Robinson & Cole Lawyers Participate in Northeast Black Law Students Convention
Robinson & Cole was a sponsor of the Northeast Black Law Students Association’s Northeast Regional Convention held February 21 – 25 in Hartford. The event included the Frederick Douglass Moot Court Competition, a mock trial event, and a number of educational and social programs. Robinson & Cole Business & Public Finance lawyer Kevin J. Rasch was the keynote speaker at the luncheon on Friday. Robinson & Cole lawyers David W. Bogan, Joey Lee Miranda and Ndidi N. Moses judged portions of the mock trial or moot court competitions.

Paul Hastings Advises Catalina Marketing Corporation in $1.7 Billion Buyout By ValueAct Capital
Paul, Hastings, Janofsky & Walker LLP, a leading international law firm, announced today that it represented Catalina Marketing Corporation (NYSE:POS) in a $1.7 billion buyout by ValueAct Capital.

The transaction is expected to close in the next several months and is subject to the approval of the company's stockholders, regulatory approvals and other customary closing conditions. There is a 45-day window for other bidders to make competing offers.

The Paul Hastings team was led by partner Barry Brooks and included partners Kevin Logue, Michael Zuppone, Michael Chernick, Joseph Opich and J. Mark Poerio and associates Michael Cormack, Randy Merkelson, Jay Dubiner and Karoline Hinga.

Fulbright Partner Named FAA's Chief Counsel
President George W. Bush has appointed Kerry B. Long, a partner in the Washington office of Fulbright & Jaworski, as Chief Counsel of the Federal Aviation Administration.

Long, who has more than 20 years of experience in airline industry transactions, will oversee a 190-lawyer organization that advises the agency and its administrator.

A commissioned officer in the U.S. Navy during the Vietnam era, Long welcomed the opportunity to return to government service. He continues an honored tradition of government service by Fulbright attorneys.

"Since Fulbright's beginnings, public service has been a cornerstone," Long said. "I am humbled to have the opportunity to continue that tradition of service in the Bush administration."

During his time at Fulbright, Long made numerous contributions to the firm's transportation practice group, which covers the full range of federal regulatory agencies having jurisdiction over transportation modes and facilities.

"The FAA has gained a great lawyer with tremendous judgment who is capable of handling the most challenging of issues," said James D. Tussing, the head of Fulbright's Equipment Finance Practice Group. "Kerry's work for Fulbright's clients has involved many complex legal matters related to the airline industry and prepared him well for one of the most demanding legal jobs in Washington."

Long's work at Fulbright continued a deep transportation tradition that dates all the way back to the firm' co-founders.

R.C. Fulbright did extensive work for railroad clients. Additionally, the son of the firm's other co-founder, John Crooker, served as the head of the Civil Aeronautics Board under President Johnson.

Another Fulbright partner, Everett Hutchinson, served as a member of the Interstate Commerce Commission before joining the firm. He later went on to serve as the Deputy Secretary of Transportation under President Johnson.

Years later, Fulbright Senior Partner Carl Vogt served as chairman of the National Transportation Safety Board under the first President Bush and President Clinton and later on the White House Commission on Aviation Safety and Security under President Clinton. Vogt also served as a director of the National Railroad Passenger Corporation (AMTRAK) and as a member of the FAA's Aviation System Capacity and Safety Review Committees.

"The contributions of Carl Vogt and others at Fulbright served as inspiration for me in taking on this new challenge," Long said. "I look forward to the opportunity to serve that awaits me at the FAA.

Michael Elmer Accepts "Individual Business Leadership" Award as Leader of Pro Bono Team
Finnegan Henderson's Michael Elmer was selected from a number of nominees to receive the Silicon Valley Arts & Business Award for "Individual Business Leadership." The award is given to individuals who have made significant contributions to the arts in Silicon Valley in the past two years. The awards ceremony was hosted by Arts Council Silicon Valley (ACSV), the largest nonprofit arts council in California. Nominated by the San Jose Convention and Visitors Bureau, Mike accepted the award on behalf of the Finnegan team that works on a pro bono basis with ACSV on its ARTSOPOLIS project. The team includes Gary Edwards, Venk Krishnamoorthy, and Sylvia Lopez.

