Butzel Long attorney Jack D. Shumate to be featured on panel discussion at Michigan Association of Environmental Professionals event
Butzel Long senior attorney Jack D. Shumate will be featured in a panel discussion at the Michigan Association of Environmental Professionals event on October 1, 2007 in Brighton. The panel presentation is titled, "Duty to Investigate Urban Soil Conditions" with a special emphasis on environmental concerns in redevelopment of urban properties.

Based in Butzel Long's Bloomfield Hills office, Mr. Shumate concentrates in environmental law, natural resources, insurance coverage matters and appellate law. Mr. Shumate is the firm's Senior Environmental attorney. He has been engaged in all aspects of environmental law for more than 30 years. Currently, his environmental practice is focused on investigation and cleanup of Superfund sites throughout the country, pre-acquisition property investigations, environmental aspects of major real estate and corporate transactions, Brownfield redevelopment, and environmental litigation.

Mr. Shumate has a broad background in real estate and corporate transactions and related litigation and legislative relations. Prior to joining Butzel Long, he worked in the Corporate Legal Department of Consumers Power Company. His duties in that position included licensing, investigation, and closure and re-use of the company's coal ash landfills, including resolving heavy metals issues. He has represented subsidiaries engaged in exploration and development of oil, natural gas, and uranium. He also has served as a legal and legislative advisor to the Governor of Ohio.

Mr. Shumate is one of 23 attorneys from across the United States and the only Michigan lawyer who have founded the American College of Environmental Lawyers. The College will recognize the achievements of outstanding environmental attorneys and focus their efforts to enhance the practice of environmental law.

Mr. Shumate is an active member, and past Chairperson, of the Real Property Law Section of the State Bar of Michigan. He is a frequent author and lecturer on real estate and environmental topics, and has served as an expert witness concerning environmental and attorney malpractice issues. He is listed in The Best Lawyers in America.

BC Attorney to Participate in Panel at ABA Joint Meeting
Bryan Cave LLP New York Counsel Alan Appel will join some of the country’s leading attorneys and government officials Sept. 27-29 to examine the latest policies, initiatives and regulations related to taxation and property. Appel and others from the ABA’s Section of Taxation and Section of Real Property, Trust and Estate Law will meet in Vancouver, B.C., for their joint fall CLE conference.

Saturday, Sept. 29, Appel joins a panel discussion on the choice of entity ownership in cross-border real estate investment transactions. They also will discuss the fifth protocol to the U.S.-Canada Income Tax Treaty that was signed Sept. 21. The protocol radically changes investments between the U.S. and Canada.

Appel is vice chair of the ABA Section of Taxation’s U.S. Activities of Foreigners and Tax Treaties Committee. At Bryan Cave, he focuses his practice in domestic and international tax planning involving taxation of mergers and acquisitions, partnerships, joint ventures, limited liability companies and tax controversy matters. On behalf of the ABA Tax Section, Appel had primary responsibility for drafting and submitting comments to the U.S. Treasury Department and IRS concerning the scope of the guidance provided by the proposed regulations under Section 1446 of the Internal Revenue Code.

A frequent author on tax topics, Appel has appeared on both radio and television discussing various income tax issues and is a member of the adjunct tax faculty of the New York Law School.

David Frick Returns To Baker & Daniels
David R. Frick has joined Baker & Daniels LLP where he will concentrate on a corporate practice.

Frick recently retired as Executive Vice President and Chief Legal and Administrative Officer for WellPoint, Inc., the nation's largest health insurance company. He serves on numerous Boards of Directors and is Chairman of the Indiana Stadium and Convention Building Authority, which is responsible for the construction of the new 63,000-seat stadium and expansion of the Indiana Convention Center.

SQUIRE SANDERS ENHANCES UK REAL ESTATE CAPABILITY
Global law firm Squire, Sanders & Dempsey L.L.P. has announced that real estate expert James Vernon-Stroud has joined the firm’s London office as a senior associate from Eversheds LLP.

Vernon-Stroud has advised developers, investors, multinational owner/occupier corporations, listed companies and pension funds. Notably, he has acted for the largest supplier of self-storage accommodations in Europe in its purchase by public-to-private means, dual refinance over its international portfolio, acquisition of new build stores, portfolio management on a day-to-day basis and flotation exit by its majority-owning venture capital fund. He has also advised national pub chains on various investments and disposals.

This hire further demonstrates the firm’s commitment to expanding its London office, with the hire of Roderick J. Cowper, a prominent litigator and international dispute resolution lawyer, also being announced this week. Cowper, who joined the firm from Bryan Cave LLP, and will head up the firm’s London litigation practice. Cowper’s hire was preceded by the hire of Tomasz Z. Ujejski in July, the former head of Baker & McKenzie’s Warsaw office. Ujejski is based in London and represents clients with business interests in Central Europe.

The firm continues to support this expansion with the hire of associates across a range of areas including, in recent months, corporate finance (Manmohan S. Panesar – Pinsent Masons), employment (Diane E. Mills – Howard Kennedy) and litigation (Alison M. Bradley – Campbell Hooper).

Andrew O. Visintin, head of the firm’s London office, said: “In 2006, the London office doubled in size with the addition of lawyers from Haarmann Hemmelrath. We are making significant strides in our commitment to again double the size of our London office. We are actively recruiting top talent and look forward to announcing further high profile appointments in the coming months.”

