HUP&K’s Employment Group Divides to Conquer
Hodes, Pessin & Katz, P.A. (HP&K), Maryland’s 7th largest law firm, has divided its Labor & Employment Law group between its Baltimore and Howard County offices, to more effectively target and serve the state’s private sector areas of labor and employment.

Rochelle S. Eisenberg, member of HP&K’s Labor & Employment Law group, has moved from the firm’s Towson headquarters, to the firm’s Columbia office, to spearhead new efforts to better serve their employment-management clients and reach new prospects throughout Maryland.

Eisenberg’s clients range from small businesses to Fortune 500 corporations, as well as union and non-union companies. She represents employers in such matters as wage-hour compliance, safety and health enforcement actions, collective bargaining and labor arbitration matters.

Eisenberg and her group bring over 30 years of labor and employment experience to Howard County, and will continue to advise clients on such issues as hiring, discipline, layoff and termination processes. She regularly represents clients before federal, state and local administrative agencies, including the National Labor Relations Board, the Equal Employment Opportunity Commission, the U.S. Department of Labor, state and federal safety and health enforcement agencies and the courts.

Eisenberg and her group have presented well over 500 seminars, locally and nationally, to private and public sector employers, and provide specialty training and audit programs for employers of all sizes.

Smith Anderson Recipient of the Volunteer of the Month Honor for Pro Bono Efforts
The Food Bank of Central & Eastern North Carolina (Food Bank) honored Smith, Anderson, Blount, Dorsett, Mitchell & Jernigan (Smith Anderson) with its Volunteer of the Month award.

Jane Cox, President and CEO of the Food Bank, recently informed the Firm of this recognition. In her letter, Ms. Cox expressed special appreciation for the pro bono legal services provided by several firm lawyers in connection with a lease for one of its warehouses. Firm lawyers Mike Weddington, Cliff Brinson and Steve Mason worked on the particular project in question.

"We very much appreciate the recognition Food Bank provided to our lawyers donating their time," said Rose Kenyon, Chair of Smith Anderson's Pro Bono Committee. "We take seriously our obligation to provide pro bono legal services to the poor, or to organizations like the Food Bank that assist the poor. It is an honor to be able to support an organization like the Food Bank that serves such an important need in our community."

Smith Anderson lawyers and staff regularly provide pro bono services in many other ways, including representing clients referred by Legal Aid of North Carolina and providing services to non-profit organizations. In addition, firm lawyers and staff are active in a variety of civic and community organizations throughout the Triangle.

ATTORNEY PAUL J. DURHAM JOINS SHEEHAN PHINNEY BASS + GREEN
Sheehan Phinney Bass + Green is proud to announce that attorney Paul J. Durham has joined the firm as an associate.

Joseph DiBrigida, president and managing director of Sheehan Phinney Bass + Green, said the firm is committed to expanding its presence in the field of corporate law, including corporate, entertainment and media law. “Paul Durham has experience as an in-house attorney; he has worked in the firm environment as well running his own firm; and he has experience working in non-legal industries. Durham comes to Sheehan Phinney from his own practice, which he founded in 2005. Since 2004, he has taught undergraduate and MBA-level law and business courses at Southern New Hampshire University and Daniel Webster College. Before moving to New Hampshire, Durham was Senior Counsel at Playboy TV International, LLC, where he managed the international legal affairs of the pay television company and assisted executives in launching branded television networks around the world. He also served as an associate at the Miami law firm of Bilzin Sumberg Baena Price and Axelrod LLP.

Durham is a 1995 graduate from Boston University’s School of Management and received his J.D. from the Boston University School of Law in 1998. Durham is a member of the New Hampshire, Florida, Boston and American Bar Associations and is licensed to practice in New Hampshire, Massachusetts and Florida.

Experienced Employment/Labor Attorneys Ari Karen and Caryn Pass Join Venable’s Employment Practice in Washington
Venable LLP announced that experienced labor and employment attorneys Ari Karen and Caryn G. Pass have joined the firm as partners in the Washington office. Both Mr. Karen and Ms. Pass arrive from the Washington firm of Krupin O’Brien LLC; joining Mr. Karen and Ms. Pass are associates Heather Broadwater, Grace Lee, James Fagan, and Trevor Blake.

Mr. Karen, who had been head of Krupin’s litigation practice, defends employers on a wide variety of employment-related disputes, including discrimination, sexual harassment, wage and hour violations, whistleblower claims, non-compete and confidentiality agreements, and claims for breach of fiduciary duty and unfair trade practices. He has frequently represented clients in the financial services industry, particularly mortgage lenders, as well as clients in the hospitality sector.

Ms. Pass’s practice focuses on proactive and preventative counseling. In addition to the representation of both for profit and not for profit clients in the restaurant, accounting, government contractor, and association industries, she has developed an extensive client base and is recognized as one of the nation's leading attorneys in representation of independent schools. Ms. Pass and her team represent independent schools in the full menu of legal challenges. She has advised schools in matters ranging from faculty and employment contracts, and board governance and development, policies and procedures, tuition contracts and enforcement, and the safety, welfare, and discipline of students.

T&K Attorneys Receive Affirmed Appellate Opinion for Estate Client
The Fourteenth Court of Appeals affirmed a lower court's judgment awarding Thompson & Knight's client attorney's fees in David Mandell v. Jeanne Mandell, et al., No. 14-06-00031-CV.

The plaintiff, David Mandell, sued the Sam Field Estate for $1.5 million for allegedly breaching his first right of refusal in a 240-acre piece of property in northwest Harris County. The Estate sold its interest to William Mandell, the plaintiff's father and co-owner of the property, in 2003. The trial court threw out the lawsuit because David Mandell secretly conveyed a portion of his interest to his attorneys in 1998 and then denied doing so. The opinion is significant because it is rare for a court to award attorney's fees to a defendant.

Robert S. MacInytre Jr. and Kevin Pennell represented the Estate in the trial court, and David A. Furlow assisted in the appeal.
