Intellectual Property Arbitration Leads to Complete Vindication of Maslon Client
A team of Maslon lawyers led at trial by partners Bill Pentelovitch and Justin Perl recently completed a three-week intellectual property arbitration which resulted in complete vindication of their client, the defendant in the action, which was found to have committed no wrongdoing and against which none of the $164 million in damages sought was awarded.

The Maslon client was party to a license and development agreement in the area of microelectromechanical systems ("MEMS) devices. A dispute arose over the scope of the field of use, with the Maslon client taking the position that the field of use was limited to transmission of video images in medical applications. The plaintiff took the position that the field of use was broad enough to cover optical switching for telecommunications applications.

During the course of the trial approximately twenty five witnesses testified, including experts in the fields of optics, optical physics, and mechanical engineering. The technology involved was highly sophisticated and cutting edge at the time the agreement was entered into.

Mackenzie Hughes Introduces Three New Practice Areas
Capitalizing on his experience as a former state assemblyman, Jeff Brown, an attorney and partner at Mackenzie Hughes LLP, has taken the lead at the firm in organizing three new practice areas designed to help Central New York businesses through the receipt of government grants and participation in economic development incentive programs.

The new practice areas—public law and policy, economic development, and government grants—will provide services ranging from research, strategic advice, and drafting of government grants to assisting clients in securing participation in a variety of economic development tax incentives.

“There is a lot of interest from local businesses about how to obtain government grants and access to economic programs,” Brown said. “However, a number of small businesses and municipalities are intimidated by the details of how to get those economic benefits.”
The attorneys in the government grants practice will work with businesses throughout the entire grant process, including: matching clients with available funding to meet their missions and goals, preparation of the grant applications, and submission to the funding source.

The attorneys in the economic development practice will help businesses lock into economic developments that are available, including: Industrial Development Agency low interest bonding, Empire Zone tax credits, and Power for Jobs energy incentives.
Attorneys in the public law and policy practice will appear before government agencies, advocate issues and work with various legislators to implement regulatory and/or budgetary changes on behalf of a particular business.
“These three practice areas allow me to do things I have always wanted to do in my legal practice,” Brown said. “It allows me to focus on issues that I dealt with as a legislator and help businesses and municipalities here in this region. I’m really excited to take on this opportunity.”

On Tuesday, March 13 at Drumlins Country Club, Brown and fellow attorney Nicole Allen Cerrito will introduce the government grants practice during Mackenzie Hughes’ Labor Law Review, a monthly seminar geared toward human resource managers.

During that free seminar held at 8:30 a.m., they will talk about government grants that are readily available to help fund employers, business owners, not-for-profits and municipalities. They will also discuss how to identify grants that apply to each individual business and the documents required for grant applications.

Ray C. Stoner brings to the Firm over three decades of experience. Mr. Stoner's practice concentrates in large commercial litigation and business counseling throughout the United States . His litigation experience is vast and includes: commercial and business transactions, antitrust, unfair competition, business terminations, franchising, lender liability, construction, RICO, computer software, insurance bad faith, toxic torts, tax valuations, accounting and legal malpractice and collections. For almost twenty years Mr. Stoner served as national litigation and trial counsel for all litigation and distributor matters for a major international brand, and has successfully tried and handled appeals of many matters throughout the United States.

He also counsels businesses in antitrust, franchising distribution, marketing, dealer and supplier relations and economic development. Mr. Stoner has been involved in commercial leasing and major bankruptcy negotiations. He has also served as Pittsburgh counsel for national urban developers. Mr. Stoner is a graduate of the Marshall-Wythe Law School , College of William and Mary. He is admitted in Pennsylvania and Virginia.

Adam S. Ennis has over 16 years of experience in commercial litigation. He has extensive experience representing clients in court proceedings, arbitrations and mediations. His broad practice has included complex contractual disputes, attorney and accountant liability, antitrust, securities fraud, financial fraud, restrictive covenant enforcement, trade secret litigation, class actions, bankruptcy litigation, distributorship termination, real estate-related litigation and construction. He has represented companies and individuals in a wide variety of industries, including energy, health care, pharmaceuticals, securities, restaurants and food service, telecommunications, computer software and banking.

Mr. Ennis is a graduate of the Benjamin N. Cardozo School of Law of Yeshiva University, J.D. 1990, where he was Executive Editor of the Cardozo Law Review, and the University of Pittsburgh , B.S. cum laude, 1987. He is admitted in New York and Pennsylvania.

Lathrop & Gage to Open Clayton Office
Thomas Stewart, managing partner of Lathrop & Gage L.C., today announced that the law firm will open an office in Clayton, Mo. Joining Lathrop & Gage from Blumenfeld Kaplan & Sandweiss P.C. are:

* John King, real estate and zoning;
* Bennett Keller, business law, estate and succession planning;
* Scott Malin, estate planning, corporate and business transactions;
* Ira Blank, labor and employment and litigation;
* Donn Herring, health care, business transactions and corporate;
* Andrew Hogenson, estate planning, tax and corporate; and
* Eric Schmitt, real estate and litigation.

King, Keller, Malin, Blank, Herring and Schmitt join as members (partners); Hogenson joins as an associate. The Clayton office will be at the Pierre Laclede Center, 7701 Forsyth Blvd., and will be operational March 19. The new team brings the total of Lathrop & Gage attorneys in the St. Louis metropolitan area to 28 an increase in headcount of 33 percent.

The new location allows Lathrop & Gage to better serve St. Louis County, Stewart said, and the seven new attorneys primarily transactional lawyers complement the firms local strengths in litigation and government relations. Lathrop & Gages 21-lawyer office in downtown St. Louis boasts Thor Hearne, a government relations attorney who served as lead election counsel for Bush-Cheney 2004, and two Fellows in the American College of Trial Lawyers, including Brent Baldwin, the partner in charge.

This is just one more step in our strategic plan to grow this office based on client needs and opportunities in the market, regionally and nationally, Stewart said. Ben and his team are exceptional lawyers and clients seek them out, as we did, because they consistently deliver great results. They are at the top of their game, entrepreneurial and great additions to our firm. We believe this new office and infusion of talent will allow us to continue to grow, serve clients better and be much more competitive in St. Louis.

Former Deputy Minister of Foreign Affairs Peter Harder joins Fraser Milner Casgrain as Senior Policy Advisor
Fraser Milner Casgrain LLP (FMC), one of Canada’s leading business law firms, announced today that V. Peter Harder, Canada’s Deputy Minister of Foreign Affairs from June 2003 until his retirement from public service earlier this month, has joined the firm as Senior Policy Advisor.

Based in Ottawa, Mr. Harder will provide sage counsel to FMC’s lawyers on regulatory and policy issues affecting their clients’ business activities in Canada and abroad. He will also be responsible for developing new opportunities, particularly with international governments.

Beginning his long and varied career in 1977 as a Foreign Service Officer with Canada’s Department of External Affairs, Mr. Harder has more than 30 years of experience in federal public service. His most recent posting was Deputy Minister of Foreign Affairs, Foreign Affairs and International Trade, Government of Canada, where he served as the personal representative to the Prime Minister of Canada during the last three G8 Summits.

Mr. Harder has also served as Associate Deputy Minister (Immigration) for the Department of Employment and Immigration, Deputy Solicitor General, Deputy Minister of Citizenship and Immigration, and Secretary of the Treasury Board and Comptroller General for Canada. In 2000, he was appointed Deputy Minister of Industry Canada.
