Eleven Greenberg Traurig Attorneys Named Colorado Super Lawyers
The international law firm of Greenberg Traurig, LLP announces that 11 attorneys from the Denver office have been named Colorado Super Lawyers. Locke Reynolds Receives Motion to Dismiss in Medical Device Case
Locke Reynolds recently was granted a motion to dismiss on behalf of Medical Components, Inc. The product liability suit was filed after a catheter, inserted during the administration of chemotherapy, allegedly malfunctioned at Bloomington Hospital, Bloomington, Indiana, on May 13, 2004. The alleged malfunction caused chemotherapeutic agents to leak into plaintiff’s chest and neck, causing permanent damage, pain, scarring and the need for further medical treatment.

After removing the case to the Southern District of Indiana, Locke Reynolds filed a motion to dismiss. In the motion to dismiss, Locke Reynolds argued that plaintiffs' claims should be dismissed because plaintiffs had failed to properly name and serve Medical Components, Inc. Locke Reynolds also argued that plaintiffs' claims were time-barred and the belated service of Medical Components, Inc. could not relate back to the original complaint under Federal Rule of Civil Procedure 15(c). The District Court agreed with all of Locke Reynolds's arguments and dismissed the claims against Medical Components, Inc. with prejudice.

Canadian Lawyer Magazine features FMC's Gérard Dugré and Ronald Audette in Marché Central story
Gérard Dugré and Ronald Audette successfully represented Royal Bank of Canada before the Quebec Superior Court in the complex Marché Central case. They discuss the history and outcome of the case in Kevin Marron's article, "Divine Intervention? Big box property fraud ends well for nuns", in Canadian Lawyer Magazine (March 2007):

"Now seen as one of Canada's most successful retail property developments, the one-million-square-foot Marché Central is a Mecca of big box stores with its 120-foot tower standing like a minaret beside Montreal's Metropolitan Expressway, drawing millions of consumers from miles around on a bargain hunting pilgrimage.

Few of the shoppers who flock to this retail shrine would likely know or care much about the murky legal history of Quebec's biggest power centre development. But for the past decade, many lawyers in the province and elsewhere in Canada have been keeping an eye on the labyrinth of litigation and fraudulent dealings surrounding the development of the Marché Central.

BINGHAM MCCUTCHEN CONSOLIDATES D.C. OFFICES
Bingham McCutchen LLP, a 950-attorney law firm with 13 offices worldwide, has combined its two Washington, D.C., offices into one location at 2020 K St.

The consolidation comes a year after Bingham finalized a merger with Swidler Berlin, which enhanced the firm’s national corporate, finance and litigation areas, and made the Washington office Bingham’s second-largest. Bingham has 160 lawyers in the nation’s capital.

“Consolidating the two offices is the final step in a successful, yearlong transition,” said Washington partner Barry Direnfeld, who co-manages the D.C. office with partner Neal Sullivan.

“The transition was seamless,” added Sullivan, noting that the move to a single office has further streamlined Bingham’s day-to-day operations in Washington. Bingham’s other office was located at 3000 K St.

The merger between Bingham and Swidler Berlin was Bingham’s sixth since 1997, and it expanded the firm’s reach and strength in both Washington and New York City. Since the Swidler merger, Bingham has opened a Hong Kong office and combined with the 22-lawyer Tokyo firm Sakai & Mimura, known for its restructuring and mergers and acquisitions work.

Labor and Employment Lawyer Barry A. Guryan Returns To Epstein Becker & Green
Veteran labor and employment lawyer Barry A. Guryan has returned to his former law firm Epstein Becker & Green after a two-year hiatus.

Guryan rejoins EBG at the Firm’s New York office from Foley & Lardner LLP in Boston, where he was a member of that firm's Labor & Employment Practice and Health Care Industry Team.

Prior to joining Foley & Lardner, Guryan was a shareholder at EBG in Boston for nine years.

“The chance to rejoin EBG in New York is a extraordinary opportunity,” said Guryan. “I have the greatest respect for my former colleagues at Foley & Lardner, but I am thrilled to be rejoining my old friends at EBG, which has one of the largest and strongest Labor and Employment practices in the country.”

Guryan has more than three decades of experience in the field of labor and employment law. His practice spans issues such as Title VII, ADA, FMLA, harassment, class action litigation and negotiations of collective bargaining agreements.

Guryan is a member of American Health Lawyers Association and is also admitted to practice in New Jersey and Massachusetts and before the U.S. Court of Appeals for the First, Fifth and Ninth Circuits, and before the U.S. Supreme Court.

CRAVATH WINS REVERSAL OF CLASS CERTIFICATION IN ENRON SECURITIES CLASS ACTION
the United States Court of Appeals for the Fifth Circuit, located in New Orleans, reversed and remanded the district court's class certification decision in the Enron securities class action in which the Firm's client, Credit Suisse, is a defendant. The class had been seeking approximately $40 billion in damages.

The Court held that Credit Suisse and other banks did not have a fiduciary obligation to Enron's shareholders and no duty of disclosure, and therefore plaintiffs are not entitled to a presumption of classwide reliance. The Court also held that plaintiffs are not entitled to a fraud-on-the-market presumption because the banks did not make any misrepresentations to the market, and their alleged actions do not rise to the level of a primary violation of the securities laws. Cravath partner Richard W. Clary argued the appeal on behalf of Credit Suisse. Mr. Clary previously was appointed by Judge Harmon (Federal District Court for the Southern District of Texas) and Judge Gonzalez (Federal Bankruptcy Court for the Southern District of New York) to be liaison counsel for all of the financial institutions in the Enron mediation.


The Cravath team was led by Mr. Clary and partners Julie A. North and Darin P. McAtee, and included associates Matthew L. Kutcher and Elizabeth F. Kennedy.
