Ben Kahn Earns National Certification in Business and Consumer Bankruptcy Law
Benjamin A. (Ben) Kahn, a Member (partner) in Nexsen Pruet Adams Kleemeier’s Greensboro office, has successfully completed the requirements for national certification in both business and consumer bankruptcy law.

To become certified, Mr. Kahn had to satisfy the following requirements:

* Full-time practice of law for at least five years;
* Good standing in the bars of all states where he holds a license to practice law;
* Devotes at least 30% of practice time and at least 400 hours to bankruptcy related matters in the last three years;
* Documented involvement in consumer and business bankruptcy by providing information on cases;
* Demonstrated commitment to continuing legal education by earning at least 60 hours of bankruptcy education in the past three years;
* Pass an extensive examination covering business and consumer bankruptcy issues.

In addition, Mr. Kahn is certified as a specialist in Business and Consumer Bankruptcy Law by the North Carolina State Bar Board of Legal Specialization.

The American Board of Certification (ABC) is a non-profit organization dedicated to serving the public and improving quality of the bankruptcy bar. The rigorous ABC certification standards are designed to encourage bankruptcy practitioners to strive toward excellence and to recognize those attorneys who are experts in the bankruptcy field. The ABC offers separate certification programs in business and consumer bankruptcy and creditors’ rights. All three ABC certification programs are accredited by the American Bar Association.

The ABC is co-sponsored by The American Bankruptcy Institute and the Commercial Law League of America. The ABC Board of Directors consists of many of the nation’s finest bankruptcy and creditors’ rights lawyers, formers judges and law professors.

Nexsen Pruet Jumps in Listing of Largest U.S. Law Firms
Nexsen Pruet jumped nine spots in The National Law Journal’s listing of the 250 largest U.S. law firms, and is ranked No. 231 in the publication’s 29th annual survey.

Nexsen Pruet added 18 attorneys in 2006, pushing its total number of attorneys to more than 180 and reinforcing its standing as one of the largest general service firms in the Carolinas.

“This isn’t growth for it’s own sake,” said Leighton Lord III, chairman of the board of Nexsen Pruet. ”It is strategic growth, undertaken to better serve our clients. At the end of the day, numbers are less important than skill – it just happens that we have added both this year.

STRASBURGER & PRICE, LLP WINS ANNUAL HOUSTON BAR FOUNDATION PRO BONO AWARD
Strasburger & Price, LLP, a full-service law firm with seven offices, is pleased to announce that the Houston Bar Foundation awarded Strasburger the Outstanding Contribution to Houston Volunteer Lawyers Program (HVLP) by a Mid-Size Firm for 2006 Award.

Strasburger attorneys accepted 14 pro bono cases in 2006, and continuously volunteered their time to help staff HVLP clinics. Strasburger attorneys were also recognized for often accepting difficult HVLP cases with critically short deadlines, a service that is invaluable to many HVLP clients.

"Strasburger is committed to providing legal advice to those who cannot afford the service," said John Spiller, a Partner in Strasburger's Houston office who also serves as Treasurer of the HVLP. Mr. Spiller continued, "For example, the firm provides up to 30 hours of billable credit to any associate at our firm who works on approved pro bono matters such as the cases we receive through the Houston Volunteer Lawyers Program."

The Houston Bar Foundation provides primary support for the HVLP through an annual grant. HVLP's mission is to provide pro bono representation through volunteer attorneys to indigent and low income residents of Harris County. HVLP provides an important link between the applicant seeking legal assistance and the volunteer providing pro bono services.

Court Strikes Down COAH Regulations
Partners of Hill Wallack LLP’s Land Use Division, Thomas F. Carroll, III, Esquire and Stephen M. Eisdorfer, Esquire won a major victory on behalf of the New Jersey Builders Association and the Builders Community.

On January 25, 2007, the Appellate Division struck down key provisions of the regulations of the Council on Affordable Housing (“COAH”) limiting municipal fair share housing obligations for the period 1999 to 2014 (the “third round”). The court acted in a case brought by Hill Wallack LLP on behalf of the New Jersey Builders Association. The court ordered COAH to adopt lawful regulations within six months. It barred COAH from acting on any of the more than 250 pending petitions by municipalities for approval of their housing plans until it adopts lawful regulations.

