David J. Lindner of Buckingham, Doolittle & Burroughs, LLP Appointed to Board of Directors of Heights Parent Center
The law firm of Buckingham, Doolittle & Burroughs, LLP (“BDB”) is pleased to announce that David J. Lindner has been appointed to the Board of Directors at Heights Parent Center for a three-year term. Mr. Lindner is an Associate in BDB’s Cleveland office and represents owners, developers, contractors and governmental entities in all facets of residential and commercial real estate, including acquisition and disposition, financing, development, leasing, zoning, and condominium law. He has been recognized as one of Ohio’s Super Lawyers-Rising Stars™, in the 2006 Cincinnati Magazine, as voted by his peers.

Heights Parent Center’s mission is to support and promote the healthy development of families and children in the belief that strong families build strong communities. The organization is a unique, non-profit family education, resource and support center open to all families.

Mr. Lindner earned his J.D. at The Ohio State University Moritz College of Law where he served on the Ohio State Law Journal Managing Board (2000-01) and was a Staff Member (1999-2000); and received the CALI Excellence for the Future Award in Real Estate Finance. He also earned his B.A. in English, magna cum laude, from The Ohio State University. He is a member of the American, Ohio State and Cleveland bar associations.

Mr. Lindner resides in University Heights, Ohio with his wife, Maureen, and two daughters.

Paul Hastings Awarded "North American Portfolio Financing Deal of the Year 2006" By Project Finance Magazine
Paul, Hastings Janofsky & Walker LLP, a leading international law firm, is pleased to announce that the firm was awarded Project Finance Magazine's "North American Portfolio Financing Deal of the Year 2006" for its innovative work representing Sumitomo Mitsui Banking Corporation in connection with the acquisition of CalPeak Power by Tyr Capital and Starwood Energy Group Global. The award was announced in the magazine's February 2007 issue.

Paul Hastings Global Projects Group represented Sumitomo Mitsui Banking Corporation (SMBC), in acting as sole lead arranger in connection with the financing of the acquisition by Tyr Capital and Starwood Energy Group Global of CalPeak Power and its portfolio of five natural gas-fired simple cycle power plants with a combined capacity of over 250 MW from United Technologies. Project Finance Magazine hailed the deal as "an innovative twist on the B loan structure" that "combines the residual skills of big-ticket lease arranging with project debt and is certain to find new takers."

This recognition is another achievement that demonstrates the capabilities of the Paul Hastings' Global Projects Group.

Fulbright Partner Mark Baker Appointed To Special CEDR Commission
Fulbright arbitration co-leader and partner Mark Baker has been appointed to serve as a member of International Dispute Resolution Centre (CEDR) Commission on Settlement in International Arbitration.

Baker will be one of a group of leading international arbitrators, academics, mediators and counsel from different jurisdictions on the CEDR committee charged with investigating different approaches to settlement within the framework of international arbitration proceedings.

Baker is also co-chair of both Fulbright's international practice and its renowned arbitration practice. He has arbitrated before many of the world's arbitral bodies and has been involved in numerous alternative dispute resolution procedures.

He is frequently selected to serve as an arbitrator on domestic and international arbitration panels. In every year since 1998, he has chaired at least eight significant arbitration cases. He also led Fulbright’s $19 billion Yukos Oil arbitration.

Baker is on the American Arbitration Association’s board of directors and is a Court Member and arbitrator for the London Court of International Arbitration. He has also served as a panel arbitrator for the USA Track and Field and the American National Governing Body for Track & Field. Earlier this year, he was named one of the Most Influential Lawyers in America by the National Law Journal and one of the top 20 international arbitration experts by Practical Law Company.

CEDR is an independent non-profit organization supported that encourages and develops mediation and other cost-effective dispute resolution and prevention techniques in commercial and public-sector disputes.

Cozen O'Connor Member Christopher B. Kende Presents at UIA Winter Seminar
Cozen O’Connor member Christopher B. Kende recently spoke on “Representations and Warranties on Environmental Risks” at the 2nd Annual Union Internationale des Avocats (UIA) Winter Seminar. The seminar focused on “Representations, Warranties and Indemnifications in M&As – Pitfalls and Best Practices for Structuring as Well as Litigating and Arbitrating Them,” and was held in Sestriere, Italy. Participants in the seminar included M&A specialists from the U.S., Germany, Italy, Spain, France, Switzerland, Portugal and India. The presentations covered subjects ranging from the legal issues governing warranties and representations to litigation, mediation and international arbitration regarding disputes in mergers and acquisitions.

Resident in the New York Downtown office, Kende chairs the firm’s international insurance practice and co-chairs the reinsurance practice. He has more than 25 years experience handling major complex multinational litigation in the areas of insurance, reinsurance, environmental law and admiralty and maritime disputes.

Throughout his career, Kende has acted on behalf of many French organizations, including his successful representation of the French government in the Amoco Cadiz oil spill litigation, involving the largest shoreline pollution in history, as well as the Fédération Française des Sociétés d’Assurance (the French Federation of Insurance Companies), the French Ship Classification Society, Bureau Veritas and several French shipowners. Kende has also acted for several major carriers in asbestos and hazardous waste site coverage cases and also acts for several large foreign reinsurers in connection with matters ranging from advice on treaty wording to litigation and arbitration involving first party property insurance, reinsurance of complex financial products, insurance-backed film financing, catastrophic business interruption losses, cargo and hull cover and health and medical reinsurance.

