Issue of the Detroit Regional Chamber's online publication "Tips 4 Biz" featured an article written by Stephen Dunn. Titled "Finance: Your Liability for Unpaid Taxes," the article discusses the IRS's diligence when it comes to trust fund taxes withheld from employee's wages.

Keller and Heckman LLP Announces New Partner for 2007
Keller and Heckman LLP is pleased to announce that Rachida Semail has become a partner in the firm.

Ms. Semail, a member of the Paris bar, resides in our Brussels Office where she assists clients with EU food issues, as well as cosmetic, pharmaceutical, and medical devices issues. Her food and drug expertise includes assessment of the regulatory status of substances (novel foods, additives, and processing aids) and legal advice on marketing strategy under EU and national laws, including review of labels and registration of claims and assistance on genetically modified food and feed. Ms. Semail also works with global corporations in the areas of food supplements, fortified foods, contaminants, feedingstuffs, marketing of cosmetics, medicinal products, excipients, and medical devices, as well as handling product recalls.

Attorney Jennifer Lockshaw Named To Family Service Board
Jennifer E. Lockshaw, an attorney with the law firm of Harrington, Hoppe & Mitchell Ltd., was recently appointed to the board of trustees of the Family Service Agency for a four-year term.

Lockshaw, based in HHM’s Youngstown office, practices in the areas of corporate and business law, real estate law, probate law and estate planning. She earned her juris doctorate degree, magna cum laude, from the University of Akron School of Law and received her undergraduate degree from Youngstown State University.

Family Service Agency is a non-profit, multi-service counseling agency serving the greater Youngstown area since 1908. The agency provides family counseling, guardianship services, a youth crisis shelter, rape information, a case management program for people living with HIV/AIDS, and financial education.

Harrington, Hoppe & Mitchell Ltd. is the area’s largest law firm, with nearly 30 attorneys at offices in Youngstown, Warren and Salem. The firm provides comprehensive legal services to corporations, other businesses, non-profit organizations, government agencies and individuals throughout northeastern Ohio.

Michigan Bar Journal Article by Stephen Dunn on Family Limited Partnerships Used for Tax Avoidance
The December, 2006 issue of the Michigan Bar Journal included an article on family limited partnerships (FLPs). The article questions the ability of FLPs to achieve their tax avoidance objective in light of a growing cadre of adverse case law, and suggests alternatives.

Mr. Dunn leads the Kitch firm's tax practice. He is also a member of the Michigan State Bar committee, which published the Michigan Bar Journal, and served as editor of the December, 2006 tax law theme issue.

DAVID CAÑAS NAMED HARRIS GILBERT PRO BONO VOLUNTEER OF THE YEAR BY THE TENNESSEE BAR ASSOCIATION
The law firm of Harwell Howard Hyne Gabbert & Manner, P.C. ("H3GM") announces that one of its partners, David P. Cañas, has been named the Harris Gilbert Pro Bono Volunteer of the Year by the Tennessee Bar Association. Nominated by the Tennessee Justice Center and H3GM, David will be officially recognized on January 13, 2007 at the Tennessee Bar Association's Public Service Awards Luncheon.

This honor is the result of David Cañas's pro bono work helping a young lady named Megan in a dispute against Tenncare. Megan, who suffers from cerebral palsy, is unable to walk and needs assistance communicating. Megan's doctor and speech therapist prescribed a specific speech communication device as a medical necessity that would allow her to communicate on her own as she entered college. TennCare and its managed care organization (MCO) denied the request for the speech device, instead approving a different device that was much harder to use.

Following the denial of the speech communication device, Megan's parents sought the help of the Tennessee Justice Center, which subsequently asked David Cañas for help. David's work preparing for an administrative hearing resulted in TennCare's approval of the device originally prescribed by Megan's doctor and speech therapist. Today Megan is enrolled at MTSU and is enjoying successes that would not have been possible without the speech device that David Cañas helped her receive.

Business Tennessee Recognizes Craig Gabbert and Mark Manner in its Best 150 Lawyers 2007
Two H3GM attorneys were honored in Business Tennessee's 150 Best Lawyers. Craig Gabbert was recognized for his work in business bankruptcy, citing his representation of debtors in Chapter 11 cases such as Pen Holdings' and Symphony Healthcare. Mark Manner was recognized in the healthcare (transnational) category. The magazine recognized Mark's expertise in biotechnology and his representation of other healthcare companies as a reason for this honor.

Atty. Catino featured on CBIA Business Minute
Attorney Ann M. Catino, chair of the Environmental and Land Use Practice Group was recently featured on several segments of the Connecticut Business and Industry Association’s Business Minute. Attorney Catino is Co-chair of the Brownfields Task Force which will be sending the Connecticut State Legislature a report on the rehabilitation and use of Brownfields sites this winter.

In these radio broadcasts, Ms. Catino explained what Brownfields are, and the challenges presented by these properties and the additional complications when the properties are considered for redevelopment. There are thousands of Brownfields sites in Connecticut and the revitalization of them can add enormous value towns and communities throughout the state. Brownfields redevelopment is part of a smart growth strategy, which involves positioning a business development near transportation corridors and utilities. Strategies implemented when rehabilitating Brownfields sites includes DEP remediation standards that set forth the level of clean up required for any site.
