Miller Johnson Attorneys Present at General Assembly Session for Michigan Healthcare HR Conference
Mary V. Bauman and David M. Buday, Members at Miller Johnson, will present “Legal Updates: Employment and Benefit Laws Relevant to Healthcare HR Professionals” at the general assembly session of the Michigan Healthcare Human Resources Conference in Lansing, MI on Thursday, April 26, 2007. The session will cover areas relevant to healthcare human resource professionals and range from topics such as Michigan’s criminal background check law to the new IRS regulations for Section 403(b) tax-sheltered annuity plans.

Ms. Bauman’s practice is focused on representing employers with regard to employee benefits and executive compensation. She works with employers in establishing, amending, and terminating employee benefit plans of all types. Ms. Bauman is listed in the “Best Lawyers in America®” for Employee Benefits Law. She received her law degree, summa cum laude, in 1986 from the Thomas M. Cooley Law School.

Mr. Buday’s labor and employment practice covers a wide range of industries including an expertise with healthcare organizations. He meets healthcare clients’ needs for guidance on issues such as wage and hour, discharge documentation and ADA/FMLA. Mr. Buday understands the interplay between employments laws and laws that are unique to healthcare such as the Whistleblowers Protection provisions and Peer Review Privilege. He is the chair of Miller Johnson’s Employment – Health Care Practice Group. Mr. Buday is recognized as a Michigan “Super Lawyer” for employment and labor. He received his law degree, cum laude, from Wayne State University in 1989.

Defense Verdict in Philadelphia Construction Accident Case
Philadelphia partners John Livingood and James Prahler successfully defended a Philadelphia crane rental house in a personal injury claim by an ironworker who claimed that he was caused to fall by the movement of the defendant's crane. The plaintiff suffered four fractured vertebrae, a lacerated spleen and liver, and several herniated discs, incurring $283,000 of medical bills. He claimed that he was totally and permanently disabled with a potential future wage loss exceeding $2 million.

All other defendants settled with plaintiff prior to trial, leaving the crane rental company as plaintiff's sole target. Trial lasted eleven days in the Philadelphia County Court of Common Pleas, with the jury unanimously concluding that Margolis Edelstein's client was not negligent.

Summary Judgment For Tire Manufacturer
Philadelphia partner John Livingood and Associate Lindsay Liebman recently obtained summary judgment for a local retread tire manufacturer in a Philadelphia County Court of Common Pleas product liability action by a motorist who claimed that she was struck and injured by a portion of defendant's tire after it became detached from a truck. Margolis Edelstein asserted that plaintiff had not properly identified any actual defect of the tire. Plaintiff claimed shoulder injuries necessitating multiple surgeries as a result of the accident.

James R. Kahn, Esquire Honored by the Jewish Family and Children's Service of Greater Philadelphia
James R. Kahn, Esquire, was honored on November 9, 2006 by the Jewish Family and Children's Service of Greater Philadelphia for his services as Board Chair for the prior three years as well as over 20 years of previous volunteer work on behalf of the Agency. The annual benefit dinner, held at the National Constitution Center in Philadelphia, was attended by 400 guests and raised over $250,000 for the agency.

Jim and the executive committee he chaired were noted for the appointment of new and invigorated management and development staff. Jim's involvement with JFCS began in 1983 as a "big brother". He has participated in many board activities and volunteer efforts and was the recipient of the Young Leadership Award presented by the Jewish Federation of Greater Philadelphia in 1993.

A graduate of the University of Pennsylvania and the Harvard Law School, Jim is a senior partner and trial attorney with the Philadelphia-based law firm Margolis Edelstein. He served as Chair of the Philadelphia Bar Association's Civil Practice Committee. He was a founding member of the Schuylkill River Development Council, Inc. which raised the funds and planned the popular trail and park recently opened along the Schuylkill River in Center City. He also helped establish the Philadelphia Bicycle Club. Jim chaired the board of the Philadelphia Dance Alliance and received the Alliance's Stella Moore Award in 1994.

Bill Hodgman joined the Kitch firm. With over 35 years of experience, Mr. Hodgman will be working in both the healthcare and estate planning practices. His personal practice will focus upon healthcare transactions, commercial issues and estate planning.

Kemp Klein Foundation forms relationship with Common Ground Sanctuary
The Kemp Klein Foundation has formed a new relationship with Common Ground Sanctuary, a local non-profit which helps children and adults with a variety of crisis situations. Kemp Klein has agreed to sponsor all of their support groups and to become active participants in their cause. Our funding will pay for workbooks, flyers, videos and more. Attorneys and staff will participate in at least two hands-on volunteer activities this year, including: cooking and serving a meal to homeless youth in crisis at Common Ground Sanctuary in late Spring and, in late Summer, collecting and stuffing backpacks with school supplies for children in need.

Common Ground Sanctuary has been helping people in need for more than 30 years. Their mission is to provide services to youths, adults and families in crisis. The agency’s 24-hour crisis hotline, youth and family services, emergency psychiatric services, support groups and other programs throughout Oakland County are a lifeline for runaway and homeless youths, families in crisis situations, victims of crime, people with mental illnesses and others in critical situations. Common Ground Sanctuary serves more than 35,000 individuals per year and the agency received Honorable Mention in the 2005 Crain’s Detroit Business Best Managed Non-Profit Contest.