From the firm's Palo Alto office, the team worked with ACSV to create a licensing package for the www.ARTSOPOLIS.com website, which provides an arts and cultural calendar for the entire Silicon Valley. With this Website and Licensing Package, ACSV has licensed over 10 major US cities and governmental entities with the ARTSOPOLIS package, including Phoenix; Houston; Dallas; Denver; Colorado Springs; Inland Empire (Riverside and San Bernardino, California); Orange County, California; St Josephs County, Indiana (South Bend metropolitan area); and North Dakota, as well as some smaller "Mini License" packages for smaller metropolitan areas. The Artsopolis Network provides "hyperlinks" from one calendaring website to the other, providing both metropolitan residents and tourists alike with an electronic calendaring and ticketing service for each area. The licenses help ACSV derive revenue from its IP investments, making the non-profit project virtually self-sustaining. At least five other licenses are currently under negotiation.

FETF Partner Presents a Program on Trademark Diliution
Joseph Nabor was a co-presenter of the AIPLA On-Line Program “Trademark Dilution: New Angles after the Trademark Dilution Revision Act of 2006 and Why You Should Care.” This program focused on the practical application of the recently revised Trademark Dilution Act, and alternatives to federal trademark dilution claims for those who do not qualify under the revised Act. The program was organized and presented by the AIPLA On-Line Programs Committee and simulcast through a dial in number and over the internet. Joe, a partner at Fitch Even, focuses in the areas of trademark, copyright and unfair competition law.

Briggs and Morgan Elects New Directors and Officers
The shareholders of Briggs and Morgan, Professional Association, have elected three new directors: Nancy C. Aiken, Michael C. Krikava and Joseph P. Noack. In addition, the board of directors announces new officers Alan H. Maclin, president; Lauren E. Lonergan, vice president; Peter J. Rue, treasurer; and Michael C. Krikava, secretary.

Briggs’ new directors join re-elected members of the board, which includes Charles R. Haynor, Lauren E. Lonergan, James J. Long, Alan H. Maclin and Peter J. Rue. Nancy Aiken is a shareholder and member of Briggs’ business law section, as well as a newly elected director in the firm. Aiken assists clients with all facets of mergers and acquisitions, joint ventures and partnerships, and overall corporate strategy and structure. She also provides counsel on general corporate and securities law matters. Aiken received her B.B.A. and M.A. in accounting from the University of Iowa, and graduated magna cum laude from the University of Iowa Law School. She was an associate with Briggs during the early ’90s, before serving as senior counsel for Koch Industries Inc. from 1995 to 2000. Aiken re-joined Briggs in 2000 as a shareholder.

Charles Haynor is a Briggs shareholder and was re-elected to the firm’s board of directors. As a member of the financial institutions and real estate section, he practices primarily in the areas of banking, real estate and creditors' rights, and commercial law. For more than 20 years, Haynor has represented clients in negotiating and documenting a variety of sophisticated commercial and real estate financing transactions. He has been recognized in The Best Lawyers in America, and also named a “Leading American Attorney” and one of “America’s Leading Business Lawyers” (Chambers USA). Haynor received his B.A. from the University of Iowa with highest distinction and graduated from the University of Iowa College of Law with high distinction. He joined Briggs in 1975.

Michael Krikava is a shareholder and serves as secretary of the Briggs and Morgan board of directors. He is also the head of the firm’s energy law practice group. He practices principally in the areas of public utility regulation, energy law, and independent power and wind energy project development. In addition, he also assists clients with administrative law and procedure, and commercial litigation matters. Krikava was named one of the 2006 and 2007 “Best Lawyers in America” for Minnesota energy law practitioners and a top lawyer in energy law by Corporate Counsel Magazine. He received his B.S. with distinction from the University of Minnesota and summa cum laude from William Mitchell College of Law. He joined Briggs in 1988 after clerking for Chief Justice Douglas K. Amdahl of the Minnesota Supreme Court.

Lauren Lonergan is a shareholder and serves as Briggs’ newly elected board vice president. She has also been named section head of the firm’s business litigation section. Lonergan’s practice involves assisting clients with insurance coverage and regulatory litigation, as well as significant business and employment litigation cases. She attended Carleton College and received her B.A. summa cum laude from Macalester College, and received her law degree cum laude from the University of Minnesota School of Law. Lonergan joined Briggs in 1988.
James Long is a shareholder and was re-elected to the Briggs and Morgan board of directors. He is head of the firm’s trade regulation section. Long’s litigation practice, spanning more than 22 years of experience, involves antitrust and franchise law, and dealer/distribution/sales law. On a national scope, he has handled cases venued in Florida, North Carolina, Illinois, Indiana, Wisconsin, Missouri, Kentucky, Texas, Maine, Colorado, New Jersey and Ohio, as well as Minnesota. Long received his B.A. with honors in economics from the University of Chicago and his law degree magna cum laude from the University of Minnesota. He joined Briggs in 1987.

