JMBM Promotes Four Associates To Partner
Jeffer, Mangels, Butler & Marmaro LLP (JMBM), one of California’s foremost full-service law firms, today announced that four associates have been elected to the partnership, effective immediately.

"We are delighted to promote three associates in our Los Angeles office and one associate in our San Francisco office to partner status," said Bruce P. Jeffer, JMBM's managing partner. "Each of these professionals has demonstrated legal prowess within their areas of expertise, and we are proud of their efforts and commitment to the firm."

The following associates have been elected to the partnership:

Scott N. Castro has been named partner in the Government, Land Use, Environmental and Energy Group. Castro, who is based out of the Firm's San Francisco office, represents clients in various aspects of federal, state and local environmental and land use litigation. Castro received his Bachelor of Arts Degree from Swarthmore College, a Master of Science from Rutgers University and his Juris Doctorate from Hastings College of Law, University of California, in 1997. He is a member of the State Bar of California.

Travis Gemoets has been named partner in the Labor & Employment Group. An experienced trial attorney, Gemoets represents management in all facets of labor and employment law and advises employers on all types of employment issues. He received his Bachelor of Arts from the University of California, Los Angeles and his Juris Doctorate from Hastings College of Law, University of California, in 1994. He is a member of the State Bar of California.

Kevin K. McDonnell has been named partner in the Government, Land Use, Environmental and Energy Group. As a registered Civil Engineer and Structural Engineer in California, McDonnell offers unique professional insight in litigation matters pertaining to construction and engineering laws. He received his Bachelor of Science from California Polytechnic State University and his Masters of Science in Structural Engineering from California State University, Northridge. A member of the State Bar of California, he received his Juris Doctorate from Southwestern University School of Law in 1999.

Michael N. Steuch has been named partner in the Corporate Group. His corporate and securities work emphasizes mergers and acquisitions, capital raising and counseling business enterprises from initial formation and financing through their eventual sale. Steuch received his Bachelor of Business Administration from the University of Iowa and his Juris Doctorate from the University of California, Los Angeles, in 1998. He is a member of the State Bar of California.

Katten Muchin Rosenman LLP Offers Condolences to the Family of Harvey M. Silets
It is with great sadness that we report that Partner Harvey M. Silets passed away on Tuesday, January 23. Harvey was a giant in the fields of Tax Controversy and White Collar Defense. He was also a great General Counsel to the Firm, and a friend and mentor to many of us over the 15 years he practiced at Katten. He will be sorely missed.

Our condolences and deepest sympathies go out to Harvey’s family. He is survived by his wife Elaine, his son H.L., his daughter Alexandra, his sister Norma Pearl, and three grandsons. Donations may be made in Harvey's name to Interlochen Center for the Arts, P.O. Box 199, Interlochen, MI 49643-0199, for the benefit of the Jonathan Lazarus Silets Memorial Scholarship Fund.

Rita Sheffey selected for Georgia Trend Magazine Legal Elite 2006
Rita Sheffey, a partner in the Atlanta office of Hunton & Williams, has been selected by Georgia Trend Magazine as one of its Legal Elite for 2006. Rita has been on the list for all 4 years of the magazine's listing. This year, Rita is listed both for Business Litigation and Pro Bono, and she was one of 11 lawyers featured in the December 2006 issue. Presented by Georgia Trend, attorneys for the Legal Elite are selected by their peers in 11 different practice areas. Sheffey, who handles mostly litigation work, chairs the Atlanta office's pro bono committee and devotes half of her time to pro bono work. She also directs the firm's pro bono Southside Legal Center and maintains relationships with just about every legal service organization in metro Atlanta.

U.S. Supreme Court Agrees To Hear Superfund Cost Recovery Case
The United States Supreme Court has agreed to hear a case, United States v. Atlantic Research Corp., that may decide whether private parties who incur cleanup costs can sue other parties for contribution under the federal Superfund law without being sued by, or having settled with, EPA first.

In 2004, the Supreme Court decided Cooper v. Aviall, which changed prevailing law and declared that private parties did not have contribution rights under section 113 of the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) without a prior lawsuit or settlement with EPA. Before Aviall, most lower courts allowed private parties to sue under section 113 without a prior suit or settlement, but prohibited private parties who were potentially responsible parties (PRPs) from bringing contribution claims under a companion provision of CERCLA, section 107. These earlier decisions under section 107, coupled with the Aviall decision on section 113, effectively eliminated claims under federal law to recover cleanup costs incurred voluntarily by private parties.

Since the Aviall case, federal courts have disagreed about whether private parties have claims under section 107. The Eighth Circuit U.S. Court of Appeals said yes, as did the Second Circuit, yet the Third Circuit said no, denying the right to bring section 107 claims. The Supreme Court will now attempt to resolve this conflict and may decide whether the claims can be brought.

For sites in Washington State, the federal courts’ quandary is less important since the state’s cleanup law, the Model Toxics Control Act (MTCA), allows contribution for purely voluntary cleanups even if they are not preceded by a lawsuit or settlement. Companies that have sites in other states, however, may now be given back a remedy they had before the Supreme Court’s Aviall decision.

Corporate Partner Richard Silfen Joins Duane Morris in Philadelphia
Duane Morris LLP is pleased to welcome Richard A. Silfen as a partner in its Philadelphia office. Richard joins the firm's Corporate Practice Group from corporate roles at Cangen Biotechnologies, Inc., a biotechnology company, and GMH Communities Trust, a real estate investment trust.

An accomplished corporate lawyer, Richard will focus his practice in securities offerings and merger and acquisition transactions, as well as venture capital and private equity investments. He has represented clients in the biotechnology, pharmaceutical, medical devices and high-technology industries, assisting them with technology development and implementation plans, strategic partnerships, collaborations and joint ventures. Richard also has extensive experience counseling real estate investment trusts in business and financial matters.

Richard brings to Duane Morris a rich background in both the life sciences and REIT industries and in law. At GMH, he served as chairman of the Special Committee of the Board of Trustees in charge of identifying and pursuing strategic and financial alternatives for the future of the company. Richard also served as president and chief financial officer at Cangen Biotechnologies, Inc., a Bethesda, Maryland-based biotechnology company with offices in Tokyo and Seoul. Before that, he practiced privately at several law firms, most recently Morgan, Lewis & Bockius LLP in Philadelphia, where he was a partner. Richard also practiced as a staff attorney at the U.S. Securities and Exchange Commission, Division of Corporation Finance. He served in the Office of Mergers and Acquisitions and Office of Chief Counsel.

A 1987 graduate of the University of Alabama School of Law, Richard earned his B.A. from Baylor University, where he majored in physics.

CRAVATH REPRESENTS TIME INC. IN SALE OF ITS TIME4 MEDIA AND PARENTING GROUPS TO BONNIER MAGAZINE GROUP
Cravath represented Time Inc. in the sale of its Time4 Media Group, whose magazine titles include Popular Science, Field & Stream, Outdoor Life, Yachting, Skiing, and SKI, and its Parenting Group, whose titles include Parenting and Babytalk, to Bonnier Magazine Group. The lawyers involved in this matter are partner John T. Gaffney and associates Eric L. Schiele, Matthew F. Popowsky and Khorshid Hakemi on corporate matters; partner Stephen L. Gordon and associates Lauren Angelilli and Rebecca M. Kysar on tax matters; and associates Jennifer S. Conway and Julia Gray on executive compensation and benefits matters. The deal was announced on January 25, 2007.
