new associates, and the Minority Scholarship Program is a valuable tool in this effort. Through this Program, Foley is introduced to exceptionally talented diverse law students who share the firm's core values and culture. Scholarship applicants are referred to Foley's Recruiting Committee for consideration, and the firm has been successful in hiring many applicants both as summer associates and as new associates. Additionally, the Program gives Foley the opportunity to acquaint influential diverse law students with the firm and its diversity commitment, expanding the firm's visibility and good will within important law school constituencies

Foley & Lardner Partner Named to BTI Client Service All-Star Team
Foley & Lardner LLP announced today that Jay O. Rothman, a partner in the Business Law Department in the firm's Milwaukee office, has been named to the 2007 BTI Client Service All-Star Team for Law Firms. In addition, Rothman was one of five attorneys recognized as a 2007 “Super All-Star” for being nominated by more than one client.

“Jay has always focused on developing strong client relationships. He truly deserves this recognition of his efforts to ensure that our clients receive the best service possible,” said Joseph B. Tyson Jr., chair of the firm's Business Law Department. “Jay's performance exemplifies the firm's commitment to the best interests of our clients.”

The BTI Client Service All-Star Team honors individual attorneys whom corporate counsel identify as providing outstanding client service to Fortune 1000 clients. Attorneys are nominated for being highly responsive to the client's individual goals; providing strategic legal advice in the context of client-specific issues; going above and beyond the call of duty to deliver results; and having an exceptional understanding of the client's business.

To compile the list, the BTI Consulting Group surveyed more than 250 individual corporate counsel at large and Fortune 1000 companies on the quality of service they receive from their lawyers. The 2007 BTI Client Service All-Star Team for Law Firms lists the 113 individual attorneys from 93 law firms that corporate counsel believe provide the best service. Foley was also recently named to the BTI Client Service 30 list for the fifth consecutive year, and as a Market Trailblazer on the 2006 BTI Market Movers list, both of which recognize law firms for their exceptional client service.

Rothman is a partner in Foley's Milwaukee office, where he is a member of the firm's Management Committee as well as the chair of the firm's national Transactional & Securities Practice and a member of the Energy Industry Team. Rothman practices primarily in the areas of mergers and acquisitions, securities law, takeover defense, and general corporate and business law. He also regularly counsels publicly held companies regarding compliance matters under federal and state securities laws.

Eric Goodison Comments on Use of Equity Cure Rights in Private Equity Deals
Corporate partner Eric Goodison was quoted in the January 22 Credit Investment News article "Equity Cure Rights Take Hold for Sponsor Credits." The article discusses the increased use of equity cure rights, provisions that allow the sponsor in a private equity deal to boost EBITDA if the company is not going to meet its covenants. Eric said "I think the concern you have as a lender, to the extent you have a concern, is that this is a company not meeting its plan and not hitting covenants and it may be delaying the inevitable, which may not be favorable to a lender...It might be better to get to the table and have discussions...this just delays that dialogue.

Davis Wright Tremaine Celebrates 15 Years in San Francisco Firm Relocates to New Offices
15 years after opening the doors to its San Francisco office, national law firm Davis Wright Tremaine LLP is proud to celebrate with clients and friends at an anniversary party and open house this February.

“We are very proud of the presence and reputation we have established in San Francisco,” commented Martin L. Fineman, partner-in-charge of the San Francisco office. “The anniversary is a great opportunity to recognize our clients, employees and our 15 years of success here in San Francisco.”

When Davis Wright Tremaine first set up shop in the Bay Area, the office started with three health care attorneys. Today, the office is 37 attorneys strong and spans 10 practice groups: litigation, health law, energy, employment, business transactions/corporate finance, First Amendment & media law, telecommunications, technology law, creditors’ rights/bankruptcy and life sciences. The firm plans to continue its strong growth in this market. “We look forward to further expanding the San Francisco office and its key practice groups over the coming years,” said Richard Ellingsen, firmwide managing partner of Davis Wright Tremaine.

Davis Wright Tremaine’s new space is approximately 30,000 square feet and takes up two floors at 505 Montgomery.

Covington Advises Coty in Sale of Calgon and Healing Garden Brands
Covington & Burling LLP advised Coty Inc. in its $125 million sale of the Calgon® and healing garden® brands, the number one and two brands respectively in the specialty bath sector, to Ascendia Brands, Inc. The transaction is expected to close in the first quarter of 2007.

Coty Inc. is the world’s largest fragrance company with an annual net sales of $2.9 billion. Brands include Calvin Klein, Cerruti, Chloé, Jette Joop, Jil Sander, JOOP!, Kenneth Cole, Marc Jacobs, Nikos, Vera Wang and Vivienne Westwood.

The Covington corporate team included Scott Smith and Andrew Muratore, as well as George Chester and Stephen Rodger (antitrust).

Nixon Peabody Collaborates with CA (Computer Associates) Legal Team on Pro Bono Project and Wins Asylum for Kenyan Journalist; Law Firm and Corporate In-House Legal Department Join Together to Offer Their Pro Bono Services
John Bolton, a business litigator and partner in the Long Island office at Nixon Peabody, has collaborated with the legal team at CA in developing their respective pro bono programs, including pro bono asylum training, throughout the past year. Mr. Bolton, who received the referral of Nahason Orenge’s case from the New York City Bar Justice Center, states, “Nixon Peabody has a long legacy of providing pro bono service, and we are thrilled that our partnership with CA has produced a winning result for the client and for our community. This case is a win-win all around. Our client has not only won asylum to remain in the United States, but he will also likely be allowed to bring his wife to this country.” CA, whose worldwide headquarters office is located in Islandia, New York, began its pro bono program in December 2004, and has also demonstrated a strong commitment to giving back to its community.

