EG&S WINS DISMISSAL OF DISCRIMINATION IN HOUSING CLAIM
On behalf of Luzerne County, EG&S successfully defeated a well publicized claim that the County violated the Fair Housing Act by refusing to grant a zoning use variance to allow a group home for recovering alcoholics. Plaintiff alleged that Luzerne County improperly acceded to public pressure in reaching its decision. Following discovery, EG&S argued to the United States Department of Housing and Urban Development (“HUD”) that Luzerne County’s zoning ordinance is facially non-discriminatory and was applied in a non-discriminatory manner to this proposal by Luzerne County. HUD agreed with EG&S, and dismissed this discrimination claim against Luzerne County.

CBLH Represents The State Of Delaware Before The United States Supreme Court
For the past 16 months, Connolly Bove Lodge & Hutz LLP has represented the State of Delaware in an original jurisdiction action brought by the State of New Jersey. The suit centers on British Petroleum’s (“BP”) proposal to build a liquefied natural gas facility partially in New Jersey which, if permitted, crosses into Delaware territory in the Delaware River. Although Delaware owns the land to the 1934 low water mark on the easterly half of the River within the area known as the twelve-mile circle, New Jersey’s suit claims that it has exclusive rights to regulate BP’s proposed liquefied natural gas facility – even though the pier for the facility is located in Delaware. Delaware’s coastal zone act prohibits BP’s proposed facility under Delaware law and Delaware has denied BP’s coastal zone application for the proposed facility.

On December 22, 2006, both Delaware and New Jersey moved for summary judgment in the case. Oral argument on the summary judgment motions will be held on February 22, 2007 in Philadelphia before Supreme Court appointed Special Master Ralph I. Lancaster. A decision from the Special Master is expected in the spring or summer of 2007.

Certilman Balin Names Two Partners
Certilman Balin Adler & Hyman, LLP has announced that effective January 1, James A. Rose (Smithtown,), who was formerly of counsel, and Gregory J. Pond (Port Washington) have been named partners in the firm’s Litigation Group.

Since 1998, James A. Rose has practiced law at Certilman Balin Adler & Hyman, LLP. As a Partner in the Litigation Practice Group, he represents clients in various matters including banking, securities, employment, business, real estate, commercial, personal injury and medical/dental malpractice. Mr. Rose also acts as counsel to many companies in the tri-state area regarding contract negotiations, business issues and disputes. Having litigated cases in both federal and state courts, he has significant trial and appellate experience. After graduating from Hofstra University in 1993, he went on to earn his law degree from the Touro Law Center in 1996, where he was a member of the Law Review. Mr. Rose serves on the Smithtown School District’s Industry Advisory Board and participates as a mentor in several different programs, including the LIKE (“Lawyers Involved in Kids’ Education”) program. He is a member of the Long Island Elite, a group of young professionals who give back to their community. A member of the New York State Trial Lawyers and Nassau County Bar Associations, Mr. Rose is admitted to practice in the State of New York, as well as the United States District Court, Eastern and Southern Districts.

Gregory J. Pond brings over two decades of diverse trial and litigation experience to the firm. His unique litigation practice is a culmination of years of advising clients in matters related to the probate and administration of estates, small business transactions and real estate matters. Mr. Pond understands the complex legal, business and personal issues that arise in estate planning, especially those involving closely-held businesses and succession planning. He also knows the problems that may occur in estate planning and administration matters, having litigated on behalf of clients in the areas of contested wills and accountings and other related estate litigation matters. In the past, Mr. Pond has also represented hundreds of clients in personal injury cases. Mr. Pond earned his Bachelor of Arts in History from St. John’s University and went on to graduate in 1983 from that university’s law school. A member of the New York State Bar Association, the New York Trial Lawyers Association, and the Nassau County Bar Association, he is admitted to practice in the State of New York; the U.S. District Court, the U.S. Court of Appeals for the Second Circuit; and the U.S. Supreme Court. Active in his community, Mr. Pond serves on the Board of Port Youth Activities.

Briggs Attorneys Named to L & P Top 40 List
Attorneys John M. Degnan and Jeffrey J. Keyes, both shareholders in the firm of Briggs and Morgan, Professional Association, are listed among Minnesota’s Top 40 Business Litigation Attorneys in the February/March 2007 issue of Minnesota Law & Politics.

John Degnan has practiced law in the Twin Cities for more than 30 years. As a member of Briggs’ business litigation section, he regularly represents clients in business disputes, as well as members of the legal and medical communities in professional matters. He also focuses his practice on medical malpractice claims, prescription drug and pharmacy matters, products liability and issues relating to the Emergency Medical Treatment and Active Labor Act (EMTALA) and the federal False Claims Act. He is frequently chosen as a mediator in business disputes and employment, commercial and injury cases.

John is a fellow of the American College of Trial Lawyers and the American Board of Trial Advocates. He has been repeatedly named a Minnesota Law & Politics “Super Lawyer” and one of the designation’s top 100. John is also a civil trial specialist certified by the Minnesota State Bar Association and the National Board of Trial Advocacy, and he is certified as a Minnesota Rule 114 neutral. He is a member of the International Association of Defense Counsel, the Defense Research Institute, the Academy of Certified Trial Lawyers of Minnesota, a board member of Creative Dispute Resolution and a master for the Warren E. Burger Chapter of the Inns of Court.

Jeff Keyes is a member of the trade regulation and franchise practice groups at Briggs, and practices principally in the areas of litigation, antitrust law, dealership and franchising law, and civil rights and civil liberties law. He is a nationally recognized lecturer and teacher on trial practice, franchising and antitrust issues, and an adjunct professor at William Mitchell College of Law.

Among Jeff’s accolades, he has been included in The Best Lawyers in America under Bet-the-Company Litigation and Commercial Litigation, as well as named Minnesota Lawyer’s 2005 Minnesota Attorney of the Year. He is a fellow of the American College of Trial Lawyers, chair of the Federal Practice Committee of the United States District Court for the District of Minnesota, member of the Civil Litigation Section of the Minnesota State Bar Association, and member of the Antitrust Section, Franchise Committee of the American Bar Association.

Jeff also serves as chair of Briggs’ Pro Bono Committee and has led the firm’s efforts in significant legal work for the disadvantaged. Under his direction, a team of Briggs’ attorneys successfully worked over 11 years to overturn the death penalty conviction of a Texas death row inmate. In 2005, Jeff argued the case of a Somali immigrant to the U.S. Supreme Court in the Somali deportation litigation.

Honigman to Open New Office in Ann Arbor; Expands Private Equity and Venture Capital Practice; David Parsigian to Join the Firm
Honigman Miller Schwartz and Cohn LLP today announced that the firm will open an office in Ann Arbor, Michigan in the first quarter of 2007. The office will provide a full range of business-related legal services and will be fully integrated with Honigman’s other offices located in Detroit, Bloomfield Hills and Lansing, Michigan. David N. Parsigian has joined the firm as Partner in the Corporate and Securities Department, effective Jan. 17, 2007, and will serve as Managing Partner of the new office.

“Ann Arbor is fast becoming the center of emerging high-technology and other industries. Honigman’s corporate, private equity and venture capital, mergers and acquisitions, real estate, tax, intellectual property, litigation and other business-related services uniquely position us to grow with the Ann Arbor economy,” said Alan S. In 2006, Parsigian was the Chairman of the Board of the Ann Arbor Area Chamber of Commerce.
