Robbie Kaplan Quoted in The American Lawyer
Litigation partner Robbie Kaplan is quoted in the January issue of The American Lawyer concerning the obstacles faced by women litigators. In the article, Robbie recounts a story of how as junior associate she (unsuccessfully) tried to imitate the no-holds-barred cross-examination style of now-retired Paul, Weiss partner Marty London, only to "fall flat on my face." Robbie says that as a result, she quickly learned that as a woman litigator, she would have to develop her own distinctive courtroom persona that was different from that of her male counterparts. She explained that when she began at Paul, Weiss as a junior associate, "I [mistakenly] thought I could become a trial lawyer in the model of the great [male] trial lawyers, and those kind of cultural and societal biases wouldn't be there.

OMM Represents ARIO Data Networks in Acquisition by Xyratex
O'Melveny counsel Paul Sieben represented venture-backed ARIO Data Networks, a provider of highly scalable and highly modular "bladed" storage solutions and RAID controllers, in its acquisition by publicly listed UK firm Xyratex Ltd. (NASDAQ: XRTX). Terms of the transaction were not disclosed.

Xyratex is a leading provider of enterprise class data storage subsystems and storage process technology. With the completion of this acquisition, key assets and employees will be integrated into the Networked Storage Solutions division of Xyratex to enhance its capability to deliver even more software value add technology for its customers.

HASKELL SLAUGHTER'S GRAFFEO RE-ELECTED TO BIRMINGHAM BAR YOUNG LAWYERS SECTION EXECUTIVE COMMITTEE
V.J. Graffeo, an attorney with Haskell Slaughter Young & Rediker, LLC, has been re-elected for a second one-year term on the Executive Committee of the Birmingham Bar Association's (BBA) Young Lawyers Section. The Executive Committee is responsible for planning and implementing the activities of Section, which promotes the professional development and community involvement of younger BBA members.

With over 3,000 members, the BBA is the largest local bar association in Alabama.

V.J. Graffeo practices in the area of complex civil litigation. His experience includes working with the firm's securities, class action and derivative litigation team, as well as representing plaintiffs and defendants in other types of civil actions.

Ed McHorse named as finalist in Austin Under 40 awards
Graves Dougherty shareholder, Ed McHorse, has been named one of five finalists in the Legal category for the 2007 Austin Under 40 Awards.

A natural leader, Ed chooses to spend his limited spare-time investing in causes he feels strongly about and can really make a difference in.

In addition to his work at Graves Dougherty, McHorse offers his expertise to various clients referred to him through Volunteer Legal Services, which assists the growing number of low-income individuals needing civil legal assistance. His probono legal work also extends to organizations such as Caritas of Austin and the Tarrytown United Methodist Church. For more than nine years, McHorse has been an active member of Caritas of Austin. In addition to providing legal counsel, he served two terms on Caritas' board of directors—a total of six years—including a term as president of the board. Currently, McHorse chairs Caritas' Community Advisory Board and served as chair of the underwriting committee for the Harvey Penick Award Dinner in November 2006.

“Ed McHorse exemplifies all things ethical and compassionate about nonprofit agencies like Caritas of Austin,” said Beth Atherton, Executive Director of Caritas of Austin. “He is sincere, forthright and engaged as a volunteer who tirelessly gives his time and energy.”

For more than twelve years, McHorse has been actively involved in Tarrytown United Methodist Church (TUMC.) He served a three-year term on the church's nominating committee and is currently a delegate to the annual conference. When the need arises, he also handles legal matters for the organization. McHorse led the effort to draft TUMC’s Children and Youth Safety Policy and has been actively involved with TUMC staff in follow-up and revisions to the policy for a number of years. In addition, McHorse is a member of the board of trustees for the Austin District of the United Methodist Church.

A sports enthusiast, McHorse is a board member of the Northwest Little League (NWLL) currently serving as the T-ball Commissioner. In 2005, he also formed a select baseball team, which he continues to coach during the fall seasons. He has also coached the various soccer and basketball teams of his three children. Due to his talent, hard work and pure love of the game, McHorse has been selected to coach District and All-Star baseball teams for NWLL. He also volunteers with the Highland Park Elementary PTA.

Lew Little, CEO and Chairman of TRISUN Healthcare, has been a colleague and client of Ed’s for many years. In addition to the legal work Ed provides for TRISUN, they both sit on the advisory board of Caritas.

Frank Carroll Elected Chair of Dallas Bar Association Antitrust Section
William Frank Carroll, a shareholder who works in both the Dallas and Fort Worth Offices of Winstead, has been elected chair of the Dallas Bar Association Antitrust Section for 2007. As chairman, Carroll will provide leadership and guidance to the section's members on litigation and corporate counsel issues relating to antitrust and other trade regulation matters involving the Department of Justice Antitrust Division, the Federal Trade Commission and private civil antitrust issues.

"I am honored to serve as the chairman of this Section and I look forward to working with the other officers and the council as we strive to provide guidance on antitrust compliance and regulatory issues," said Carroll who was also appointed as co-chairman of the Dallas Bar Association Judiciary Committee. He also previously chaired the Dallas Bar Association Business Litigation Section.

Other positions that Carroll will hold in 2007 include: vice chair of the State Bar of Texas Minimum Continuing Legal Education Committee; co-chair of the American Bar Association Business Law Section Securities Arbitration Committee; co-chair of the American Bar Association Litigation Section Corporate and Securities Litigation Committee; and co-chair of the Federal Bar Association Appellate Practice Committee.

Additionally, Carroll will teach Trial Advocacy at Southern Methodist University Dedman School of Law this Spring and serve as president of the Bobby Bragan Youth Foundation, an organization that awards college scholarships to students in the 8th grade contingent on them completing high school (http://www.bobbybragan.org/).

Carroll is a trial and appellate lawyer with extensive experience in many substantive areas of law and he is a member of Winstead's Appellate, Intellectual Property Litigation, Securities Litigation and Enforcement and Litigation/Dispute Resolution Practice Groups. He is also a mediator and arbitrator In addition, he is a seasoned counselor in complex business matters with a primary emphasis on federal court, class action, financial institutions, antitrust and securities litigation. Carroll is one of only 100 lawyers in Texas who is Board Certified in both Civil Trial Law and in Civil Appellate Law by the Texas Board of Legal Specialization.

Jan Witold Baran Quoted on Obama Fundraising
Wiley Rein Partner Jan Witold Baran was quoted in The Washington Times on Sen. Barack Obama's early success in raising funds for his presidential campaign.

"I don't think money is going to be a problem for Obama. At this stage of the game, he is what the late [Republican strategist] Lee Atwater used to call a rocket. He's a fresh face that captures the attention and fancy of the public," Baran said.

However, Baran cautioned against reading too much into early fundraising, telling the paper, "Howard Dean, an obscure governor from tiny Vermont, raised $40 million—a record in off-year fundraising then—and was on the cover of all the national newsmagazines. By the time the Iowa caucuses came along, he came in third.
