DLA Piper expands Bangkok office with two partner appointments
DLA Piper has appointed Suraphon Rittipongchusit and Supreedee Nimitkul as partners in the Bangkok office. Suraphon joins the growing dispute resolution department having had significant experience of commercial litigation, arbitration and other forms of dispute resolution matters. Supreedee is a corporate practitioner with over 20 years' experience advising on a wide range of corporate and commercial issues as well as providing advice to multinational corporations and leading Thai companies.

Suraphon has advised clients in arbitrations at the Thai Arbitration Institute and under International Chamber of Commerce (ICC) rules. He has experience of the banking and finance sectors and has also worked on business reorganizations, project finance matters and advised foreign investors in selecting investment vehicles. Suraphon also provides clients with high-level negotiations in relation to corporate acquisitions, joint ventures, and long-term supply, distribution and licensing agreements issues.

Supreedee's areas of expertise span an extremely diverse array of corporate and commercial issues. He advises clients across a wide range of industry sectors, however, he is particularly experienced in the banking and finance sector. Supreedee advises on project finance, joint ventures, mergers and acquisition, major business reorganizations and debt restructurings. He also handles dispute resolution matters under Thai and ICC arbitration rules. In addition, Supreedee assists clients looking to expand their franchise business in various sectors including automotive and entertainment.

Supreedee is a guest lecturer at the Business and Accountancy Faculty of Thammasat University and has been a speaker at conferences on copyright protection and arbitration in Singapore and Bangkok.

Harold McElhinny Inducted Into American College of Trial Lawyers
Morrison & Foerster is pleased to announce that Harold McElhinny has been inducted into the American College of Trial Lawyers (ACTL), one of the premier legal associations in America. Mr. McElhinny was inducted at the College’s 2007 Annual Meeting in Palm Springs, CA.

Founded in 1950, the ACTL is composed of the best of the trial bar from the United States and Canada. They are dedicated to maintaining and improving the standards of trial practice, the administration of justice and the ethics of the profession.

Fellowship in the ACTL is extended by invitation only and only after careful investigation, to those experienced trial lawyers who have mastered the art of advocacy and whose professional careers have been marked by the highest standards of ethical conduct, professionalism, civility and collegiality. Qualified lawyers are called to Fellowship in the ACTL from all branches of trial practice. They are selected from among those who customarily represent plaintiffs in civil cases and those who customarily represent defendants, those who prosecute individuals accused of crime and those who defend them. Lawyers must have a minimum of fifteen years trial experience before they can be considered for Fellowship.

Mr. McElhinny is Co-Chair of Morrison & Foerster's Intellectual Property Group. His experience includes the representation of clients, as both plaintiff and defendant, in significant matters involving all aspects of patent, copyright, and trade secret litigation.

Mr. McElhinny received his B.A. degree in 1970 from the University of Santa Clara and received his J.D. from Boalt Hall School of Law, the University of California at Berkeley, in 1975.

Mr. McElhinny is the ninth Morrison & Foerster partner to be named a fellow of the College, joining previous honorees Bob Raven, Seth Hufstedler, Jim Brosnahan, Chuck Patterson, Mel Goldman, William Alsup, Howard Soloway, and Jim Bennett.

Miller Canfield Attorney to Speak at 31st Annual Criminal Defense Attorneys of Michigan Conference
Thomas C. O’Brien, senior counsel with the law firm of Miller Canfield, will speak at the 31st Anniversary Annual Conference of the Criminal Defense Attorneys of Michigan, to be held March 15-17th at the Crown Plaza Hotel in Novi, Mich. O’Brien’s presentation on Friday, March 16th at 3:15 p.m. will focus on utilizing United States Supreme Court decisions in the Daubert and Crawford cases along with the Michigan Rules of Evidence to limit expert testimony. The three-day advanced skills conference for criminal defense lawyers is expected to draw more than 250 attorneys.

According to O’Brien, "the movement to eliminate so-called junk science in Michigan courts resulted in the amendment of MRE 703 in 2003. Unlike Federal Rule 703, Michigan now requires that the facts or data in the particular case upon which an expert opinion is based must be in evidence. This change in former Michigan practice not only affected civil cases; it made it significantly more difficult for the prosecution to introduce expert testimony."

O’Brien practices in Miller Canfield’s Criminal Defense Group as well as the firm’s Litigation and Dispute Resolution Group. He is a frequent lecturer in the field of trial practice for the National Institute for Trial Advocacy and the Institute of Continuing Legal Education. He is listed in both The Best Lawyers in America and Super Lawyers .

Kaye Scholer Representing Lutron in Complaints Against Leviton in U.S. Federal Court and International Trade Commission
Kaye Scholer is representing Lutron Electronics, the world's leading designer and manufacturer of lighting controls, lighting control systems and shading solutions, in complaints filed against Leviton Manufacturing Company with the International Trade Commission (ITC) and in the United States District Court for the Eastern District of Texas. The complaints allege that Leviton has infringed Lutron patents covering a wide spectrum of proprietary Lutron lighting control and wireless technology and has sold products made to look like Lutron's popular Maestro® dimmers.

In the complaint to the ITC, Lutron charges that Leviton is importing into the United States lighting control products made in Mexico and China that infringe on four U.S. Patents held by Lutron. These patents protect a variety of Lutron dimmers and switches including lighting control systems that wirelessly communicate.

