Federal Circuit Upholds Judgment in TriStrata’s Patent Infringement Case Against Mary Kay
the United States Courts of Appeals upheld a judgment against Mary Kay Inc. in excess of $41 million. The case was heard by the Federal Circuit on Tuesday, January 9, 2007, and the court summarily affirmed the judgment the following day.

In March 2005, a jury found that Mary Kay infringed several patents owned by TriStrata Technology Inc. related to alpha-hydroxyacid (AHA) skin care technology and awarded TriStrata more than $26 million in damages. On March 31, 2006, the U.S. District Court for the District of Delaware issued final judgment affirming the jury verdict and granting prejudgment verdict interest to TriStrata. The Court also granted TriStrata’s motion for a permanent injunction enjoining Mary Kay against making or selling the infringing products. With interest, the total award amounted to more than $41 million.

"We are extremely pleased that the Federal Circuit ruled with such dispatch on the appeal," said Michael V. Ciresi, chairman of Robins, Kaplan, Miller & Ciresi L.L.P. and co-lead trial counsel for Tristrata. "It is consistent with our view that the jury’s determination was absolutely correct."

"TriStrata has developed pioneering technology. This case illustrates the importance of the patent system in protecting such technology," said Jan M. Conlin of Robins, Kaplan Miller & Ciresi L.L.P., co-lead trial counsel.

TriStrata is a wholly-owned subsidiary of NeoStrata Company, Inc., a research-based dermatological company.

Potter Anderson & Corroon’s Kathleen Furey McDonough Receives Caleb R. Layton, III Service Award from the U.S. District Court for the District of Delaware
Potter Anderson & Corroon LLP partner Kathleen Furey McDonough has received the Caleb R. Layton, III Service Award, awarded by the judges of the U.S. District Court for the District of Delaware in recognition of her service to the Court and the Bar of the Court.

The annual award is given to those who personify the qualities of a federal practitioner: legal acumen, professional decorum, and public service. It is named for the late Caleb R. Layton, III, who served as a resident judge of the Superior Court of New Castle County for 10 years before being appointed U.S. District Court Judge for the District of Delaware.

U.S. District Court Judge Gregory M. Sleet presented the award to McDonough during a ceremony in which he praised her skill as a lawyer and her outstanding contributions to the Court and its Bar, noting her work as chair of the U.S. District Court Advisory Committee.

“This is a high honor for Kathleen and we are extremely proud of her,” said Potter Anderson’s Chairman, David B. Brown. “We at the firm, along with Kathleen’s clients and professional colleagues, know from long experience of her extraordinary dedication to community service and her superb skill as a lawyer, but it is gratifying to see her recognized and honored in this public way.”

McDonough founded and heads the Labor and Employment practice group at Potter Anderson & Corroon LLP and represents management clients in a full range of disputes. She also counsels a number of secondary and post-secondary institutions with respect to employment and education law issues. She serves as counsel to clients on all aspects of personnel policies and practices, with a strong emphasis on litigation avoidance. McDonough regularly represents employers in both federal and state court. She received her J.D. from Temple University School of Law and a B.A. from Saint Joseph’s University.

Paul Ayoub appointed co-chair of Greater Boston Chamber of Commerce Development Committee
Paul Ayoub, partner in the Land Use, Permitting and Development, was appointed co-chair of the Greater Boston Chamber of Commerce Development Committee in January. He is member of the Chamber’s board of directors and also serves on the Government Affairs Committee and Housing Task Force.

The Development Committee’s mission is to promote the development of buildings, land and open space in ways that maximize job creation and quality of life.

Mayer, Brown, Rowe & Maw Government Procurement Expert Calls for Federal Acquisition Reforms at Capitol Hill Hearing
Mayer, Brown, Rowe & Maw government procurement law expert Marcia Madsen told a U.S. Senate Subcommittee today that more competition, greater use of commercial buying practices and strengthening the federal acquisition workforce are among keys to ensuring that taxpayers and government are better served when the government buys goods and services.

Madsen, a partner in Mayer Brown's Washington office and expert in government procurement law, testified before the Subcommittee on Readiness and Management Support of the Senate Armed Services Committee in her capacity as chair of the Acquisition Advisory Panel (AAP). The Panel was established by Congress in 2003 to review government procurement practices and recommend ways the federal government could improve the way it buys goods and services from the private sector. Its draft final report was issued in December.

Madsen told the Subcommittee that injecting greater competition into government contracting must be a top priority, given that as much as one-third of the government's annual acquisition spending has not been competitively bid in recent years - at a time when government purchases have risen sharply.

"With federal procurement spending approaching $400 billion annually and the serious and competing demands on taxpayer dollars, an accountable and transparent acquisition system that delivers innovative, high-quality goods and services is critical to our national interests," Madsen told the Subcommittee .

During its 18-month review, the Acquisition Advisory Panel tracked major trends in federal procurement, finding that in 2004, 32 percent of the $338 billion in federal government contracts were not competitively bid. Even when there was competition, 20 percent of the dollars were awarded in situations where only one offer was received.More than one-fourth of total contracts were also sole-sourced in 2005.

Madsen urged administrative or congressional action on many of the Panel's 80 recommendations aimed at making the federal government a better consumer and steward of taxpayers' dollars. Chief among those recommendations are ones designed to increase competition among private companies seeking government business.

"The commercial sector relies on competition to obtain fair prices and quality service and government needs to do the same. Competition fuels innovation, drives fair prices, disciplines the responsible, effective use of streamlined acquisition vehicles, and improves opportunities for small business participation," said Madsen.

Madsen also testified that the state of the federal acquisition workforce is troubled. There is a significant mismatch between the demands placed on the acquisition workforce and the personnel and skills available to meet those demands. The acquisition workforce has declined by 50 percent since the mid-1990s. At the same time, the Panel found that since 9/11, annual federal procurement spending shot up 63 percent, from $234 billion to $382 billion in FY2005.