Mr. Bolton and CA’s vice president and assistant general counsel, Bonnie L. Yeomans, together with two CA paralegals, Mary Ellen Dyckman and Theresa Jackson, began their collaborative representation of Mr. Orenge in the summer of 2006. Mr. Orenge is a national of the Republic of Kenya and a professional journalist. He sought asylum in the United States because he had been repeatedly persecuted throughout his homeland, and had been subjected to continued threats and harassments, including false arrests, because he wrote newspaper articles critical of the government and local police. Nixon Peabody and CA’s in-house lawyers submitted a series of affidavits that were signed by the client’s coworkers and family members attesting to the persecution he was subjected to, as well as an extensive memorandum of law that made the case for a grant of asylum. Just a few weeks ago, Mr. Orenge’s asylum application was granted, allowing him to stay in the United States indefinitely and making him eligible for permanent resident status.

Bonnie L. Yeomans said, “The partnership between CA’s Worldwide Legal Department and Nixon Peabody is an excellent example of how teamwork across in-house legal teams and law firms produces excellent results and service for pro bono clients, and our community at large.”

Nixon Peabody and CA are now helping Mr. Orenge apply to bring his wife to the United States. Mr. Orenge intends to continue pursuing his passion for journalism in this country.

7 Attorneys Named Among NC's "Legal Elite"
GREENSBORO, NC – Business North Carolina magazine has named seven attorneys from Nexsen Pruet Adams Kleemeier’s Greensboro office to its “Legal Elite” listing, an honor bestowed by the publication on less than 5 percent of the state’s lawyers.

The seven, who will be recognized in the publication’s January 2007 issue, include:

* M. Jay DeVaney, a Partner in Greensboro, for real estate law;
* R. Harper Heckman, a Partner in Greensboro, for construction law;
* Benjamin A. Kahn, a Partner in Greensboro, for bankruptcy law;
* D. Beth Langley, a Partner in Greensboro, for employment law;
* Christine L. Myatt, a Partner in Greensboro, for bankruptcy law;
* Peter G. Pappas, a Partner in Greensboro, for employment law;
* David A. Senter, a Partner in Greensboro, for construction law; and

In developing the list, the publication sent more than 17,000 ballots to every licensed lawyer living in the state, asking each to name the state’s best practitioners in a number of business -related fields. Fewer than 600 earned “elite” status.

Jay DeVaney is a Board Certified Specialist in Real Property Law - Business, Commercial, and Industrial Transactions by the North Carolina State Bar. He focuses his practice in the areas of commercial real estate, land-use litigation, and legal malpractice defense. DeVaney is a member of the American College of Real Estate Lawyers Board of Governors and a fellow of the American College of Mortgage Attorneys. He is also a former chair of the North Carolina Bar Association’s Real Property Section and a former member of the Board of Governors. He is listed in Best Lawyers in America for real estate law; was named a North Carolina “Super Lawyer” in a Law & Politics survey; and is a member of Outstanding Lawyers of America.

Harper Heckman practices in the areas of lien, bond, construction law, and civil litigation. He is a former chair of the North Carolina Bar’s Construction Law Section and is the current chair of the Contract Documents Steering Committee of the American Bar Association's Forum on the Construction Industry. Additionally, he has been included in the Triad Business Journal's "40 Leaders Under Forty" and was named a North Carolina “Super Lawyer” in a Law & Politics survey.

Ben Kahn is a Certified Specialist in Business and Consumer Bankruptcy Law by the Board of Legal Specialization of the North Carolina State Bar. He focuses his practice is the areas of bankruptcy law and commercial litigation. He has represented creditors' committees, individual secured and unsecured creditors, guarantors, lessors, debtors, trustees, and others in numerous bankruptcy cases under Chapters 7, 11, 12 and 13 of the U.S. Bankruptcy Code.

Beth Langley concentrates her practice in employment law matters, ERISA litigation and business litigation. She is a former chair of the Labor and Employment Law Section of the North Carolina Bar Association and she served for several years on the North Carolina Bar Association’s Labor and Employment Law Section Council. She is currently a member of the North Carolina Bar Association’s Business Law Curriculum Committee. She is a frequent speaker on employment law and litigation procedure and strategy.

Christy Myatt chairs the firm’s bankruptcy and creditor rights group. She is a Certified Specialist in Bankruptcy Law by the Board of Legal Specialization of the North Carolina Bar and in Business Bankruptcy Law by the American Bankruptcy Board of Certification. She is a former chair of the North Carolina Bar’s Bankruptcy Section; is a former chair of the Bar's Board of Legal Specialization; currently serves as a member of the ABA Committee on Legal Specialization; and was named a North Carolina “Super Lawyer” in a Law & Politics survey.

Peter Pappas practices in the areas of business and commercial litigation, labor and employment law, insurance litigation, ERISA litigation, and fidelity and surety. He is a former chair of the Bench/Bar Liaison Committee, Litigation Section, and Young Lawyers Division of the North Carolina Bar Association. He clerked for the Honorable W. Earl Britt, United States District Court Judge for the Eastern District of North Carolina.

David Senter chairs the firm’s construction practice group. He concentrates his practice in the areas of construction and surety, commercial litigation, and commercial collections. He is a member of the Governing Committee of the American Bar Association’s Construction Forum and is a past member of the council of the North Carolina Bar’s Construction Law Section.