Lutron's federal court complaint requests that Leviton be enjoined from further infringement of the four U.S. Patents mentioned in the ITC complaint and an additional fifth U.S. Patent, and that Leviton be ordered to pay damages for willful infringement of those patents. The federal court complaint also alleges that Leviton has engaged in other forms of infringement of Lutron's intellectual property and in other forms of unfair competition.

The Kaye Scholer team that prepared the complaint includes partners James D. Herschlein and David S. Benyacar, and associates Daniel M. Boglioli and Danielle J. Garrod, all in the Litigation Department. Assisting in preparing the cases for discovery and trial are associates John S. Cahalan and Joshua S. Reisberg of the Litigation Department, and former summer associates Lauren Attard, Erica Gersowitz, Penelope Jensen and Scott Levine.

David S. McDaniel Joins Jaffe Raitt Heuer & Weiss, P.C.

Holland & Knight Expands National Biotech Practice with Addition of Prominent Life Sciences Lawyer Larry S. Millstein
"Holland & Knight's national Intellectual Property Group adds a prominent biotech patent lawyer to its practice through the acquisition of the Washington, D.C.-based law firm Millstein & Taylor, P.C. Name partner and noted life sciences attorney Larry S. Millstein, Ph.D. joins the firm's Washington, D.C., office as partner. Also joining Holland & Knight is name partner and transactional lawyer Robin Taylor, who will practice in the firm''s Northern Virginia office in the Mergers & Acquisitions Group.

Millstein's arrival is the latest in a series of strategic lateral additions by the firm's IP group, which added eight lawyers to its practice within the last year. Millstein holds a Ph.D. in molecular biology and chemistry, and has extensive experience in technically complex matters, particularly relating to molecular biology, bio-research instrumentation, genomics, expression profiling, proteomics, array technologies, HTS technologies, bioinformatics, drug discovery, biomarkers, pharmaceutical agents and formulations, transgenics, bioMEMS, certain aspects of nanotechnology, and single molecule technology. His practice focuses on technology and intellectual property portfolio development and strategy, including technology assessment, forecasting and counseling; patentability assessment; patent preparation, prosecution and acquisition; IP licensing, due diligence, and litigation counseling.

""Larry is widely respected in the legal and biotech communities, and has impressive technical and litigation expertise,"" said Josh Krumholz, the firm’s Intellectual Property Practice Group leader. Millstein is a registered U.S. Patent Attorney and is a member of the Bars of the District of Columbia, the C.A.F.C. and the U.S. Supreme Court. He also is an adjunct professor in the Department of Biochemistry Molecular and Cellular Biology at Georgetown University, and he is chairman of the Board of Directors of the Georgetown University Program in Entrepreneurial Biotechnology.

Before founding Millstein & Taylor, Millstein was senior patent counsel at Human Genome Sciences. Before taking up the practice of law, Millstein was a scientist for more than 10 years and carried out research in biology at the at the Smithsonian Institution and in chemistry and molecular biology at UC-San Diego, the Scripps Research Institute, and the University of Rochester. In addition to his academic publications, Millstein is an inventor on several patent applications on micro-arrays and on polynucleotide amplification methods.

Millstein holds a B.S. in chemistry from SUNY-CCNY, and an M.S. and Ph.D. in chemistry and molecular biology from the University of California-San Diego. He earned his J.D. from George Mason University School of Law and is a graduate of the school''s Patent Law Specialty Track Program.

Robin Taylor, co-founder of Millstein Taylor, is a highly regarded business lawyer and certified public accountant with more than 20 years of experience in matters relating to business transactions, taxation, regulatory compliance, intellectual property law, and employment law.

Taylor''s practice includes counseling technology companies, especially early and mid-stage companies, as well as advising on complex commercial transactions, business entities and operational structures, mergers and reorganizations, and debt and equity financing. She has significant experience in joint ventures, licenses, sales partnering arrangements, and mergers and acquisitions. In addition, Taylor has negotiated large and complex transactions; handled financing, leasing and purchasing of investment real estate; and counseled clients on employment law, including ERISA compliance. She also has experience setting up technology incubators and other technology development-based, IP-oriented enterprises.

Taylor earned her B.S.B.A. from the University of North Carolina and received her J.D. with honors from the University of North Carolina Law School in 1986. She is a Certified Public Accountant and holds a Master of Laws in Taxation degree from Georgetown University School of Law.

Hogan & Hartson Strengthens Its New York Real Estate Practice With New Counsel
"Hogan & Hartson LLP announced today that Dennis D. Kiely has joined as counsel in the firm’s real estate and business, finance, and tax practices in New York.

Kiely’s practice focuses on a full spectrum of real estate and capital markets transactions, including representing public and private companies in the acquisition, disposition, management, brokerage, financing, and leasing of commercial real property interests. He also negotiates partnership and limited liability agreements for investment funds, joint ventures, and closely held companies, and represents lenders and borrowers in connection with various types of loans, including construction loans, bridge loans, and commercial mortgage-backed securities.

“Expanding the New York office’s real estate practice continues to be a focus for us,” said Mitchell R. Lubart, a director of the firm’s real estate practice. “Dennis has diverse real estate and capital markets experience and will be a terrific asset to Hogan & Hartson.”

Prior to joining Hogan & Hartson, Kiely was a real estate associate in the New York office of another prominent international law firm.

Kiely received his law degree from Columbia Law School and his bachelor’s degree from Columbia College.