The author of several reference works on marine pollution, as well as numerous articles for French and American periodicals and law reviews on the subject of limitation of liability, insurance, reinsurance and pollution legislation in the United States, Kende also wrote the chapter on U.S. Law of Insurance in the Encyclopédie de l’Assurance, a seminal reference work on world insurance law. In addition, he is the author of the chapter on Oceans and Coasts of the Matthew Bender publication, Environmental Law Practice Guide. An adjunct professor of maritime law at Brooklyn Law School in New York, Kende is often a frequent lecturer at bar association conventions, seminars and continuing education programs in his fields of expertise, and is fluent in French.

Kende is a past member of the maritime law committee of the Association of the Bar of the City of New York and a current member of the foreign and comparative law committee of that organization. He is past president of both the Maritime Law Committee of the New York County Lawyers Association and the Admiralty and Maritime Law Commission of the UIA. He is president of the Insurance Law Commission of the UIA and serves on the International Organizations, Conventions and Standards Committee of the Maritime Law Association of the United States. He is licensed to practice in California, the District of Columbia, Massachusetts and New York.

A resident of New York, Kende earned his undergraduate and graduate degrees from Brown University (B.A., 1970; M.A., 1970) and his law degree from New York University School of Law (J.D., 1973).

Cozen O'Connor Attorney H. Robert Fiebach Presents at 2007 Legal Malpractice and Risk Management Conference
Cozen O’Connor member H. Robert Fiebach recently spoke on “Transactional Law – Issues on the Periphery” at the 2007 Legal Malpractice and Risk Management Conference.

Held in Chicago, Ill., the conference dealt with important developments in malpractice claims, legal malpractice insurance and risk management strategies. Fiebach’s presentation focused on transactional lawyers, who are often the subject of complex and financially significant legal malpractice cases. Topics within his presentation included how mergers, sales and bankruptcy affect who can sue a transactional lawyer and upon what theories, whether lawyers can be liable for failing to provide business advice, and liability with regard to non-clients for negligent misrepresentation and ordinary negligence.

A member in the Philadelphia office, Fiebach concentrates his practice on business litigation matters. He practices in a number of groups, including professional liability, corporate disputes and shareholder claims, and securities litigation.

Fiebach is a fellow of the American College of Trial Lawyers and a past president of the Pennsylvania Bar Association, Pennsylvania Bar Institute and the Pennsylvania Bar Trust. He serves as both a state delegate and member of the house of delegates for the American Bar Association, is a member of the Philadelphia Bar Association and recently served on the Mayor’s Task Force on Gaming.

Fiebach is listed in Who’s Who in America, Who’s Who in American Law and The Best Lawyers in America. He was also named as a Pennsylvania Super Lawyer by Philadelphia magazine. He has authored numerous articles on professional liability.

A resident of Philadelphia, Fiebach earned both his undergraduate degree (B.A., 1961) and his law degree (LL.B., cum laude, 1964) from the University of Pennsylvania, where he was research editor of the University of Pennsylvania Law Review and a member of the Order of the Coif. Fiebach is admitted to practice in Pennsylvania, and before the U.S. Supreme Court and the U.S. Court of Appeals for the Second, Third and Fourth Circuits.

Covington’s Pro Bono Legal Effort Leads to Historic Reform of Virginia’s Indigent Defense System
Covington & Burling’s effort to improve the quality of indigent defense in Virginia yielded results last week when the General Assembly approved landmark legislation permitting judges to waive the unreasonably low, mandatory caps on legal fees paid to lawyers representing poor criminal defendants in Virginia’s circuit courts. Under the previous system, attorneys representing indigent defendants charged with a felony punishable by life imprisonment could be paid only $1,235; and defendants facing a felony charge carrying a sentence of up to twenty years could be paid only $445.

For many years, the caps had been criticized as encouraging a “meet and plea” routine of processing criminal cases that denied poor defendants their constitutional right to meaningful and effective assistance of counsel. Despite repeated calls for reform, the caps remained in place, earning Virginia the reputation as the worst indigent defense system in the country.

Working with its pro bono client, the National Association of Criminal Defense Lawyers (NACDL), Covington spearheaded a multi-year effort to make the constitutionally guaranteed right to counsel a meaningful reality in Virginia. Covington initiated and supported a statewide study documenting the pernicious effects of the caps on the quality of legal representation, mounted a legislative and educational campaign, and prepared the class action lawsuit that ultimately persuaded Virginia's Republican Attorney General to join with its Democratic Governor to push through the reforms enacted this year.

“Covington’s legal prominence and commitment to the cause of equal justice were instrumental to securing passage of this historic reform,” said Steve Benjamin, a NACDL Board member and nationally known criminal defense lawyer based in Richmond.

The Covington team includes John Hall, Sarah Wilson, Josh Carpenter, Brent Starks, Hope Hamilton, Jodi Steiger, Dan Suleiman, and Virginia Desilets.

Covington Advises Major League Baseball on Launch of MLB Channel
Major League Baseball announced the launch of the MLB Channel today in connection with its seven-year agreement with DIRECTV to carry the MLB EXTRA INNINGS subscription package of out-of-market games. DIRECTV will be a minority partner in the MLB Channel, and will work with MLB to develop the new network. Scheduled to launch in 2009, the MLB Channel will be the first and only network dedicated to providing baseball programming to MLB fans 24 hours a day, seven days a week on a year-round basis.

Covington & Burling LLP advised MLB on the MLB Channel transaction. Washington corporate lawyers Doug Gibson and Peter Zern led the Covington team, with Andy Friedman in Washington and Rob Heller in New York providing the tax advice.
