Federal Rules Amended for E-Discovery
The Federal Rules of Civil Procedure were amended effective December 1, 2006 to address expressly the developing area of e-discovery. Because business is done largely by email and by computer, the volume of documents and e-discvoery has exploded over the last several years. Balch & Bingham has been on the cutting edge of e-discovery issues. Its litigators have handled a number of large scale, complex litigation matters involving electronic discovery.

Anticipating the Rules changes, Balch & Bingham hosted four separate seminars for its clients in 2006 to provide an overview of the Rule changes and e-discovery issues. Tom Francis Elected to American College of Bond Counsel
Tom Francis, Partner in the Birmingham office, has been elected as a Fellow of the Class of 2006 for the American College of Bond Counsel.

The American College of Bond Counsel was formed in 1995 for the purpose of recognizing lawyers who have established reputations among their peers for skill, experience and high standards of professional and ethical conduct in the practice of bond law.

Mary Ellen Ternes to Speak at Oklahoma NanoFocus 2007 Conference
Environmental attorney Mary Ellen Ternes will be a featured speaker at the Oklahoma NanoFocus 2007 Conference on March 28 - 29 at the Cox Convention Center in Oklahoma City. The two-day event, which is sponsored by the Oklahoma Nanotechnology Initiative, will focus on nanotechnology research, national and regional trends, current nano education programs and grant opportunities for Oklahoma researchers and businesses. Over 35 Oklahoma companies are now actively involved in incorporating nanotechnology into their business products.

Ternes will summarize the current national and international thought regarding issues critical to developing appropriate nanotechnology health, safety and environmental regulation, including toxicology, routes of exposure, environmental fate and transport and recommended work practice standards, including EPA's recently issued "Nanotechnology White Paper."

Ternes is a former chemical engineer who began her environmental career as an EPA Region 6 emergency On-Scene Coordinator in 1985. She also worked as a hazardous waste incinerator permit writer both for EPA Region 6, then industry, before going to law school.

As an environmental lawyer, Ternes assists clients with all types of environmental issues, including potential liability resulting from exposure to hazardous chemicals. She recently wrote the American Bar Association's position paper on the Clean Air Act and Nanotechnology, briefed EPA's now former General Counsel Ann Klee regarding these issues, and moderated the national ABA teleconference on the same issues.

She currently serves on the American Institute of Chemical Engineers Nanoscale Science and Engineering Forum Board of Directors.

SQUIRE SANDERS’ LOWRY ADMITTED TO AMERICAN COLLEGE OF TRIAL LAWYERS
Patricia E. Lowry, a litigation partner with global law firm Squire, Sanders & Dempsey L.L.P.’s West Palm Beach office, has been inducted as a Fellow in the American College of Trial Lawyers. The invitation-only fellowship honors lawyers who have mastered the art of advocacy and have demonstrated high standards of ethical conduct, professionalism, civility and collegiality.

The American College of Trial Lawyers requires candidates to have at least 15 years of trial experience, and the fellowship enrollment is capped at less than 1 percent of the lawyers in a state. There are more than 80,000 lawyers in Florida and less than 250 Fellows.

“The American College of Trial Lawyers inducts only the most skilled and experienced trial lawyers, and Patricia has successfully demonstrated both attributes across the country over the past 20 years in trials involving product liability and employment litigation, with special expertise in pharmaceutical products and medical device liability defense,” said Howard C. Nicols, who coordinates the firm’s advocacy practice. “As leader of our firm’s product liability and mass tort group, Pat has been at the forefront of numerous high-profile cases including acting as Florida litigation defense counsel for several nationally known pharmaceutical companies.”

Lowry joins seven other Squire Sanders lawyers from the firm’s offices in Cleveland, Columbus and Washington DC who are also Fellows in the American College of Trial Lawyers. Alan L. Briggs, Donald T. Bucklin, Charles F. Clarke, Thomas S. Kilbane, Damond R. Mace, Robin G. Weaver and David J. Young represent Squire Sanders in the College.

Carlton Fields Shareholder, Thomas A. Dye, Served as a Moderator at the ABA Section of Litigation Committee on Corporate Counsel Seminar
Carlton Fields West Palm Beach Shareholder, Thomas A. Dye, served as a Moderator for the breakout session, Beating the Monster Class Certification Motion, at the American Bar Association’s Section of Litigation Committee on Corporate Counsel Seminar. This Continued Legal Education program was held in Amelia Island, Florida on Friday 15 – 18, 2007.

Dye is a trial lawyer who handles commercial, tax, professional liability, intellectual property, product liability, and consumer class action cases. He is Co-Chair of Carlton Fields’ Telecommunication and Technology Litigation Group. Dye received his B.A. from the College of William and Mary and received his J.D., cum laude, from University of Miami School of Law. Dye is named to the Florida Trend magazine, Florida “Legal Elite” List.

G&K Hires New Associate
Phoenix-based Gallagher & Kennedy, P.A., a full service business law firm, today announced the addition of Matthew MacLeod as an associate in the Phoenix office.

Mr. MacLeod joins the firm’s litigation department in the personal injury practice where he represents the rights of victims.

Prior to joining Gallagher & Kennedy, Mr. MacLeod served as senior associate in the Maricopa County Public Defender’s office for approximately three and a half years. In this position, he handled a full range of cases including dangerous crimes, sex cases, murders, robberies and drug sales. Mr. MacLeod has extensive experience in motion practice, pre-trial hearings, oral arguments and trial.

Mr. MacLeod also clerked for the Maricopa County Public Defender’s Office, where he assisted attorneys with legal research, jury selection and client interviews.

Mr. MacLeod volunteers at the Lewis Juvenile Detention Center where he visits and speaks with juveniles incarcerated at the facility about goal setting and offers advice and encouragement. In addition, Mr. MacLeod has donated his time as an assistant mock trial coach at Brophy College Preparatory.

Mr. MacLeod earned his juris doctor at Arizona State University College of Law in 2003. He completed his bachelor’s degree in 2000 at the University of Notre Dame.

WilmerHale Advises TUI on the Merger of Its Tourism Division with First Choice
"Europe's leading tourism company, which is also active in the shipping and logistics business, announced that it was to merge its tourism division with British travel operator First Choice Holidays PLC. As a result, the business of First Choice and the largest section of TUI AG's tourism activities are to be combined to form a new public company named TUI Travel PLC, which will be listed on the London Stock Exchange. With 51 percent of the shares, TUI will hold a majority stake in the new company. The transaction remains subject to approval by the shareholders of First Choice, and to clearance by the competent competition authorities.

WilmerHale Berlin lawyers are advising TUI on the merger with First Choice with regard to German corporate and securities law, and - in collaboration with law firm O'Melveny & Myers - on matters of competition law and merger control.

The WilmerHale team on Corporate and securities law includes Dr. Roland Steinmeyer, Dr. Matthias Santelmann and Florian Steinhardt; and Antitrust and competition law/merger control includes Ulrich Quack, Markus Hutschneider and Christian Wörz.

WilmerHale has been advising TUI for a number of years on matters relating to antitrust and competition law/merger control and, more recently, has also been assisting it with regard to corporate and securities law. One example includes the takeover of the British-Canadian container shipping company CP Ships."