In its lengthy opinion, the court invalidated COAH’s so-called “growth share” methodology for determining municipal fair share obligations. It also ruled that COAH could not authorize municipalities to meet their housing obligations by requiring builders to provide affordable housing without also providing compensating incentives. In other rulings, it rejected COAH’s subtraction of 50,000 units from its determination of the state’s unmet housing need for alleged affordable housing provided through “downward filtration” of previously unaffordable housing. It also ruled that COAH could not authorize municipalities to restrict 50 percent of affordable housing to senior citizens.

The decision is far reaching. It potentially affects all property owners and all developers and redevelopers of residential and non-residential projects. On each of the key points in its decision, the Appellate Division adopted the arguments made by Hill Wallack LLP.

For example, the court held that COAH’s so-called “growth share methodology,” which calculates municipal housing obligations based upon municipalities’ own projected housing and employment growth, is unconstitutional. The court concluded that, as formulated by COAH, this methodology does not require municipalities to act to satisfy the actual unmet housing need, but instead encourages them to seek to reduce their housing obligations by deterring development.

The court also ruled that so-called “pass-through” or “growth share” ordinances--ordinances that require builders to construct affordable housing in every development without providing compensating incentives--discourage production of affordable housing. It held that such ordinances are not a constitutionally acceptable means of meeting the municipal housing obligations.

The court rejected COAH’s claim that municipal housing obligations can be reduced because large numbers of safe, decent housing units are available to lower income families as a result of the declines in housing prices. It concluded that COAH had no evidence that there is a surplus of housing, or that declining housing prices are in fact making housing affordable to lower income families.

Among other rulings, the court declared that COAH cannot increase the proportion of affordable housing that municipalities may restrict to senior citizens from 25 percent to 50 percent. It held that restricting affordable housing to senior citizens was potentially exclusionary and that COAH lacked sufficient evidence to justify any such increase.

Because of its broad effect, the court’s decision will require property owners and builders who do not already have final development approvals to make careful tactical decisions over the next six months. He is admitted to practice before the state and federal courts of New Jersey. A distinguished scholar, Mr. Eisdorfer has argued significant cases concerning anti-exclusionary zoning litigation, municipal zoning which discriminates against housing for the non-traditional households, and racial discrimination in selection of occupants for low-income housing. He is a resident of Highland Park, New Jersey.

Haynes and Boone Announces 2007 Class of New Partners
Haynes and Boone, LLP has named 10 attorneys from three of its offices as firm partners effective this year.

Six of the new partners work in the Dallas office. They are:

* William Bruce Newsome – Mr. Newsome is a member of the Corporate/Securities Practice Group representing and advising publicly traded and private companies.
* Purvi J. Patel – Ms. Patel specializes in trademark and copyright law, focusing on brand management, including the procurement, protection, enforcement and management of domestic and international trademark portfolios.
* David M. Shinnick -- Mr. Shinnick has extensive experience in assisting clients with complex commercial real estate transactions including acquisition, development, financing, leasing and disposition of retail, office, multifamily, condominium and industrial projects.
* Sarah R. Teachout – Ms. Teachout is a member of the Antitrust and White Collar Criminal Defense Practice Group. She concentrates her practice in the defense of corporations and individual clients in federal criminal proceedings and has represented clients in a variety of antitrust, environmental and complex business litigation.
* Craig S. Unterberg – Mr. Unterberg represents borrowers and lenders in secured and unsecured commercial lending transactions, including syndicated financings, and mergers and acquisition financings.
* Susan A. Wetzel – Ms. Wetzel focuses her practice in the areas of executive compensation, health and welfare plans, retirement plans and health law. She is co-chair of the Mergers and Acquisitions Subcommittee of the American Bar Association Section of Taxation Employee Benefits Committee

Three of the new partners are based in Houston:

* Kenneth V. Herz – Mr. Herz is a member of the Haynes and Boone Financial Transactions Group who concentrates his practice in the representation of banks and other financial institutions.
* William B. Nelson – Mr. Nelson's practice centers on corporate securities law, including public offerings and private financings, acquisitions, mergers, monetization transactions, securities law compliance and corporate governance.
* Mark Trachtenberg – Mr. Trachtenberg is one of the country’s leading authorities on school finance litigation. An appellate lawyer, he was the principal architect of the legal strategy from the trial court through the Texas Supreme Court in a successful challenge to the constitutionality of the Texas school finance system.

Finally, David J. Drez III of the Fort Worth office has been named partner in the firm’s Business Litigation Practice Group. He has represented clients engaged in a variety of industries and has litigation experience in commercial litigation matters in both federal and state courts in Texas and around the country.
