FITZPATRICK JOINS WTK AS PARTNER
John M. Fitzpatrick ("Fitz"), a "go-to" trial attorney for high exposure liability cases, joins the Denver-based trial law firm Wheeler Trigg Kennedy LLP as a partner.

In 20 years of private practice, Fitz has tried and obtained defense verdicts in 18 states in over 140 cases involving product liability, medical malpractice, asbestos, construction defects, professional negligence and gas releases from chemical plants. Fitz has served as national trial counsel for many major corporations, including GE, Georgia Pacific, Foster Wheeler, United Health Services, Global Aerospace and Air Products & Chemical Co. He was named CNA’s Health Pro Litigator of the Year in 2004.

The former concert pianist and Army Airborne Ranger, Fitz began his legal career trying criminal cases in Colorado and South Korea with the U.S. Army JAG Corps. After entering private practice in 1988, he soon established a reputation for trying high exposure medical malpractice and asbestos cases to verdict across the country. In 2003 and 2004, Fitz had three cases listed in the top 10 defense verdicts in Virginia. In June 2005, Fitz tried and won the first-ever asbestos case for GE in Madison County, Illinois – voted the "#1 Judicial Hellhole" for corporate America by The Wall Street Journal. Since 2004, Fitz has tried 17 high exposure cases to verdict in eight states, prevailing in 16 with one appeal pending. Fitz is a 1981 honors graduate from Notre Dame Law School and a 1974 graduate of the United States Military Academy at West Point with a BS in engineering.

At WTK, Fitz will focus his practice in the areas of product liability, asbestos, medical malpractice, and high exposure negligence cases. George Nowack Elected Dean of The College of Community Association Lawyers
Weissman, Nowack, Curry & Wilco, PC announces that George E. Nowack, Jr. was elected Dean of The College of Community Association Lawyers, effective January 1, 2007. Nowack, a founding partner of Weissman, Nowack, Curry & Wilco, PC is co-chair of the Firm's community association practice and a member of The College's charter class.

As Dean, Nowack will be responsible for promoting the high standards of professional and ethical responsibility in the practice of community association law, a founding principle of The College. Established in 1993 by the Community Associations Institute (CAI) Board of Trustees, the charter class consisted of 20 attorneys acknowledged by their peers as having developed the field of community association law. The College also provides a forum for the exchange of information among experienced legal professionals for the advancement of community association law.

"I am extremely honored to lead The College," said Nowack. "CAI and The College are committed to continued development of quality education and programs for our members." He cited the two day annual Community Association Law Seminar as an example of state-of-the-art education for attorneys. Over 400 participants attend sessions on legal issues affecting community associations taught by leaders in their fields. Each year Nowack presents a review of the key cases decided in the previous year during the opening session.

The College is governed by a five person Board of Governors elected by its 95 members. The Board in turn elects a Dean to serve a two year term. In becoming Dean, Nowack is only the second person to have served CAI as the National President and Dean of The College.

In order to be eligible for College membership, an attorney must have at least seven years experience primarily in community association law. Additionally, a candidate must have had significant legal writings and publications, teaching experience and involvement with CAI at both the national and local levels.

Partner Elected to USLAW Post
Tyler Cooper partner Noble F. Allen has been elected Vice Chair of the Retail Practice Group Section of the USLAW Network. Noble practices in the firm’s New Haven office, focusing on civil and commercial litigation and immigration law.

Noble is Chair of the firm’s Commercial Landlord and Tenant Group. He routinely litigates commercial landlord/tenant cases and primarily represents commercial landlords and property owners in leasing matters.

The USLAW Network is a national organization composed of approximately 60 member firms in 43 states with more than 3,500 attorneys. Tyler Cooper is the only member firm in the state of Connecticut. The purpose of the Network is to offer firms the opportunity to represent high quality national clients based on referrals from other member firms.

Appointments
Paul Walter has been appointed as an Adjunct Professor at the University of Baltimore School of Law and will teach a course entitled Litigation Process during the Fall semester.

Laurie M. Wasserman has been appointed as Baltimore County Representative to the Maryland State Bar Association's Young Lawyers Section.

L. Content McLaughlin has been appointed to the Board of Directors of the Maryland Chapter of the National Association of Women Business Owners and serves as Public Policy Chair.

Ferrier R. Stillman has been invited to participate in the Women in Law Development Committee. This project will record the unacknowledged history of women in the law.

John B. Isbister and Diane V. D'Aiutolo have been invited to reprise their roles as faculty members in MICPEL's Trial Advocacy Program at the University of Baltimore School of Law.

OMM Reverses Arbitration Award Against California Pacific Medical Center
In an important case concerning the jurisdiction of federal agencies in relation to arbitrators, O’Melveny has obtained the vacatur of a 2006 arbitration award against client California Pacific Medical Center (CPMC) in San Francisco.

The arbitration award had held that CPMC violated an organizing agreement with Service Employees International Union (SEIU) by refusing to join the union’s appeal of a National Labor Relations Board (NLRB) order that dismissed the union’s organizing petition at the hospital.

U.S. District Court Judge Samuel Conti vacated the arbitration award on the grounds that it conflicted with a prior ruling of a federal agency acting within the scope of its statutory authority. Download the order.

This case is particularly significant because it is one of the first in the nation to review an arbitration award arising from an organizing agreement between a union and an employer. Many unions have made obtaining organizing agreements from employers the primary objective of sophisticated corporate campaigns. Judge Conti’s decision makes clear that the NLRB -- not a labor arbitrator -- remains the primary authority on questions of union representation.

Denis Braham Becomes New Winstead Chairman and CEO
The law firm of Winstead begins 2007 with new leadership, as shareholder Denis Clive Braham assumes the post of chairman and CEO. An attorney with Winstead since 1989, Braham worked on the Winstead team responsible for bringing the NFL back to Houston and helping the city successfully win the bid to host Super Bowl XXXVIII. Braham also worked on the Winstead team that helped Jerry Jones with the new Dallas Cowboys Stadium under construction in Arlington, and he worked on the Winstead team that represented two New York bond insurers in one of the biggest municipal bond transactions of 2006—the financing of the new Yankee Stadium. Braham is a member of the firm's Corporate and Real Estate Sections and he also chairs Winstead's Sports Business & Public Venues Practice Group, counting among his clients the Dallas Cowboys and the Houston Texans.

"I'm excited about leading Winstead as we look to the future," said Braham. "Winstead has helped clients create evolutionary changes and transformations in the business community such as Victory Park in Dallas and Reliant Stadium in Houston.
