Dan Kolkey and Mary Murphy Named as Lawyers of the Year by California Lawyer Magazine
California Lawyer magazine has recognized San Francisco partners Daniel Kolkey and Mary Murphy with its California Lawyer Attorneys of the Year Award. The magazine honored 43 attorneys whose achievements have made a profound impact by changing the law, influencing public policy, influencing the profession, or achieving a remarkable victory for a client or for the public. The magazine highlighted Kolkey's work persuading the state Supreme Court to rule that cities and other public entities do not qualify as "persons" under the False Claims Act. Murphy is honored for her work on the Westfield San Francisco Center, a $420 million retail and entertainment development in San Francisco's mid-Market Street area that opened in September 2006.

Don Lampe Elected to Honorary Post
Don Lampe, a member in the Capital Markets Practice Group in the Charlotte and Greensboro offices, was elected to the Board of Regents of the American College of Consumer Financial Services Lawyers. This was announced at the College's Annual Dinner in Washington, DC on March 17, 2007. Don is the only attorney in North Carolina who belongs to the College. In his role on the Board of Regents, he will assist with organization and implementation of the programming, membership and awards-giving activities of the College.

The American College of Consumer Financial Services is an honorary, invitation-only professional membership organization consisting of the nation's leading lawyers in the field of consumer financial services law. The College's purpose is to promote this area of practice through academic and public service programs and activities. The College's membership consists of law firm and in-house attorneys, as well as academics and industry consultants.

Firm Advises On EGL’s $1.7 Billion Merger
EGL, Inc. announced it has signed a definitive merger agreement under which an investor group comprising James R. Crane, EGL's CEO, together with investment funds affiliated with Centerbridge Partners, L.P. and The Woodbridge Company Limited, will acquire the company in a transaction valued at approximately $1.7 billion. Willkie advised Deutsche Bank Securities, financial advisor to the Special Committee of EGL's Board of Directors, in the transaction. Houston-based EGL, Inc. is a leading global transportation, supply chain management and information services company. The deal was handled by partner David Boston and associate Laura Delanoy.

Firm Announces Additional Expansion in Frankfurt Office
The firm announced that Dr. Andreas Hautkappe, Rolf Huenermann and Dr. Stefan Joergens, formerly with Clifford Chance, join the firm as national partners in the Frankfurt office. Associates Ole Oldenburg and Ingo Bednarz, also from Clifford Chance, join the Willkie team in Frankfurt as well. The expansion of Willkie’s core deal team in Frankfurt further enhances the firm’s standing in the German transaction and project market.

This follows last month’s announcement that tax experts Dr. Patrick Meiisel and Dr. Bettina Bokeloh, formerly of PricewaterhouseCoopers, also joined Willkie’s Frankfurt office. Their arrival significantly enhances the tax competence of the Frankfurt private equity/M&A team. Private equity specialist Mario Schmidt, formerly at Clifford Chance, also joined the firm last month. Additionally, the Frankfurt team includes M&A and private equity experts Jochen Winter and Dr. Michael Bernhardt, who moved to Willkie from Linklaters in February 2006.

First Ever Public RMBS Securitisation by Ukrainian Bank
White & Case acted for UBS Limited as Arranger, Sole Lead Manager and Sole Bookrunner in connection with the first ever public Residential Mortgage Backed Security (RMBS) securitisation by a Ukrainian bank, in an issue of $180 million RMBS Floating and Fixed Rate Notes ("the Notes") for Closed Joint Stock Company Commercial Bank "PrivatBank" ("PrivatBank"). The Notes were issued by Ukraine Mortgage Loan Finance No. 1 Plc, a special purpose vehicle incorporated in England and Wales.

"Residential Mortgage Backed Securities are a dominant asset class in the world securitisation market and continue to go from strength to strength. One area of expansion for the asset class is the emerging markets, where the uptake of securitisation as a means of accessing capital is rapidly increasing in general," commented David Barwise, lead White & Case partner acting on the deal.

The transaction is the latest in a string of cutting edge securitisation deals that White & Case has worked on in the emerging markets. Examples include: acting for Russian bank Alfa-Bank in the largest ever publicly placed unwrapped diversified payment right (DPR) issuance; acting for WestLB AG and JPMorgan in the first ever public future flow securitisation of DPRs in Kazakhstan; acting for another Kazakh bank, Alliance Bank, on the first future flow securitisation of DPRs to be guaranteed by a multilateral development bank; advising Merrill Lynch and Credit Suisse First Boston as Lead Managers of the first ever securitisation of credit card receivables in Russia; and advising WestLB as global co-ordinator and initial purchaser in an issue by Turkish bank Akbank, which was at the time Turkey’s largest ever securitisation.

The White & Case team advising UBS Limited on this deal was led by partner David Barwise, working alongside partner Neil Woodgate and associates Jeremy Reynolds, Samantha Levy, Tricia McDoom and Jana Zupikova.

RDB Appoints Sally Gere to New Role of General Counsel; Elects New Management Committee Members
Ross, Dixon & Bell, LLP is pleased to announce that the partnership has appointed Sally Gere as the firm’s new General Counsel. Gere is a partner in the Washington, D.C., office and recently completed a term on the firm’s Management Committee. She will serve as the firm’s internal counsel for all legal matters affecting the firm and will work closely with the Management Committee and David Gische, who was recently reelected for his second four-year term as Managing Partner. Also newly elected to lead the firm are partners Jack Gerstein and Michael Whitton, who join partners Roy Bell, Tom Blair, Eileen Bower, and Robert Pozin on the firm’s Management Committee.

Orrick Lawyers Author Article on New California Trade Secret Statute
Orange County IP of counsel Thomas Gray and Silicon Valley IP associate Daniel Weinberg authored an article about an amendment to California’s trade secret statute that allows successful parties in trade secret actions to recover expert witness fees. The legislation was quietly amended in July 2006, and according to Gray and Weinberg there may be some unintended consequences.
