Governor Spitzer Taps Allan Hyman for State Judicial Screening Committee
Governor Eliot Spitzer announced on March 8th the members of four Departmental Judicial Screening Committees and the State Judicial Screening Committee. Allan Hyman, Senior Partner at Certilman Balin Adler & Hyman, LLP, has been named to the State Judicial Screening Committee that will review candidates for the Court of Claims. This committee consists of thirteen members.

The screening committees were established by Executive Order No. 4 to review and consider the qualifications of candidates for designation to the Appellate Division of the Supreme Court, candidates for appointment to the Court of Claims, and candidates for appointment to fill vacancies in the offices of Justice of the Supreme Court, Judge of the County Court, Judge of the Surrogate’s Court, and Judge of the Family Court outside of New York City.

Mr. Hyman practices in the firm’s litigation, real estate tax certiorari, and condemnation law departments. He has lectured extensively in his field. Active in civic affairs, Mr. Hyman serves as a member of the Board of Trustees of the North Shore-Long Island Jewish Health System. He is also a member of the Board of Directors of the Education and Assistance Corporation.

Cooley Adds Partner to Its IP Leadership
Thomas J. Friel Jr., a partner at Cooley Godward Kronish, has been named head of the firm's national intellectual property litigation practice, joining three other partners as an intellectual property practice group leader.

Friel, who will be included in the 2007 edition of Best Lawyers in America and was honored as a 2006 Northern California Super Lawyer, has nearly 30 years' experience in patent and licensing litigation, as well as trademark and copyright litigation.

T&K Attorney Publishes Article on the Advantages of Prepack Bankruptcies
Prepackaged business bankruptcies, or 'prepacks,' can dramatically reduce costs and increase the likelihood of success compared to normal business reorganizations," according to Thompson & Knight Partner Rhett G. Campbell. Campbell's article "Prepacks Reduce Time and Costs of Business Filings" was published in the March 5, 2007 issue of The National Law Journal.

According to the article, speed is the prepack's primary benefit as they are often concluded in 90 days or less. Standard Chapter 11 reorganizations often require 12 to 36 months to complete. Other advantages of a prepack stem from the reduction in time - reduced costs, greater control of the debtor, and less likelihood of business deterioration and loss of valued employees. However, prepacks are not suitable for every case. The best prepack candidates either had a previous out-of-court workout fail due to minority holdouts or engaged in substantial prefiling negotiations among a manageable group of claimants.

"In a proper case, a prepack combines the best part of bankruptcy law - majority rule - with the relatively lower cost of an out-of-court restructuring," says Campbell. "The result can be a win-win scenario for all."

Campbell serves as Managing Partner of Thompson & Knight's Houston office and is a Partner and Practice Leader of the Corporate Reorganization and Creditors' Rights Practice Group. He represents clients in corporate reorganization and business and commercial litigation, with a special emphasis on creditors' rights and bankruptcy matters. Campbell is Board Certified in Business Bankruptcy Law and Civil Trial Law by the Texas Board of Legal Specialization.

Former U.S. Trade Representative General Counsel Joins Sidley Austin LLP
Sidley Austin LLP today announced that James Mendenhall has joined the firm as a partner in its International Trade and Dispute Resolution Practice. He is resident in the Washington, D.C. office. Mr. Mendenhall joins the firm from the Office of the United States Trade Representative, where he served as General Counsel.

“Jim Mendenhall is a respected leader in the international trade community, and we are proud that he is joining us,” said Carter Phillips, Managing Partner of the Washington, D.C., office. “As a former General Counsel at USTR, Jim brings vast international trade and policy experience that will be of significant value to our clients.”

While at USTR, Mr. Mendenhall managed U.S. dispute settlement activities under international trade agreements and supervised trade negotiations dealing with intellectual property, investment and services, including financial services. Over the past five years, he was at the center of many of the most important trade issues facing the Administration. Mr. Mendenhall‘s accomplishments include serving as principal U.S. negotiator in talks leading to settlement of the long-standing dispute on U.S.-Canada softwood lumber trade, spearheading U.S. efforts to facilitate an international mechanism to control trade in conflict diamonds, handling the closing stages of a landmark agreement on WTO intellectual property rules and pharmaceutical patents and formulating the U.S. approach to Chinese intellectual property enforcement issues.

Mr. Mendenhall received his J.D. at Harvard Law School, where he graduated with honors, and his B.A., with highest honors, from the University of Notre Dame.

Seyfarth Shaw Welcomes Real Estate Attorneys Mitchell S. Kaplan and Willard S. Moore as Partners in New York
Seyfarth Shaw LLP, one of America’s leading full service law firms, announced that Mitchell S. Kaplan and Willard S. Moore have joined the firm as partners in the real estate practice group in the New York office. Formerly, Kaplan was a partner with Orrick, Herrington and Sutcliffe LLP, and Moore was of counsel with DLA Piper US LLP.

Kaplan’s practice is focused on finance, including securitized mortgage transactions, leasing, and conveyancing. He has significant experience in complex financing transactions, including leasehold mortgages, mezzanine loans, bridge loans, and construction loans and has also represented lenders and borrowers in loan facilities involving equity kicker components, "take-out" transactions, and construction loans with conversion features to permanent loans. His experience in lending transactions also includes structuring and closing syndicated loans, with multiple levels of debt, as well as counseling lenders and borrowers in loan workouts and restructures. In addition, Kaplan has counseled both buyers and sellers of office buildings, commercial condominiums, apartment complexes, shopping centers, hotels, and other commercial properties. He also has considerable expertise in representing both landlords and tenants in office, retail, and other commercial leasing transactions.

Moore represents lenders, developers, owners, and investors in a variety of real estate financing transactions. His primary experience is in commercial mortgage-backed securities, tax-exempt housing bonds, and affordable housing. He has represented a number of securitized lenders in the development of securitized lending programs and products and in the origination and securitization of a wide variety of loans, including the financing of multi-family, office, hospitality, retail, industrial and credit tenant properties. He has also worked extensively with B note originators and purchasers, mezzanine lenders and B-piece investors. In addition, Moore has represented many borrowers in both securitized and traditional financings. In the tax-exempt bond area, Moore has represented a number of major New York developers and lenders.

Eva Ciko Carman joins Ropes & Gray’s Securities Litigation Group
Ropes & Gray is pleased to announce that Eva Ciko Carman is a new partner in the firm's Securities Litigation Group. Carman will base her practice in the firm's New York office.

Carman’s practice is focused on securities enforcement and the defense of white-collar criminal cases. In her representation of investment advisers, broker-dealers, and others, she appears regularly before the Securities & Exchange Commission and other regulatory agencies. In addition, Carman has tried several cases in state and federal courts.

Carman comes to Ropes & Gray from K&L Gates. She will be reunited with her former colleagues, Richard D. Marshall and Robert J. Borzone Jr., who left K&L Gates to join Ropes & Gray in February 2007 and March 2007, respectively.

“Eva is a terrific addition to our securities litigation team,” said Robert S. Fischler, the co-chair of Ropes & Gray's Securities Litigation Practice Group. “With her experience trying cases in court, as well as handling enforcement matters involving the SEC and other regulatory agencies, Eva significantly bolsters our securities litigation capacity in New York. ”

Carman is admitted to the bars of New York, Massachusetts and Pennsylvania. She earned a Certificate from the University of Paris, La Sorbonne, before graduating summa cum laude from Boston College. She went on to earn her law degree from the Georgetown University Law Center. A prolific author, Carman has been featured extensively in Metropolitan Corporate Counsel and several other publications.
