Davis Graham & Stubbs Attorney Scot Anderson Featured Speaker at Coal in the West Conference
Davis Graham & Stubbs partner Scot Anderson will be Articles Nexis featured speaker on the panel of experts for the Coal in the West Conference next Thursday and Friday, March 29-30 at the Brown Palace Hotel in downtown Denver. The two-day regional conference is presented by Law Seminars International for attorneys, coal energy professionals, public and private utility professionals, energy industry executives, consultants, and tribal and government officials. The program will cover the latest information on regulatory, legal and business issues impacting today’s western coal industry.

Mr. Anderson’s segment on March 29 is on “Practical Approaches to Resolving Some of the More Complicated Environmental Problems,” and he will address methods for resolving conflicts between coal mining and coalbed methane development. Mr. Anderson is a frequent speaker on energy issues and has chaired numerous conferences and institutes for the Rocky Mountain Mineral Law Foundation and other organizations. His practice focuses on transactions and litigation in the natural r esource and energy industries, international transactions, and project development. He is engaged in nearly all legal aspects of the coal industry, and has worked on the development and marketing of oil and natural gas in the U.S., Europe, North Africa and South America.

The national panel of speakers for the Coal in the West Conference includes energy attorneys, energy and utility company executives, bankers and regulatory agency representatives.

WCM Conducts Intellectual Property Seminar for PLRB/LIRB Annual Claims Conference
Senior Partner Dennis M. Wade and Partner Robert J. Cosgrove, together with Dawn Siebert, Home Office Managing Coverage Attorney of Employers Mutual Casualty Company, conducted a seminar for the Property Loss Research Bureau/Liability Insurance Research Bureau Claims Conference & Insurance Services Expo entitled Intellectual Property Claims: Analyzing Coverage and Defense Issues. The seminar provided tips and strategies for Underwriters and claims professionals to address the often intricate coverage and defense issues that arise out of intellectual property claims. Specific topics included: the various types of intellectual property claims; the common damages arising out of intellectual property claims; and the key questions that must be answered to successfully defend intellectual property claims.

Judge Lewis Quoted on Capital Case Representation
Judge Timothy Lewis was quoted in The Philadelphia Inquirer article “Old Pa. Death Sentences Getting New Day in Court.” The article discusses the tendency of defense lawyers to ineffectively represent clients in murder trials, which may prevent defendants from receiving fair trials. This becomes especially important when the death sentence becomes a possible sanction for the defendant. Brian Thomas, found guilty of murder in 1986, will receive a new sentencing hearing due to his former attorney’s failure to communicate his history with mental illness. “Allowing defendants in capital cases to be represented by inexperienced lawyers with no expertise in the death penalty reflects a serious breakdown in the legal system. It’s a real slap in the face to the notion of justice,” Judge Lewis commented.

LEADERSHIP AKRON SELECTS J. BRUCE HUNSICKER FOR 2007 DISTINGUISHED LEADER AWARD
Akron attorney J. Bruce Hunsicker has earned the Distinguished Leader Award from Leadership Akron, a non-profit organization that promotes community involvement.

Hunsicker, 52, is an attorney in the Akron office of Vorys, Sater, Seymour and Pease LLP and is a 1993 graduate of the Leadership Akron program.

In 2004, Hunsicker was diagnosed with prostate cancer.

While Hunsicker continues to vigorously practice law, his ailment has led him to mount an aggressive campaign to educate men about prostate cancer. He has formed an organization called The One-in-Six Foundation (OneInSix.org), which is so named because one in six men will get the disease.

He has set a goal of raising $1 million, which is to be used to educate men about prostate screenings and to also help finance prostate research at The Johns Hopkins University School of Medicine.

Thus far, Hunsicker and his organization have raised more than $100,000 toward that goal.

"I’m not crazy about winning an award by virtue of being sick," said Hunsicker, who is candid and practical in discussions about his malady. "But I see this as an opportunity to spread the word about this disease."

Hunsicker said there is not sufficient emphasis nationally about prostate cancer, and that many men don’t realize that it can be detected early through a simple blood test called a PSA.

Mark Scheffler, executive director of Leadership Akron, said "Bruce has really gone above and beyond what you would normally expect someone in his situation to do, and that’s a mark of leadership. He’s not only fought the battle for himself and his family, but he’s also taken the battle against prostate cancer to the community level. That exemplifies the spirit of what Leadership Akron is all about."

Hunsicker said Leadership Akron is an excellent organization that encourages an annual class of participants from the region’s business, governmental and independent sectors to better understand the area’s needs and its future.

OMM Attorneys Publish on Managing Business Disputes in Today's China
O'Melveny partner Michael Moser recently edited the book Managing Business Disputes in Today's China: Duelling with Dragons, published by Kluwer Law International. The book uses a hypothetical scenario to highlight the kinds of disputes that can arise in the course of initiating and operating a Chinese joint venture.

Moser authored the chapter "The Scenario: Ricepower and Its Woes," and co-authored "Arbitration Inside China" with counsel Nadia Darwazeh. He wrote "Arbitration Outside China" and "Endgame" with other contributors. Partner Patrick Norton authored "Informal Dispute Settlement Approaches," and counsel Friven Yeoh wrote "Enforcement and Dispute Outcomes.

Rich May Scores Trial Victory
After a week-long trial in Suffolk Superior Court, a jury returned a verdict in favor Rich May's client Pier Fish Co., Inc., a seafood wholesaler with facilities in Boston and New Bedford, in a lawsuit against the Massachusetts Bay Transportation Authority. The dispute centered on the MBTA's broken promise to arrange for a sale of MBTA-owned land to Pier Fish outside the public bidding process, following the MBTA's eminent domain taking of Pier Fish's property in the Boston Seaport District. Rich May's Frank Gaeta served as lead trial counsel to Pier Fish. The MBTA, represented by the world's second largest law firm, vigorously contested Pier Fish's claims from the outset of the lawsuit, filed more than two years ago. The jury awarded Pier Fish every dollar of damages that it sought in the case.

Smith Anderson Lawyers Present CPA/Law Forum Seminar on Income Tax Issues for Real Estate Investors
Smith Anderson lawyers Walter Rogers, Bill Nelson and Josh Bryant presented to the Charlotte chapter of the CPA Law Forum a seminar on Income Tax Issues for Real Estate Investors. The well-attended seminar provided practical guidance on how to achieve income tax objectives through proper real estate transaction planning. It reprised a similar seminar provided by Mr. Rogers, Mr. Nelson and Mr. Bryant for the Triangle chapter in June 2006.

A national educational and networking organization with chapters throughout the United States including the Triangle area, The CPA/Law Forum brings together professionals in the accounting, legal and financial industries.

Mr. Rogers represents diverse clients in matters involving federal, state and local taxation and in business transactions with tax implications. He regularly advises on tax planning for businesses, individuals, trust and estates; resolves tax controversies; and advises tax-exempt organizations in matters of formation and operation.

Mr. Nelson practices in the areas of federal, state and local tax planning and advocacy for businesses and tax-exempt entities. His diverse experience includes planning and structuring corporate acquisitions and tax-free reorganizations; tax planning for private equity funds, partnerships and limited liability companies; general tax planning for businesses; and international tax planning.

Mr. Bryant's practice includes advising on corporate and business law, tax law, and estate planning. Prior to attending law school, he became a Certified Public Accountant and worked as a tax consultant with the Raleigh office of Ernst & Young LLP where his practice focused on the federal tax treatment of pass-through entities.
