Wiley Rein Partner Comments on Supreme Court Decision to Hear Pollution Cleanup Case
Wiley Rein Partner Laura A. Foggan was quoted in Business Insurance on the Supreme Court’s decision to hear a case that deals with who can be made to pay for environmental cleanups mandated by the Superfund law. Foggan described United States vs. Atlantic Research Corp. as a “very interesting case...that 's going to be closely watched.”

“We've maybe lost track of the fact that Superfund is a draconian remedy that imposes very substantial liability, but it does. As a result, any of these cases over sharing Superfund costs tend to be high-stakes, high-dollar matters,” Foggan said.

In this case, Atlantic Research Corp. asked the federal government to cover part of the company’s expenses for a voluntary cleanup of a facility in Arkansas that retrofitted rocket motors for the U.S. government. Previous Supreme Court decisions have held that companies seeking contributions for such expenses must have been sued under the Comprehensive Environmental Response, Compensation, and Liability Act of 1980. Federal appeals courts have been split over contributions for voluntary environmental cleanups.

“Certainly, the ability to force the government when it's a responsible party to share cleanup is an important issue. The trick is that if there weren't a means for the responsible party who incurs the cost " to recover it, Foggan told Business Insurance.

“The government could hold all the cards,” she said. “It could decline to sue, decline to settle, kind of play the game so the party that had to undertake the cleanup'' would not have the right to force the government to pay its share as a responsible party.

Weltman, Weinberg & Reis Co., L.P.A. Wins a First Place Renaissance Award from the Pittsburgh Chapter of the Public Relations Society of America
Weltman, Weinberg & Reis Co., L.P.A. (WWR) was the recipient of a First Place Renaissance Award in the Internal Publications category of the Renaissance Awards program sponsored by the Pittsburgh chapter of the Public Relations Society of America (PRSA). WWR received the award in recognition of its inTouch newsletter- a quarterly newsletter distributed to employees in all of its offices. The firm was presented with the award at the 2007 PRSA Renaissance Awards ceremony held on January 25, 2007 at the Omni William Penn Hotel in Pittsburgh, PA.

The PRSA Renaissance Awards are dedicated to honoring local organizations, agencies and individuals for excellence in public relations. The judges evaluated nominations in more than 40 categories. inTouch won one of two First Place Renaissance Awards in the Internal Publications category.

inTouch debuted in the summer of 2005 with the goals of unifying WWR’s staff and facilitating better communication within the firm. Alan Weinberg, Managing Partner of WWR, states, “Our firm has undergone rapid growth in the last seven years- we’ve opened four new offices and have nearly doubled our staff from 530 employees in 2000 to over 1000 employees in 2007. As a result, it has become increasingly important for us to improve communications among our employees and offices. inTouch is a great way for our employees to enjoy learning more about the firm and also their fellow employees. Along with business-related articles and general news, the newsletter typically spotlights WWR offices, shares employee stories outside the office, surveys the staff, showcases interesting employees, holds contests, and spreads fun facts about the firm. Each issue features an article from a partner along with human-interest stories about the staff.

David A. Sturms, chairman of Vedder Price’s Investment Services Group, has been nominated as Independent Counsel of the Year. He is one of four final nominees who will be honored at the 14th Annual Mutual Fund Industry Awards on March 8th 2007. These awards are bestowed annually to leaders from across the mutual fund industry who have excelled over the previous year.

Over the past 13 years, the Mutual Fund Industry Awards Dinner and Ceremony has become the premier event for the mutual fund industry, growing in attendance and prominence each year. The awards are given by the editors of Institutional Investor’s Fund Action and Fund Directors newsletters – leading publications in the U.S. mutual fund industry – to the fund leaders, marketers, trustees and independent counsel who have made significant impacts on the fund industry over the previous year.

Mr. Sturms was nominated for his efforts on behalf of the board of the PowerShares Funds in approving a new advisory contract following the acquisition of the funds by AMVESCAP. Mr. Sturms said he was honored to be nominated, acknowledging that “this would not have been possible without the support of my colleagues at Vedder Price, including in particular, Karin Jagel Flynn.”

