Michael Oxley, Former U.S. Congressman, Joins Baker Hostetler
Baker Hostetler LLP announced today that former U.S. Representative Michael G. Oxley will join the firm as Of Counsel, based in its Washington, D.C., office, effective March 12. He will serve existing firm clients as well as develop his own public policy practice in the areas of corporate counseling, financial services and capital markets.

Mr. Oxley, who retired from Congress in January after a 25-year career representing Ohio’s Fourth Congressional District, is best known for his co-authorship of the landmark Sarbanes-Oxley Act of 2002, which restored Americans’ confidence in the capital markets following the corporate scandals and created a new accounting oversight board for publicly traded companies.

Alec Wightman, who serves with Steve Kestner as Executive Partners of the firm, said, "The addition of former Congressman Mike Oxley to our Government Policy team gives us a new and unique ability to counsel our clients. He is one of the nation’s leading authorities on corporate governance. Mr. Oxley will help corporate clients assess and avoid risk while assisting clients in internal investigations and litigation, as needed. And, he will continue to play a prominent role in shaping public policy in the area of financial services and proper conduct by public corporations."

He joins Baker Hostetler’s Government Policy Group, which represents multinational and corporate clients seeking to resolve or avert problems related to federal and/or state policy through legislative or administrative solutions. The team includes former members of Congress, a former U.S. Ambassador, senior executive branch officials and state legislators.

He will also support the firm’s premier White-Collar Defense and Corporate Investigations Practice, which represents clients involved with complex white collar crime, regulatory investigations and litigation. They have represented top tier banking and investment firms by establishing monitorship programs in conjunction with government regulators in accordance with best practice standards. Their team for all matters includes nationally recognized former prosecutors from the United States Department of Justice, former state prosecutors, “trial tested” defense attorneys and enforcement officials from various federal agencies (including the SEC’s Division of Enforcement).

From 2001 through 2006, Mr. Oxley served as chairman of the House Financial Services Committee, which in 2001, consolidated the jurisdiction of all financial services industries in one panel for the first time in the history of the House. The Committee’s scope includes banking, insurance, securities and exchanges and monetary policy.

While in Congress, Mr. Oxley backed pro-business, low-tax, pro-competition and free-trade positions as the best policy atmosphere to support strong economic growth. He is a well-known advocate for free trade agreements and international business engagement and has consistently backed the nation’s law enforcement and intelligence communities in their fights against drugs, crime and terrorism.

Mr. Oxley helped shape legislative policy across a wide array of issues. A member of the House Energy and Commerce Committee from 1983 to 2001, he is well-known for his knowledge of federal telecommunications and energy policy. Prior to his election to Congress in 1981, Mr. Oxley was a special agent of the FBI and a member of the Ohio General Assembly. Previously, he practiced law with the firm Oxley, Malone, Fitzgerald and Hollister.

Also joining Baker Hostetler are two former aides, James K. Conzelman and Peggy A. Peterson, who will support Mr. Oxley in the growth of his practice.

Mr. Conzelman was Mr. Oxley’s chief of staff throughout his congressional career, serving in the position from 1981 through 2006. On the Financial Services Committee staff, Mr. Conzelman was counselor to the chairman from 2001 to 2006. Ms. Peterson served as Mr. Oxley’s press secretary since 1988. In 2001, she was named communications director of the Financial Services Committee, and in 2003 she also assumed the Committee’s deputy chief of staff responsibilities.

New Supreme Court Decision Allows for a Patent Licensee in Good Standing Can Challenge Licensed Patent under Declaratory Judgment Act
The law of litigating a licensed patent was recently clarified for licensees who wish to challenge a licensed patent without risk of treble damages. On January 9, 2007, the Supreme Court held in Medimmune Inc. v. Genentech that a patent licensee need not necessarily terminate or break a license by not paying the royalties due in order to seek a declaratory judgment that the licensed patent is invalid, unenforceable, or not infringed.

No Jurisdiction Over Foreign Patent Claims
The Federal Circuit recently held that a U.S. district court did not possess subject matter jurisdiction over infringement claims under foreign patents. In Voda v. Cordis Corporation, the Federal Circuit declined to allow the exercise of supplementary jurisdiction over foreign patent claims and concluded that exercising such jurisdiction would constitute an abuse of discretion under 28 U.S.C. § 1367(c).
