Fitch Even Partner Presents a Program at the IPTA Conference
John Gresens will present a program as a featured noon guest speaker at the 2007 IPTA Conference in Newcastle, Australia. The conference is organized by the Institute of Patent and Trade Mark Attorneys of Australia. The IPTA serves patent attorneys since 1918 and helps exchanging ideas and discussion between members.

Mr. Gresens will be speaking about recent patent legal precedents from the Federal Circuit and the U.S. Supreme Court. John is a partner at Fitch Even, and focuses his practice on strategic intellectual property counseling and litigation.

Fire protection and monopoly protection for rural water districts.
DSDA attorney James C. Milton has addressed the question of whether fire protection is part of the analysis for monopoly protection held by rural water districts. This monopoly protection is based upon a federal statute found at Title 7, U.S.C. Section 1926(b), and is the subject of frequent litigation between municipalities and rural water districts in Oklahoma and around the country. Rural water districts argue that water needs for fire protection should not be included in the "made service available" analysis for purposes of Section 1926(b). The rural water districts argue that Section 1926(b) "was not enacted for the purpose of fire protection." But federal regulations require rural water districts to "have sufficient capacity to provide reasonable fire protection to the extent practicable." 7 C.F.R. section 1780.57(d). Furthermore, federal regulations and USDA loan documents require rural water districts to comply with state and local laws and regulations, particularly regarding engineering requirements for water service facilities. Id. Many states require water service systems to be built to certain requirements so that fire protection needs can be met. Finally, the Rural Utilities Service regularly provides funding for water systems that provide water for fire protection. In fact, in its 2004 annual report, the Rural Utilities Service noted that its funding for public body projects (loans made to public agencies like water districts) were substantially impacted by "the increased demand for fire protection in public body water systems." AHLA releases Guide to Legal Issues in Life-Limiting Conditions
The Public Interest Committee of the American Health Lawyers Association (AHLA) has released A Guide to Legal Issues in Life-Limiting Conditions. You can find the Guide on the web at [www.healthlawyers.org/LifeLimiting]. The Guide provides an overview of the key legal and practical issues that arise in the care of individuals who face a life-limiting condition or who care for a loved one with a life-limiting condition. As an aid to the planning process, the Guide is organized around the continuum of care, beginning with healthy individuals who are able to live at home and following the continuum to independent retirement communities, assisted living, long term care, and an eventual return to the home with the aid of hospice services. Elise Dunitz Brennan of Doerner Saunders serves as chair of the Public Interest Committee of the AHLA. Ms. Brennan is also a director of the AHLA and serves on its Executive Committee.

Elise Brennan just completed her six-year term on the AHLA Board of Directors and has been appointed to the Advisory Board of the Journal of Health Law published by Saint Louis University School of Law's Center for Health Law Studies. Elise's most recent publication is a chapter on the use of Alternative Dispute Resolution in health care in the 2006 Health Law Handbook published by West.
Elise Dunitz Brennan, a partner in the law firm of Doerner, Saunders, Daniel & Anderson LLP in Tulsa, OK, recently began a third year of service on the Board of Directors of the American Health Lawyers Association (Health Lawyers). The association provides educational and professional development services for 9,500 healthcare attorneys. Ms. Brennan serves on two of Health Lawyers’ Board Committees. The Public Interest Committee oversees Health Lawyers’ activities to fulfill its commitment to serve as a public resource on healthcare legal issues. The Practice Group Committee oversees activities of fourteen Health Lawyers practice groups that provide professional development activities and networking opportunities for members who focus on specific areas of health law or work in special employment settings. Since 1991, Ms. Brennan has chaired Health Lawyers’ Alternative Dispute Resolution Task Force. The Association’s ADR service offers competent trained dispute mediators who arbitrate the healthcare field’s search for an alternative to the long delays and costs of litigation. She also has chaired the Association’s Credentialing & Peer Review Practice Group.

Ms. Brennan’s practice consists of representing hospitals, managed care organizations, ambulatory health care facilities, nursing homes, all types of behavioral and medical health care practitioners, and employer health plans. Ms. Brennan has been listed in each edition of The Best Lawyers in America since 1990.

Ms. Brennan received her B.A. from Tulane University, her M.S.W. from the University of Michigan, and her J.D. from Southern Methodist University.