This is the latest in a slew of recent hires for the firm’s European real estate practice, following, most recently, the announcement earlier this month that a team of real estate lawyers from LeBoeuf, Lamb, Greene & McRae LLP had joined Squire Sanders’ Moscow office. The team includes Dmitry A. Kunitsa, the former head of real estate at LeBoeuf, who now heads up Russian real estate at Squire Sanders. As a result of these hires, the firm’s Russian real estate team has doubled in size.

Daniel E. Larkin, the firm’s joint head of real estate in Europe, said: “Vernon-Stroud is a high-calibre lawyer with an intimate knowledge of the UK property market and a strong track record. His hire is part of our plan to further penetrate the UK market and extend our capacity to provide a full range of legal services to real estate clients in the UK and throughout the region.

“We plan to retain and enhance our well-earned position as one of the leading real estate legal teams in Europe by enhancing our capability in London, Europe’s largest financial centre,” Larkin added. “Real estate finance remains a serious growth area for the firm. Over the years our practice has established a solid reputation throughout Western, Central and Eastern Europe, with particular emphasis on the financing of major real estate projects. Our experts from Frankfurt right across to Moscow are heavily involved in advising on significant real estate developments including providing counsel to investors and financial institutions such as German open-end funds, Irish investors and the large US investment funds.”

Attorneys Elected to the Hastings 1066 Foundation Board of Trustees
Sedgwick, Detert, Moran & Arnold LLP announced that the University of California Hastings College of the Law has elected Sedgwick attorneys David Eligator and Amber Rye Brumfiel to the Hastings 1066 Foundation board of trustees. The 1066 Foundation raises funds to maintain and elevate Hastings' academic excellence, made increasingly critical by the state's dramatic reduction in financial support. Hastings selected Eligator and Brumfiel for their professional prominence, and their commitment to advancing the school's academic standing.

"The 1066 Foundation enables Hasting to fulfill its commitment to excellence by providing scholarships, recruiting exceptional students, funding academic programs, student publications, and more," said Brumfiel.

"I'm excited to help harness the power of our incredible community of Hastings alumni," added Eligator.

Sedgwick's more than 40 Hastings alumni continue to offer the school financial and professional support, including Sedgwick Partner Rebecca Hull who served as the 1066 Foundation's President.

A member of the Hastings class of 1994, Eligator focuses on all aspects of construction. He represents contractors, developers, engineers, architects and property owners in construction defect actions and commercial disputes involving allegations of negligence, breach of warranty and breach of contract. He also represents manufacturers and suppliers of construction-related products in claims relating to alleged product failures. In addition to serving as a Foundation trustee, he on the Board of Directors of the San Francisco Court-Appointed Special Advocates Program (SFCASA), a non-profit organization that advocates for abused and neglected children in San Francisco's foster care system. Eligator graduated from Brown University with a degree in urban studies. While at Hastings, he was admitted to the Thurston Honors Society.

A member of the Hastings class of 2001 and the board's youngest member, Brumfiel litigates a wide range of commercial disputes, including patent infringement, trade secret misappropriation, unfair competition, contract issues and torts. She has significant experience handling real estate litigation, including prosecuting and defending eminent domain actions, commercial landlord-tenant matters and title issues. Brumfiel is also an active member of the Commercial Real Estate Women. She graduated cum laude from the University of California, Los Angeles, and during her time at Hastings, Brumfiel was the senior managing editor of the Hastings Law Journal.

Paralegal Erin Clogston Joins McAfee & Taft
Erin Clogston has joined the law firm of McAfee & Taft, where she provides paralegal support for attorneys engaged in commercial litigation, labor and employment counseling and litigation, and a broad range of commercial transactions, including bankruptcy, debtor-creditor rights, banking, real estate, and oil and gas law. Her responsibilities include preparing and filing pleadings with the courts, coordinating depositions and mediations, organizing documents and preparing for trial.

Clogston began her career in 2001 as a legal assistant and previously worked in the areas of general commercial litigation, insurance defense and foreclosure litigation before joining McAfee & Taft.

The Norman, OK, native graduated with a certificate in legal office administration and paralegal studies in 2001 and is a member of the National Association of Legal Assistants.

King & Spalding Earns Preemption Victory for GlaxoSmithKline
King & Spalding, a leading international law firm, has earned a significant victory for client GlaxoSmithKline in a failure-to-warn product liability case. A federal district judge on September 19 granted summary judgment in the case (Tucker v. SmithKline Beecham d/b/a GlaxoSmithKline) and dismissed, with prejudice, all claims made by the plaintiff.

Judge David F. Hamilton, of the United States District Court for the Southern District of Indiana, dismissed the case on the grounds that approval by the U.S. Food & Drug Administration of the prescribing information for an antidepressant pharmaceutical product preempted any failure-to-warn claim under state law. This decision could potentially lead to the dismissal of similar pharmaceutical and medical device cases.

The King & Spalding team representing GlaxoSmithKline consisted of product liability partners Chilton Davis Varner, Andy Bayman, Todd Davis and Frank Coan, and FDA/Healthcare partner Mark Brown, along with associates Nicole Taylor and David Norden.

Varner, widely considered one of the nation’s top product liability litigators, was appointed by the late Chief Justice Rehnquist to the Federal Civil Rules Advisory Committee in 2004, where she assisted in drafting new electronic discovery provisions. Brown, a former Associate Chief Counsel with the FDA, is recognized as one of the nation's most experienced lawyers on a wide range of FDA issues in pharmaceutical and medical device litigation.