Alan Maclin is Briggs’ newly elected president. He previously served as head of the litigation department. Maclin’s litigation practice has grown to include lead defense of numerous groundbreaking class actions challenging various mortgage banking practices, along with representation of manufacturers, financial institutions and others in connection with complex commercial litigation. He also concentrates on antitrust and trade regulation, defense of governmental enforcement actions and investigations, and complex trust and estates litigation. Maclin joined Briggs and Morgan in 1980 after serving six years as special assistant attorney general for Minnesota. He received his B.A. magna cum laude from Vanderbilt University and his law degree from the University of Chicago Law School.

Joseph Noack is a shareholder and newly elected director in the firm. He is a member of the business law section and practices principally in corporate and business law, mergers and acquisitions, business structuring and succession planning, private placements, and emerging companies. Noack graduated from St. John's University with a B.A. in economics and accounting. Following a tour in Vietnam as a U.S. Army armor officer, he received a law degree from Notre Dame Law School. He worked in business and tax planning with Arthur Andersen & Co. before practicing law in 1977 with another Twin Cities firm, which merged with Briggs in 1983.

Peter Rue is a shareholder and board member, and serves as the firm’s treasurer. He is a member of Briggs’ financial institutions and real estate section, and practices primarily in the areas of financial transactions and bank regulations. Prior to joining Briggs, Rue garnered 20 years of combined in-house banking experience through his work with several notable banking institutions. In his practice, he has extensive experience in structuring, negotiating and documenting complex credit transactions. Rue also regularly advises clients on bank regulatory issues, restructuring, workout and exit strategies, equity investments, affiliate transactions, confidentiality, and other topics. He received a B.A. in history and political science from the University of Rochester, and a law degree from Ohio State University College of Law. Rue joined Briggs in 2001.

TUCKER ARENSBERG ATTORNEY NOMINATED TO SERVE ON THE CIVIL SERVICE BOARD FOR NON-UNION COUNTY EMPLOYEES
Steven B. Silverman, an attorney with the law firm Tucker Arensberg, P.C., has been appointed to serve on the Allegheny County Civil Service Board.
The Board holds hearings and adjudicates personnel matters when employment related issues or disputes arise involving non-union County employees. Steve is one of 3 members of the Board and will serve a three year term.

Silverman is a shareholder in the firm’s Litigation Department and practices civil litigation with an emphasis on commercial litigation. He is also co-chair of the firm’s Technology Group. Steve handles business disputes involving such areas as trade secret theft and restrictive employment covenants, particularly in the context of the computer, software and high technology industries. He also advises corporations and individuals on various employment matters.
Silverman's technology practice encompasses counseling a diverse array of clients ranging from software developers and consultants to web hosting companies. Silverman has handled matters involving internet advertising claims, copyright infringements, licensing and various e-commerce issues. He has also written and lectured on these topics for many groups. He was recently selected by his peers for inclusion in The Best Lawyers in America® 2006 in the Information Technology Law category and named a 2006 and 2007 Pennsylvania Super Lawyer in the Civil Litigation Defense Category. His article “Protect Your Trade Secret!” was published in PA Manufacturer, a publication of Pennsylvania’s industrial resource centers.
For several years, Silverman served as an adjunct professor at Carnegie Mellon University’s Graduate School of Industrial Administration, teaching a course entitled “Labor and Employment Issues in the High Tech Workplace.”

Steve’s litigation practice also includes handling cases under ERISA, contract disputes, construction cases, zoning and land use matters and in collection actions.
Steve has successfully tried jury and non-jury trials in both state and federal courts. He has argued cases before both the Pennsylvania Superior and Commonwealth appellate courts. Steve is admitted to practice before the United States District Court for the Western District of Pennsylvania, the United States Court of Appeals for the Third Circuit and the United States Court of Appeals for the Tenth Circuit.
