FTC Growing Watchful of Cash Cards
Blackwell Sanders attorney Mark Hostetler shared his advertising and marketing law expertise today with Charlie Brennan on The Charlie Brennan Show, KMOX-AM 1120. With the growing popularity of gift cards, apparently complaints by consumers to the Federal Trade Commission have risen too. The FTC has proposed a settlement with Kmart Corp. to resolve recent deceptive advertising accusations. Hostetler said this is likely just the first in what may be a series of FTC pronouncements and actions to regulate cash card disclosures and to protect consumers against gift cards that do not clearly disclose all of their terms and conditions.

Hostetler cautioned businesses and consumers alike who use so-called “cash cards” to be watchful for continuing FTC scrutiny of the manner in which cash cards are advertised, marketed and redeemed.

The FTC contends that Kmart’s claim that the gift card is “as good as cash,” is false because the card failed to disclose that fees are assessed after a period of non-use; and, that failure to conspicuously disclose certain terms for use of the cash card is deceptive.

Under the proposed settlement, Kmart has agreed to reimburse cardholders whose cards were reduced by dormancy fees, if the consumers can provide evidence that their gift cards were docked in that fashion.

“We are honored that so many of our colleagues have been selected for the listing,” said Brian K. Burke, chair and chief executive officer at Baker & Daniels. “It is especially rewarding that this recognition comes from our peers at the bar."

Several Baker & Daniels lawyers received multiple distinctions. Andrew Z. Soshnick, an attorney whose practice focuses on family law, was named to the Top 10 Super Lawyers and Top 50 Super Lawyers lists. James M. Carr and Christopher G.
