Clark Hill PLC Attorney Barbara A. Ruga to Present at Michigan Negotiators Association 2007 Labor Relations Academy
Clark Hill attorney Barbara A. Ruga will present at the Michigan Negotiators Association 2007 Labor Relations Academy in Lansing, Michigan on May 17 at 1:30 p.m. in a session entitled “Critical Points in Bargaining.” Ruga’s presentation will cover timelines and other strategic considerations. Ruga has been practicing law for nearly 30 years in the areas of education, labor relations and employment law. She predominantly represents public school districts in a wide range of employment and school law matters, and frequently lectures to public school districts on employment matters.

Ruga has published several books and articles in the field of employment law, including articles in the Michigan Council of School Attorneys Newsletter. She was the co-editor and author of “Michigan Wrongful Discharge and Employment Discrimination,” (ICLE, 1990-1994) and “Wrongful Discharge Cases in Michigan,” (1984 and 1987 editions).

Ruga has been active locally on bar association committees, professional, charitable and local governmental projects.

Ruga earned her J.D. and B.A., cum laude, from the University of Michigan.

Scott G. Smith Leads Clark Hill PLC Municipal Group
Attorney Scott G. Smith has been named the leader of Clark Hill PLC’s Municipal Group, Clark Hill CEO John Hern announced. Smith is a member in the firm’s Grand Rapids office.

Smith has been practicing law for more than 25 years, and concentrates his practice in the areas of municipal law, municipal finance law, real estate law, environmental law, and condemnation law.

Smith serves as general legal counsel for the communities of Allegan, Cedar Springs, Grand Haven, Otsego, Plainwell, South Haven, and Sparta, and as special legal counsel for Grand Rapids and a number of other communities.

Smith has extensive experience in all aspects of municipalities and municipal endeavors, representing cities, townships, villages, counties, and myriad authorities and intergovernmental entities, such as brownfield redevelopment authorities, downtown development authorities, tax increment finance authorities, economic development corporations, utility boards, joint fire and other emergency services boards, parks boards, planning commissions, zoning and construction boards of appeals, and other municipal bodies and entities. He has spoken at numerous conferences and seminars on such topics as property acquisition and condemnation, environmental considerations in municipal property transactions, blight enforcement, open meetings and freedom of information issues, zoning, planning and land use, relationships between municipalities and non-profit entities, intergovernmental contracts, annexation and act 425 agreements, and the redevelopment of blighted and contaminated property. In addition, he is the co-author of “Understanding Township Franchises & Right-of-Way Consents,” Michigan Township News, June, 2003.

Smith earned his B.A. from Wheaton College and his J.D. from the University of Michigan Law School.

Firm Associate Named One of State's Top 50 Pro Bono Attorneys
Bryan Cave LLP Phoenix Associate Kyle Hirsch has been selected by the Arizona Foundation for Legal Services & Education as a recipient of its 2007 Top 50 Pro Bono Attorneys In Arizona Award.

The foundation established this award in 2001 to recognize attorneys who have tirelessly given their time and experience to assist Arizonans who would otherwise have no legal resources.

Hirsch, nominated by the Community Legal Services Volunteer Lawyers Program, will be among those honored at a reception in conjunction with the State Bar of Arizona’s Annual Convention on Thursday, June 28, at The Westin Kierland Resort and Spa.

Ross Addresses Commercial Real Estate Financing 2007
New York Partner Barry C. Ross joins a lineup of top speakers for the Practising Law Institute seminar on Commercial Real Estate Financing 2007. Headed by a faculty of real estate law specialists, this annual event attracts real estate lawyers and professionals.

The program will cover several current topics in advanced real estate practice. Ross will be speaking in New York on February 15 and Chicago on March 29 on key financing issues in ground leasing.

Ross is active in all areas of real estate, with an emphasis on complex development, joint venture and financing transactions. He lectures annually at the New York State Bar Association’s Advanced Real Estate Seminar on such topics as construction financing and long-term ground leasing.

Court Finds Wrinkles in Plaintiff’s Suit; Denies Preliminary Injunction in Favor of Tuxedos, Inc.
Brinks Hofer Gilson & Lione, one of the largest intellectual property law firms in the United States, announced that the U.S. District Court for the Northern District of Illinois – Eastern Division has ruled in favor of its client Tuxedos, Inc. by denying a Motion for Preliminary Injunction that had been filed by After Hours Formalwear, in the matter of After Hours Formalwear, Inc. v. Tuxedos, Inc. d/b/a Formally Modern Tuxedos et al., No. 06 C 2460.

After Hours Formalwear, owned by Federated Department Stores, Inc., acquired a chain of formalwear shops that operated under the name “Modern Tuxedo,” which were later renamed “After Hours.” Subsequently, the defendant, Tuxedos, Inc., opened formalwear stores under the name FORMALLY MODERN TUXEDO. After Hours then sued Tuxedos, Inc., alleging that the use of the trademark FORMALLY MODERN TUXEDO infringed After Hours’ asserted rights in the name “modern tuxedo.” After Hours alleged violations of the Lanham Act, the federal trademark statute and related Illinois statutes.

In its opinion, the court found that After Hours did not meet its burden of proving that “modern tuxedo” is a valid and protectable trademark. The court found that After Hours failed to overcome Tuxedos, Inc.’s evidence that “modern tuxedo” is a generic term. The court determined that After Hours did not demonstrate a reasonable likelihood of prevailing on the merits of its underlying claims.

“We are very pleased with the court’s decision,” said Brinks lead attorney, Philip A. Jones. “The evidence we submitted showed wide use of “modern tuxedo” as a generic term in the industry, meaning it cannot be a trademark, and the court agreed.”

Tuxedos, Inc. was represented in the case by Brinks’ attorneys Philip A. Jones, John T. Gabrielides and Jeffrey Marx.

Formally Modern Tuxedo is an independently owned operation started by formalwear industry veterans, providing a fresh alternative to renting or purchasing formal attire and menswear. Formally Modern Tuxedo specializes in personalized service and a product mix that offers fashion-forward designer men’s garments by Tombolini, DKNY, Ben Sherman, Ike Behar, to name a few. Stores are located in the Clybourn Corridor of Chicago and in Orland Park, Illinois.
