Litigation Partner Roberta A. Kaplan Advises Women Litigators on Finding Pathways to Success
Litigation partner Robbie Kaplan is quoted in the January issue of The American Lawyer concerning the obstacles faced by women litigators. In the article, Robbie recounts a story of how as junior associate she (unsuccessfully) tried to imitate the no-holds-barred cross-examination style of now-retired Paul, Weiss partner Marty London, only to "fall flat on my face." Robbie says that as a result, she quickly learned that as a woman litigator, she would have to develop her own distinctive courtroom persona that was different from that of her male counterparts. Buchanan’s Successful Reversal of Medicaid Ruling Noted in BNA's Health Law Reporter
ruling by the New Jersey Superior Court, Appellate Division, reversing an earlier ruling by the New Jersey Department of Human Services' Division of Medical Assistance and Health Services (DMA) was noted in the January 18, 2007, edition of BNA's Health Law Reporter. Attorneys Ivan J. Punchatz and Brian N. Rath filed the brief opposing the DMA. Punchatz is the head of Buchanan's New Jersey Health Care section, and Rath is a member of the Health Care section.

The court found that the cash value of three life insurance policies should not have been counted as available resources when calculating a potential Medicaid recipient's eligibility for New Jersey's Medicaid Only program. The court said that the policy owner's diminished mental capacity rendered the assets inaccessible under state law, and allowing the firm's client, Absecon Manor nursing home, to seek more than $100,000 as reimbursement from the state's Medicaid program.