Mr. Sturms has extensive experience in advising investment companies and investment advisers on all aspects of the Investment Company Act of 1940 and the Investment Advisers Act of 1940, and in counseling independent directors of investment companies on their duties and responsibilities under the law. His publications include "Enhancing the Effectiveness of Independent Directors: Is the System Broken, Creaking or Working?," Villanova Journal of Law and Investment Management (Fall 1999). Mr. Sturms also served on the American Bar Association Task Force that drafted the Fund Director's Guidebook (2003 and 2006).

Mr. Sturms is a frequent speaker and author on investment management issues, including mergers and acquisitions of investment companies and investment advisers; federal and state registration of investment companies and investment advisers; investment company independent directors; D&O/E&O insurance; valuation; audit committees; money market funds; mutual fund advertising; on-line investment advice, distribution and compliance; and derivative instruments.

He also served on the Investment Company Institute’s SEC Rules and State Liaison Committees, as well as the money market funds, advertising, compliance, creditors’ rights and various other ad hoc committees. In addition, Mr. Sturms served on the Illinois Securities Advisory Committee.

Ed Hughes Named Leader of Energy/Utility Law Team
Stafford Rosenbaum LLP recently announced that Ed Hughes has been appointed to head its Energy/Utility Law Team.

Hughes’ practice is concentrated in the areas of utility law, antitrust, trade regulation, consumer protection, and business litigation. His broad range of experience includes serving as a trial attorney in the Antitrust Division of the U.S. Department of Justice in Washington and as the Telecommunications Advocate in the Wisconsin Department of Justice.

In addition to his telecommunications work, Hughes has experience both in private practice and as an assistant attorney general in electric utility matters. He also represents plantiffs and defendants in a wide range of business litigation matters involving antitrust, trade regulation, and consumer protection issues.

Hughes received his J.D. from the University of Chicago Law School and his bachelor’s degree from Georgetown University. He is a member of the American Bar Association, the State Bar of Wisconsin, the Dane County Bar Association, and the James E. Doyle Chapter of the American Inns of Court. He was recently selected by his peers for inclusion in the 2007 edition of The Best Lawyers in America.

ATTORNEY PETER NIEVES NAMED TO NEW HAMPSHIRE UNION LEADER'S 40 UNDER FORTY LIST
For the sixth year, the New Hampshire Union Leader has honored 40 shining stars under age 40 that are making a difference in New Hampshire. Sheehan Phinney attorney Peter Nieves was named to the 2007 class of those up and coming leaders. Honorees are nominated and selected based upon their professional and volunteer accomplishments. Nieves, 36, was featured in the January 29, 2007, edition of the newspaper and, along with others on the list, will be honored at an event in March.

Nieves is Chair of the firm’s Patent Group. His practice focuses on many aspects of intellectual property, including domestic and foreign preparation and prosecution of

patents, domestic and foreign preparation and prosecution of trademarks, and disputes concerning patents, trademarks, copyrights and domain names. He speaks regularly at Dartmouth College in the Tuck School of Business and the Thayer School of Engineering, as well as at other forums. In addition, he is an adjunct professor at Franklin Pierce Law Center.

Nieves lives in Dunbarton, NH, with his wife Bonnie, and their two daughters Skye and Sierra. He is a graduate of the State University of New York at Buffalo and Franklin Pierce Law Center.

Proposed shield law filed in the state legislature
A law that would prevent the release the names of confidential sources of reporters in Massachusetts has been filed in the state legislature with several prominent sponsors. The bill, conceived of and drafted by Prince Lobel partner Jeffrey A. Newman, has resulted in the creation of a committee comprized of representatives from all major media groups in the state, all of whom are supporting and advancing the Bill. Massachusetts is one of just a few states in the entire nation that does not have a "shield" law and recently Governor Deval Patrick voiced his strong support for the filed legislation.
